My daughter got a ticket for OUI last year. As a parent, I was torn between anger, disappointment, and heartbreak (knowing that an OUI conviction would hound her for years to come). As bad as I felt, my daughter felt much worse.
After a day or two of working through the emotions, we turned our attention to finding an attorney to find out what, if anything, we could do to minimize the damage. We wanted an attorney that specializes in OUI cases and an internet search pointed us to Wayne Foote.
First, Mr. Foote did an excellent job of working with my daughter to calm her fears. He walked through the entire night paying close attention to the roadside tests and the intoxilyzer test. She blew a .17 on the intoxilyzer so he knew it was going to be a tough case.
After reviewing the police report, the dashcam video, and the intoxilyzer room video, Wayne laid out the options including a strategy for contesting the results. He was honest in his assessment and what the expectations were if we went to trial (about 50/50).
We decided to take our chances at trial - and it turned out to be one of the wisest decisions we've ever made. Mr. Foote's trial preparation was meticulous. His cross-examination of the arresting officer was respectful, but brutal. My daughter told me after the trial that she almost felt sorry for him.
But where Mr. Foote really shines is his skill communicating with a jury. Masterful!
After deliberating 45 minutes, the jury found my daughter not guilty. I will be forever grateful to Mr. Foote for the way he got my daughter through one of the most gut-wrench experiences she'll ever face. He kept her informed throughout the several months of preparations and was able to get her excused from almost all pre-trial court proceedings.
If you're arrested for OUI, the single most important thing you can do is call Wayne Foote!
