Jeffrey Lustick -- a straight speaking, brilliant attorney

I am an older man who was looking after a woman who was seemingly normal, but actually was mentally challenged. I did not live with her, did not even live in the same country with her, but I paid her rent and drove across the border from Canada everyday to look after her meals, drive her around to se...e the countryside, etc. She was a 6-time convicted felon who was trying to change her life, and she was making real progress with my assistance. When I met her, she had no ID, no Social Security card, no food stamps, no welfare assistance, no health coverage, nothing. I helped her obtain all of those things. And she had stopped her life of crime. Anyway, her mental state began to deteriorate, and she started to leave messages, almost daily messages, on my phone threatening to kill me, kill my son, and kill my granddaughter. One day after the worst of those threats, while I was driving her around, she again threatened to kill me, and I responded by giving her a hard shove. She spit in my face, then I punched her. She spit in my face again, and I hit her again. Two spits in my face, two punches in response. I wish I had infinite patience, but there comes a point where I've had enough and will not let my life be threatened without a response. A witness saw the shove. Another witness saw me hit her (but did not notice her spits in my face), and called the police. The police came, inspected her, and found no injuries: I am an older man who has had a stroke, not Mike Tyson in his prime. She was physically fine and did not want to press charges. But I was arrested and charged with assault. I had no prior history of anything. Considering the ongoing threats I had been subjected to, her history of violent acts (6 convictions for stabbing people), and the immediate provocation of threatening to kill me, I thought the state would drop the charges against me. Wrong I was. Even after seeing a transcript of the chilling threats made against me and my family that were left on my voicemail in the last week, even on the day before, the prosecutor was determined to convict me of assault. And he would not budge. Enter Jeffrey Lustick. Jeffrey researched the law and came to the conclusion that I would lose the case if we presented my defense in the context of the threats that I outlined above. A jury might be sympathetic, but would convict me all the same. But he saw another defense: consent. That sounded preposterous to me at first, but the more I thought about it, the more I could see what he was thinking. She was a woman who had spent many years in prison and was used to a violent environment. The fact that she had 3 prior convictions for domestic assault strengthened that point. It actually turned her on when I hit her. I had not thought about it, but I think Jeffrey had hit upon a truth. She was not hurt when I hit her, it actually increased her respect for me and made her want to have makeup sex. In that sense, she actually consented to being hit, it was part of the relationship in her view. And lo and behold, when Jeffrey presented that defense to the prosecutor in his office, and told him he would lose the case if he took it to trial, the prosecutor thought about it -- and days later decided to dismiss the case. Jeffrey was frank with me about what he saw as a poor defense, and he came up with a better one that actually had the ring of truth to it. I was impressed with Jeffrey's thinking, and even more impressed with his ability to present the case convincingly to the prosecutor before trial and persuade him to drop the charges. I learned that, in the law of today, a man cannot strike back even against someone who is actively threatening his life. While I can now see that technically I might have committed assault in the law if narrowly interpreted, convicting me of assault would have been an affront to common sense, given my peaceful history, the total context of the murderous threats I faced, and the little damage I did. Jeff did a great job defending me when I was charged with DUI in 2004 in Skagit County. We won as well in Thursten County but when the prosecuter appealed the district courts decision the case was overturned and I defended myself with Jeff's help for free. I was granted an appeal and the case went to... the State Supreme Court and the appeal was denied. So the case was remanded back to the district court. So I have to start all over again.
