    For the first 10 years as a lawyer i represented all aspects of criminal law. Eight years ago I began concentrating on DWI and drug related cases. I am certified as an SFST instructor and as a breath test operator. I own two working Breath Testing Devices (Intoxilyzer 5000EN) and use them in my trial practise. I completed Phebotomy training and am well versed in Search and Seizure law. I have tried a number of regular DWI cases and breath test cases to Not Guilty verdicts. I am DRE certified.

    I am a former police officer and undercover VICE officer having spent 13 years as a Texas Peace Officer. I spent a season as a Municipal Court Judge overseeing traffic cases and ordinance violations. I have been married for twenty years to my lovely wife, Masae.  We have four children and five grandchildren.  We attend Cornerstone Church in San Antonio and conduct a Bible Study in our home every Wednesday evening.  My greatest joy is to see clients make it through their case successfully and give their lives to the Lord in the process.

 

I got my undergraduate degree at Texas State University and my Law Degree from the University of Texas School of Law.  I was admitted to the Texas State Bar in 1992 and have run my own law office since that time.  I have represented a number of high profile cases in the Austin, Texas area.  I am asked to speak on DWI related issues on the local news channels frequently.

 

I have been to the most prestigeous DWI related training in the nation on a regular basis for the past seven years and am known as the DWI Dude on a national level.

Out of State Issue
I came to Mr. Balagia with a traffic matter that was mistakenly showing on my driver record as a conviction which also meant that I would lose my license. Mr. Balagia sat me down and thoroughly explained that he thought this was something that could be resolved. He chose his assistant attorney Mr. Simpson to help me with my case. His assistant attorney Mr. SImpson handled the matter with the utmost professionalism, always responded to my calls and demonstrated a genuine care for my situation. The matter was resolved and I now feel such a great sense of relief and freedom thanks to them. I would definitely recommend Mr. Balagia and Mr. Simpson for anybody who has a traffic matter to resolve.

Solid Criminal Defense
Jamie & his team represented me in a felony criminal defense matter. I was referred to him by my father who'd known Jamie for quite some time. The initial meeting lasted about an hour as they questioned me on what happened so as to determine the best way to defend me. Prior to every court hearing, they called and wrote me to keep me informed as to when to appear. At the conclusion of each appearance they reviewed what had transpired and sought my input before making recommendations as how to best proceed. The case was difficult in that I didn't give them a lot to work with; that said, Jamie provided me with solid advice and we were able to reach a good conclusion with the State. I avoided prison and have a second chance that I am making the best of. I would recommend that first, it's better not to get in trouble in the first place, but, if you do, I wouldn't hesitate to hire Jamie again.

Best Damn Lawers Around!
Very professional, trust worthy, polite, extreamly smart. Team works together great before trial and during trials, was surprised at the amount of attorneys that were working on my case at any given time, if i ever have any type of legal matter I will be contacting Jamie and his team first!

Excellent attorney....He will fight for your rights....expensive, yes. He will go the distance .... He is a wonderful person, he took care of my son. I would highly recommend...you have to follow up tho... If you ever get a DWI in the surrounding counties .....this is the man.

Great!!!
I was recently arrested for DWI/Possession of marijuana. Jamie and his entire staff did an amazing job. DWI Dismissed!
I had been arrested for DWI almost 2 years ago. Jamie and his staff worked tirelessly so justice would prevail. After reviewing the DPS tape my lawyer, Tristan Dau submitted a 'Motion to Suppress' based on an invalid traffic stop. The judge reviewed and had no choice but to dismiss the case!!! I have my life and reputation back and could never repay these guys for this judgement. Hire Jamie Balagia!!!

Non-discloure Agreement (NDA) Success
I have a misdemeanor arrest on my record from 10 years ago and dreaded every time I had to submit to a background check for a new job. After reviewing my case's history, my attorney, Tristan Dau, walked me through my available options, ultimately saving me time and money. LIFESAVER - aside of God of course!
I was reluctant to trust one of Jamie's staff attorney's but he really does hire GREAT associates. TRISTAN was excellent and pulled me out a a horrible fire. I had a DWI charge in Hays county and then got one in Bexar. I am a pretty responsible and professional person and never thought I'd ever be in this position in my life. We went to trial 2 times for Hays county and then able to get Obstruction of a Hwy deferred adjudification. WOW. I have an opportunity for a job that looks promising. That never would have been possible before their help. I owe them a debt of gratitude. Thank you!

Success!!!
I was stopped last year for a traffic offense which tunred out in my arrest for a DWI which I felt was wrong. I contacted Mr. Balagia's office for representation and from the first time I spoke with them I knew I had found the right guy. They helped me from the very beginning and made me feel very comfortable. Mr. Balagia was certain that we would win the case one way or the other. Every step of the way he answered my questions. Great law firm to work with
I was arrested for two Class A Misdemeanors and was facing a year in jail on each charge. The prosecution had a very weak case and was taking their time moving this forward to a jury trial. After much postponement, the prosecution was ready to discuss a plea bargain. My lawyers were able to successfully negotiate a plea agreement which entailed dismissing one of the charges all together and lowering the other charge to a Class C Misdemeanor with a 90-day deferment and a fine. After the successful completion of the 90-day deferment, the Class C Misdemeanor would be dismissed. I believe this plea agreement was in my best interest as it avoided going to trial, which we felt our case was strong and in our favor based on the facts, but it still would have been a crapshoot as to whether we were going to get a favorable jury considering this occured in a small town. A special thank you to Jerry Smith, Tristan Dau, and Tracy Holder for all of your hard work on my case. I would definitely recommend their services.

I recommend Jamie Balagia
I was arrested for class B DWI. I made the mistakes of taking field sobriety test and breathalyzer. They were not in my favor. But Jamie and his staff worked diligently to win me deferred adjudication. After 18 months of no arrests my record will show no evidence of a DWI. This was a very emotionally stressful ordeal for me but Jamie and his staff handled all the details and got me the best possible outcome in my situation. I am very grateful for their expertise.

This was a great result for our client but I am so angered by the current consequences of a DWI. I was so happy to be able to keep a conviction off another person's criminal history record. Please speak out in your community to get support for the idea of a Deferred Adjudication for DWI cases.

A hard fought battle against a court system that took every opportunity to harm our client. We never gave up and gave back two hits for every one they gave us. Jamie Balagia-the best defense lawyer bar none!
Jamie Balagia and his staff were extremely professional, responsive and did absolutely everything and more in my best interest. From Mel to Hallye to Jamie. I have never met a more professional bunch. My world had crumbled when I was arrested for dwi an falsely accused of making statements to a Dps trooper. It felt like the whole world was against me. Whenever I hear people say that DWI cases cannot be won I know different. Whenever I hear people say that police officers do not lie under oath I will think of this case. A great judge and an ethical prosecutor saw the light on this officer's make believe story and helped us get a Not Guilty and a complete expunction of the arrest.

One of a kind Lawyer
Mike from Round Rock : This has been a long hard road for me to relive my williamson county nightmare . I was charged DWI , I had to fight all the way , dealing with untruthful Wilco Cop & DA . My first attorney threw me under the bus and I found out he works with wilco , so sad . Then I found Jamie and we went to trial . Jamie was a multidimensional common sense trial lawyer from picking the jury to summation and we won the case . Great staff . They will work out payments if you need . Too bad there's not more like him to fight for are liberties & rights eroding away , so many things to be a crime that it becomes impossible for men to live without breaking laws . BELIEVE in the DUDE!
Jamie Balagia from day one made me feel that there is no case that is not able to be won. His skill, knowledge, experience and highly educated lawyers that also help handle all the cases (Tristian Dau!) are a power house of an attorney team. I would recommend you and I already recommend friends to put their trust into Jamie Balagia (the Dude) and you will not be disappointed! If he asks you or tells you to do something, don't ask why just do it! It is always some part of the plan or strategy to take it in for the win! This was another case where CZ stood tall and trusted us enough to go to trial and risk a jail sentence had we lost. Good things happen when you go to trial and the jury sees that sometimes witnesses lie and then the jury does the right thing!

Current Client
I recently got in some legal trouble and called Jamie's office. No, he was not the one that I met with to discuss my case, but I didn't expect someone as busy and successful as him would be. Although he did come in and make a loud and entertaining appearance. Since my case has started, everyone in the office has been extremely helpful. Yes, it is expensive, but they are more than fair with payment plans and down payments. The reason I chose Jamie was because he got my friend's marijuana case dismissed. He is the best. Everyone smiles or shrinks in their chair when he enter the court room. No one else is worth the money.

Would Recommend!
I hired Mr. Balagia's team for my DWI case. We were able to get a Pre-Trial Diversion. Fees are alittle high but well worth every cent. The lawyer(s) who were assigned to me responsed to every communication within a reasonable time frame. Still working with the team and they have done an excellent job. Would I recommend the firm, yes, and I have already.

Pre-trial diversion means no conviction and the opportunity to file an Expunction to get a clean record. Chad had to perform a number of conditions to earn this PTD and we were happy to get him there. And remember "great lawyers aren't cheap and cheap lawyers aren't great".
