Unhappy Client with DUI Case and DMV Hearings

This woman hired us for what she told us was a DUI case. It turned out she was driving blood alcohol level above a .20, and was involved in a violent confrontation with the police when they attempted to arrest her. She was alleged by several officers to have assaulted one officer by kicking him in the stomach, and it was allegedly that she had to be peppered sprayed because she had kicked out the windows of the police vehicle causing over $400 in damage to the car. Our office after reviewing reports submitted by officers, receiving her blood alcohol results from the Ventura county crime lab, interviewing the only witness besides the police officers, and going to the location of her arrest, advised her on the likely consequences of her alleged behavior. She became angry when we told we had formed an opinion that was inconsistent with exoneration for her offenses and advised her of the foreseeable and predictable consequences of her behavior. Any competent and honest lawyer would advise a client of the most likely consequence of their behavior, and any lawyer who knew their job well and was privy to the information in the police reports, the witness statements, and the physical evidence would have been ignoring their duty by not informing their client of the reality of their case. Sometimes the best option for the client, when the evidence is overwhelmingly against them, is for the lawyer to continue to work on their defense and also begin to attempt to mitigate the charges or sentence. The most likely outcome of her case is clear, and it was our duty as her lawyer to inform her of that opinion and protect her as best we could. When my office informed her of our opinion she became upset and asked for her money back. She hired us to review her case, provide our assessment of the best defense, and give her our opinions. She is seeking to take advantage of all of work we did and not pay for it, and common sense tells most people just because you disagree with the legal opinion you paid for does not entitle you to a refund. Our promise is to be honest with clients and not to mislead. It is not to guarantee any result. We wish her well and we hope for the best for her, but we stand by our advice and our concern for her future remains.
