Description: Miss Rogers was a passenger in a friend's car on their way to school one morning when the defendant pulled out in front of them. As a result, a collision ensued. The defendant died in the collision, and Miss Rogers suffered a herniated disk in her neck which required surgery. The Defendant's insurance carrier settled for the policy limits of $100,000.00, but the uninsured motorist carriers, State Farm and ALFA refused to pay any additional funds. Consequently, the case was tried to a verdict of $115,000.00. Of course, they were entitled to set off the $100,000.00 already paid so the final amount received from trial was $15,000.00.
