After engaging in discovery, charges were voluntarily dismissed by the prosecutor.
The Government applied for a career offender designation and a sentence of 92-115 months. After an evidentiary hearing I sucessfully defeated the career offender enhancement and secured the statutory minimum sentence of the client.
Government applied for a sentence of 18-24mo after a lengthy evidentiary hearing client was sentenced to only 90-days in jail.
After briefing the matter as amicus counsel to the Missouri Supreme Court, the conviction was reversed and the client was freed on a writ of habeas corpus.
Client was facing a mandatory 60-month sentence. I was able to secure a "safety-valve" reduction and client was only sentenced to 30-months.
