Ernesto C. Gapasin is a Senior Counsel at Tully Rinckey, PLLC. Ernesto earned a commission to the United States Army as a Judge Advocate General and graduated from the Judge Advocate General’s Legal Center and School (TJAGLCS) in Charlottesville, Virginia in May 2005. Because of Ernesto's civilian experience as a criminal defense lawyer, he desired to focus all his efforts on Military Trials. As a result, he aggressively sought an assignment to Okinawa, Japan as a Defense Counsel. Ernesto was tasked with raising a Trial Defense Service ("TDS") office on Okinawa where none had existed before. He established and ran the first-ever Trial Defense Service office on Okinawa that serviced Soldiers in Okinawa, mainland Japan, and Korea. Harkening back to his past experiences as a criminal defense lawyer in Las Vegas, Nevada, Ernesto established a policy of aggressively contesting all cases. He developed a reputation for wargaming a court-martial from beginning to end with an aggressive cross-examination style that resulted in a number of acquittals in Okinawa, mainland Japan, and Korea. Ernesto worked a number of high-profile cases that led him to various locales in the Pacific Rim in order to conduct pre-trial investigations. In one high-profile case, Ernesto even took depositions in the city of Manila, Philippines in order to effectively defend his client against rape charges. This resulted in the dismissal of rape charges despite the highly politicized nature of the case involving his U.S. service member client and a Filipina accuser on Okinawa. The dismissal was reported on the first page of local and national papers.

After successfully completing his assignment on Okinawa, Ernesto returned to the Continentinal United States and accepted the position of Senior Defense Counsel at Fort Leonard Wood, Missouri. As the Senior Defense Counsel, Ernesto oversaw hundreds of courts-martial and separation boards that litigated at this very busy field office. Although Senior Defense Counsels are not typically expected to try cases, Ernesto broke the mold, trying a number of courts-martial as the Senior Defense Counsel, and achieving a high-rate of success in an incredibly high number of contested trials. Ernesto also achieved a full acquittal in another highly-publicized contested rape case that resulted in a full acquittal. In a dramatic turn of events, Ernesto’s cross-examination of the accuser resulted in a revelation that she was the perpetrator of a burglary of the home of the accused. The client in this case successfully obtained his Medical Board benefits due to injuries from an I.E.D., and successfully and voluntarily retired from an honorable 14-year career.

When Ernesto was in the military, he also served as an appointed Part-Time Military Magistrate. His function was to preside over pre-trial confinement hearings and to render decisions on whether probable cause existed. He alone determined whether the factors were present that required the pre-trial confinement of an accused. Ernesto also analyzed investigation files to determine the legality of the issuance of search and seizure warrants. As a Part-Time Military Magistrate, it was Ernesto’s duty to balance the facts presented, analyze witness statements and allegations and to render whether or not probable cause to conduct a search and seizure is warranted. Having held the position of a Part-Time Military Magistrate, and having been trained by a Military Judge prior to his appointment, Ernesto is especially skilled in drafting Motions to Suppress or any motions to the Military Court seeking to suppress illegally obtained evidence.

Ernesto graduated from the University of Notre Dame in 1996, where he was active in student government as well as participating in a number of sports, to include the Notre Dame Boxing Club. Ernesto also lived in Westwood, California and studied economics at the Unversity of California – Los Angeles. When he graduated from Notre Dame in 1996, Ernesto was accepted into the University of Missouri (“Mizzou”) School of Law in Columbia, Missouri.

After his first year in law school, he served as a clerk intern in Kansas City, Missouri under The Honorable Dean Whipple, Federal District Judge of the Western District of Missouri. Judge Whipple was a highly regarded Eighth Circuit Federal Judge in Kansas City. Because of this opportunity to work directly with Judge Whipple and his clerks, Ernesto became keenly aware of the intricacies of complex civil and criminal Federal litigation. Working on influential Federal cases from “in chambers” became an important chapter in his development as a military lawyer.

Much of Ernesto's reputation as a relentless cross-examiner began during his career in Las Vegas. He worked on several high-profile criminal cases as a young associate such as State of Nevada v. Murphy, a homicide case dubbed the “Binion Murder Mystery” as portrayed on CNN, Court TV, and numerous other local and national television shows. Several books, such as Murder in Sin City and Quicksilver were based on this high-profile murder case involving the death of Benny Binion, an heir to the family empire that began with Binion's Horseshoe Casino in downtown Las Vegas. Ernesto began his career learning from the best lawyers in the city handling complex murder cases as well as difficult federal cases involving high-level drug distribution and possession allegations. He also had the opportunity to work with famed Harvard Law Professor, Alan Dershowitz, on the Murphy case. The client was ultimately released from jail following a successful appeal that resulted in the overturning of her conviction two years prior.

Ernesto also worked a high-level appellate case in the Fifth Circuit Court of Appeals for an accused charged with smuggling millions of dollars’ worth of narcotics from Mexico into the United States. This appeal was complex and involved international border issues as well as cutting-edge case decisions involving the presentation of drug evidence in the courtroom. Ernesto also litigated criminal immigration defense cases in Las Vegas that were appealed to the Board of Immigration Appeals, which is akin to being the Supreme Court in the field of Immigration Law.

While in the JAG Corps, Ernesto served in a number of positions that broadened his experience in Military Law and Courts-Martial Defense. Ernesto also deployed to Baghdad for a 15-month deployment with the First Cavalry Division out of Fort Hood, Texas. In Baghdad, Ernesto was assigned a position as an Operational Law Attorney advising commanders on the Rules of Engagement and Contract and Fiscal Law in theater. This experience of working Contracts and Fiscal Law downrange also provided knowledge he would later use in the representation of service members facing court-martial for financial fraud crimes against the Government. Ernesto served as a Prosecutor in the Air Cavalry Brigade, 1st Cavalry Division and this service as a former Prosecutor gives him a unique advantage that many military defense lawyers do not have. Ernesto served as the primary advisor to the Special Court-Martial Convening Authority and subordinate commanders on cases in which he served as the lead prosecutor. Ernesto also served as a Recorder (the government representative) in administrative separation boards, and coordinated criminal investigations with MPI, CID, investigating officers, and company commanders. As a former prosecutor, Ernesto also advised company and battalion commanders, prepared charge sheets, and litigated government motions. Ernesto's service as a prosecutor with the Air Cavalry Brigade undoubtedly gives him a unique advantage as a criminal defense lawyer.

Ernesto focuses on court-martial defense and separation boards. He has litigated hundreds of courts-martial and trials beginning as early 2007 that garnered high-profile media attention and were covered by major news outlets such as CNN, ABC News, Fox News, and even periodicals such as Rolling Stone. Ernesto also contributed to a multi-series documentary titled, The War Comes Home, by Elliot Smith of Bloomberg News, which is about service members who deploy to war but return with serious mental and behavioral issues. The Washington Post had contacted Ernesto to act as a subject-matter expert for articles involving a high-profile sex assault scandal at the Naval Academy involving allegations against several football players from the Academy.

Since leaving Active Duty with an Honorable Discharge, Ernesto has tried hundreds of military courts-martial and separation boards all around the globe, to include the Continental United States, Hawaii and Alaska, Germany, England, Italy, South Korea, Japan and Okinawa. Outside the Box Thinking
Mr. Gapasin had a logical, analytical, and outside the box thinking when reviewing my case. This mindset was instrumental in winning my case. I was falsely accused of an Article 120 and had no clue how to even start to defend myself. The first lawyer I retained failed to capture crucial evidence in a timely manner, was not responsive, and was more concerned with the politics in the JAG community. After retaining Mr. Gapasin he quickly began working on gathering any evidence and witness testimonies. Mr. Gapasin provided direction on what I needed to provide him and aspects of the case I should think about and provide him any information that could be helpful. He took the time to walk me through what to expect through out the process. He was also incredibly valuable because his services bridged the gap between being booked to finally getting assigned a Military Defense Lawyer which occurred 8 months after being booked. Moreover, during subsequent motions and pre-trials he collaborated with my Military defense lawyer and myself providing great advice with positive results. During the trial he was professional and on point giving an awesome cross examination in which the “alleged victim” provided contradictory testimony. I would highly recommend Mr. Gapasin to anyone facing criminal charges. He was diligent, patient, understanding, and informative through out the whole process.

Case closed with no probable cause
Listen to Mr. Gapasin’s advice in tb court room! We faced a case that had doctored evidence that was difficult to prove BUT because of Mr. Gapasin’s advice, clear, calm and concise thinking in the court room I was able to keep my career. When you speak with him truth is your best friend no matter how bad the situation looks. He will be busy with other clients so communication can sometimes feel limited BUT when it is time for your case he will guide you to success. He will do he was constantly doing research even in the court room. Be patient, have faith l, and tell the truth no matter what. He will ensure your success. I pray to never see a court room again but if I have to, I would hire him again in a heartbeat.

A CASE OF MANIPULATION AND DECEIT
I was found NOT GUILTY of all charges which included articles 120 (2 specifications) 120c , 128 (2 specifications). In 2021 Everything felt like it was going well, I met this woman who was going on rotation with me but I was kicked out of it when news came to me saying I was reported for a sharp incident. I was confused but was QUICKLY taken to CID. I thought I could clear up my innocence (because I knew I was innocent) to CID and didn't feel like I needed a lawyer (which was my mistake that got me in the mess with a court-martial in the first place)(Don't talk to CID). They had a bias and didn't like that I kept saying she consented. After all this, I find out I am being charged with attempted rape. Fast forward to feeling like a ghost trapped with no information, flagged, and being singled out. I met my wife near the end of 2021 and married in 2022, she helped me find Mr. Gapasin on his website, when I contacted him, he told me to be honest with everything that had happened and I did, he told me that it was NOT a good idea to talk to CID. He looked further into the investigation and discovered both sides of the accused and accuser, he found that the accuser had so much contradicting evidence and it took her 2 years to admit to prosecutors that she in fact consented to kissing, touching and groping in Court. Mr. Gapasin did amazing always analyzing and using logical explanations in front of the judge and panel members, his cross-examination was incredible by Impeaching the accuser and her witnesses. The panel was in shock when they find out that the accuser was telling different versions of the story. She was constantly giving inconsistent statements that contradicted everything that she told everyone involved in the preparation for the court-martial. Her witnesses were also being VERY untruthful and disrespectful. Mr. Gapasin reminded them what they said to the prosecutors and to the government. When the government stopped bringing in witnesses to the stand Mr. Gapasin brought the CID agent to the stand and revealed the investigation was not properly conducted. Mr. Gapasin crushed it by using ONLY the prosecutor's witnesses. The day of the closing statements the panel members were instructed into the deliberation room and in just 30 minutes in that room the decision for the verdict was made...''NOT GUILTY''.My mind couldn't process if I won. When I turned my head I asked him if I did. He told me ''Congratulations you won!'' My wife, mother, and I hugged and were glad we could live a normal life again. If you are looking for an Intelligent well-spoken lawyer that knows exactly what he is talking about Mr.Gapasin is the one, Who can lead you to victory and win your cases. Trust me I know how it feels like being falsely accused for 2 years and Mr. Gapasin made my nightmares go away!

Outstanding Experience
If you’re where I was just a year ago, you’re in a bad spot, with your career, reputation, and everything else you’ve worked your butt off for in jeopardy. I searched for the BEST military lawyer upon being notified of an allegation of a gender discrimination and sexual harassment. Knowing how the story and allegation was twisted, knowing the government has not done their investigation properly, charges were brought against me, I knew I faced an uphill battle and long road ahead. I submitted a form, giving a brief synopsis on what I was up against, and Mr. Ernesto Gapasin quickly called me back. Right away, I knew I had found my lawyer to defend me as I navigated this nightmare of a process. Today, I type this with an immense amount of relief, as Mr. Gapasin successfully won the BOI, convincing the panel members their claims were UNSUBSTANTIATED and that I had committed NO MISCONDUCT! Military Separation Board
Ernesto was well prepared and extremely articulated. He was prepared for my separation board and was able to prepare the witnesses. My wife was a witness and ernesto worked well with her; he was courteous , knowledgeable and answered all of her questions before testifying. Ernesto is without a doubt a lawyer that I would hire again, especially in regards to military matters. His experience helped me get the best possible outcome which no separation Warrented, he went above and beyond what a TDS lawyer would have done. Found Not Guilty of 14 Charges UCMJ
After having multiple sexual assault and maltreatment charges referred to court martial, I sought out Mr. Ernesto Gapasin. Although it was only three months until the trial, he took on my case and started working tirelessly. Mr. Gapasin was very good at communicating what he was working on and really learning my case inside and out. He was upfront about the possible outcomes but listened to me when I said no to different plea deals. He spent time prepping me for the stand and explained that without my side of the story we would have a harder time proving my innocence. Overall, I always felt comfortable and confident in his ability to prove my case. Hiring him was the best decision I could have made!

Not Just a Great Attorney, A Good Friend
I was facing a Separation Board. Ernesto communicated effectively with me and with the JAG lawyers. He executed his duties seemlessly. Although he could not promise a specific outcome he always came up with ideas and avenues to approach the board. During the board he had quick thinking and was prepared. Words can't describe how he performed and his knowledge of the UCMJ system. He takes care of his clients and is well organized. I sought out to look for a military lawyer when I found out I was being court martial. Many lawyers wouldn’t take my case for various reasons but when I contacted Mr. Gapasin, I gave him a brief oversight of what I was going through and my case and he was very helpful with how he could save my career, and freedom. During one of the hardest years of my life, there was no one I would have rather had in my corner than Ernesto Gapasin. I was subjected to a prolonged investigation based on false accusations from an ex-wife that put me under the thumb of the military justice system. After I had the charges preferred against me, I began searching for a lawyer to defend me. I contacted his firm and we quickly scheduled a phone call. He gave clear insight into his potential plan of defense and related some of his experience with cases like mine. I spoke with one other firm and knew I had found my counsel with Mr. Gapasin. Through an unprecedented year, we executed our defense while on two different continents, and overcame some very disturbing elements of the military justice system. His ability to coordinate with the Trial Defense Counsel and understand the intangibles of the military legal system was invaluable. His aptitude to stand firm while remaining humble during multiple hearings, pre-trial, and trial were exactly what I needed. Mr. Gapasin is the attorney you need to hire if your in a UCMJ Court Martial Trial. Mr Gapasin is the absolute best. From the time that I hired him he immediately started working on my case he also briefed me on what to say what not to say to anyone. General Court Martial

The Best Decision I Could Have Made
In May of 2019 I was investigated by NCIS, along with 34 other Activated Reservists, for matters related to travel claim submissions and alleged “overpayment.” They had apparently received a tip that people were claiming “more than they should have been” for their lodging and interviewed everyone to figure out why it happened and what was going on. By the end of their investigation we thought that it would be clear it was a misunderstanding and we were instructed to do the process by our Reserve Admin and Command incorrectly, but what we didn’t know is that they compile results and the COMMAND decides what to do with them. As you can imagine, the powers that be weren’t interested in anyone with rank taking responsibility, namely the Convening Authority who ultimately decided what to do with us. He believed we were all guilty and wanted all of us to burn, take deals, and go home. So much for Leadership Traits and Principles. The only positive thing was I predicted as much before things happened and hired Ernesto Gapasin about 10 days before I was interviewed by NCIS. We reviewed the facts of case along with what would happen next and developed a flexible strategy moving forward. He was very approachable and listened to my daily concerns as things went from bad to worse and the command worked overtime to try and get me to take a deal. They even sent our 1stSgt (who we liked) to talk to us before ANYONE had a chance to talk to an attorney and say we had no chance and we should just take the deals we were given along with an OTH because even if we didn’t mean to do it, “we still did it.” For a Reservist with no background in law or investigations, I nearly took a deal as well but, again, Ernesto alongside my Assigned Defense Counsel kept me grounded and assured me that we would fight tooth and nail for what was right. We weren’t accepting any deals and I wasn’t going to take the fall for something that I didn’t do. The same couldn’t be said for about 30 others though who would take deals within a month or so after hearing that same conversation. I would eventually go on to be the only Reservist left from the original activation on an Active Duty Base where everyone believed I was a criminal. Very few people treated me well and I was an anxious mess needing someone to talk to regularly. I also couldn’t go home after being activated on TDY for over 2 years because I was on legal hold. Again, Ernesto and my defense counsel grounded me and kept me from breaking on a regular basis. My life was on the line and everything would end if I took any form of loss. GI Bill, Doctoral aspirations, everything. A federal conviction would ruin me. After several continuances from matters outside our control, I was finally able to go to court June 2020 (this week actually) to clear my name. It was a brutal dog fight but we were prepared, giving us the ability to catch EVERY government witness in Contradictory Testimony and put on a master class of a performance during cross and redirect. Which leads me to my final point—Ernesto is an amazing attorney. Ernesto is the type of attorney who uses his understanding of the facts and smooth delivery to set traps for the prosecution and illicit the truth during cross examination. NOT ONCE did I feel like, “wow we could have done more,” or “he should’ve done this.” Ernesto nailed everything from Opening to Closing and I waited in that deliberation fearful but confident I would be acquitted. And an hour and a half later...that’s exactly what happened. Ernesto Gapasin not only gave me the acquittal but he also freed me from being here after 3 years. He doesn’t like to lose and he takes your case as seriously as you do! NEVER talk to investigators and stay away from people who could use your conversations against you. He will be the best decision you could ever make when your back is against the wall. I’m living proof!

Highly Suggest Hiring
Attorney Ernesto was an amazing Lawyer. He worked hard and was so attentive to my case. He fought for my case like I would have fought for myself if I had the skills. He is intelligent and knows a lot about Military Law. He took into account my unique situation and molded the way he worked to my needs as a customer. He made me feel confident and like my case mattered. I would highly suggest him to anyone dealing with a military situation or other situations that could use a defense Lawyer. He does all of his research and does not like to lose! If you want a great chance at winning he is the Attorney to have in your court.

Me. Ernesto thoroughly evaluated all evidence, witnesses, and testimonies. He fought for my case even though the military thought they had me guilty. He countered all allegations with facts and proof that there were flaws in the system and it’s staff! Fully retained no discharge!
