Our firm was founded in 1990 by Diane L. Drain, counselor and attorney at law. Ms. Drain has received an AV rating by Martindale-Hubbell as "exemplary reputation and well-established practice". This AV rating is the highest rating for an attorney and shows that Ms. Drain has reached the height of professional excellence. She is recognized for the highest levels of skill and integrity. Her clients have included commercial mortgage lenders, national banks and professionals such as lawyers and brokers. But her greatest rewards come from helping individuals who are experiencing financial difficulties. Since 1985 Ms. Drain has worked as a lawyer at a large firm and now her own firm. Prior to law school Ms. Drain worked for 15 years as a paralegal, legal secretary and law office administrator.
She appears regularly before the United States Bankruptcy Court. She is a member of the National Association of Consumer Bankruptcy Attorneys, along with several other professional organizations. Diane is a retired law professor (teaching bankruptcy) and is a strong and practical advocate for her clients and well respected in the legal community. For almost 20 years Diane was a member of the Board of Governor's for the State Bar of Arizona. As such she has a responsibility to both the practicing lawyers and the citizens of our State. Diane took those duties very seriously; so much so that one friend referred to her as a "cowboy".

Not ethical

Unfortunately, you are referring to something that happened over a decade ago, I cannot respond to anything specific, so I will reply generically. As so many of my clients have commented- bankruptcy takes a significant commitment that not everyone is prepared to take on. After reading your comment about your husband's failure to be at our meeting, I agree with your analysis of why I was not comfortable helping with a bankruptcy (my guess is there was more going on). In 35+ years I have fired very few clients; each time it was due to difficulties in communication or feeling that a client was hiding something (again I have no idea the specifics of your situation). As to my fees - prior to and after meeting with my clients both my paralegal and I spend several hours working on that client's file. At the first meeting the client pays a fee, which is non-refundable. If the client later decides not to file bankruptcy or I am forced to fire them, then I voluntarily refund any unearned fees (which means calculating the amount of work already done and subtracting from the fees paid). If you did not receive a refund that means the amount of time we spent on your file exceeded the fees already paid. Obviously this was painful for you, but please understand it was also painful for me. When clients reach out to me they are at a very difficult time in their lives. My goal is to help them find some peace of mind and the fresh start promised by bankruptcy. I never want to add to their pain, but I take the sanctity of the bankruptcy process very seriously. Sorry, this now sounds like I am teaching my law students about the importance of professionalism. I sincerely hope that you have been able to find a fresh start and able to rebuild your life.
