A Disaster Attorney To Retain

This attorney was a disaster for my foreclosure defense case. He ignored to file my case for 18 months despite having all the documents and after finally filing it, he did not do anything and my case was dismissed just in 5 months by the trustee due to "UNREASONABLE DELAY." I was making my payments ...to the trustee on time and have all the records to prove it. He never showed up in any trustee's meeting and lied about I have not sent him documents on time. He also lied about his fee that I did not pay. He tried to collect it second time after my case dismissed by the trustee when his fee actually was paid long before him filing the case. We went to trial in Dupage County about his fee that he falsely claimed not being paid and he LOST the trial based on the evidence (Copies of the checks) I presented to the Judge. This is so CRAZY. I retained this attorney to defend me and my case, but now, I am defending myself against my own attorney before the court. It took him 18 months to file my case but it took him only a WEEK or less to file and collect his ALREADY PAID FEE second time directly from the court via trustee's account. He said he will modify my mortgage at 2% interest rate and make sure 2nd and 3rd mortgages are wiped out. I had to order a new appraisal of my house to establish and prove the new market value of the property to the court. If he filed my case on a timely manner and did exactly what he said he would, I would have not lost my house because at the time of retaining him, I was not too far behind my mortgage and could catch up with the modification. But this never happened. I had to retain another attorney to refile my case but at that time, it was already too late for me to catch up with the payments.

stopped sale of my home and had lender modify the loan

The bank said they were reviewing me for a HAMP loan modification but the house was going to be sold anyway I found out. Kevin Benjamin was recommended. He stopped the sale and the lender agreed to a modification of the loan. I am so happy I hired Mr. Benjamin.

"Loan Mod" without a "Loan Modification"

While many "loan mod" companies were taking money and getting no results Mr. Benjamin showed me why the property did not qualify for a "HAMP" loan modification but showed me how Chapter 13 could restructure my debts and with the savings I did not even need the lower payment, all I had to do was reque...st the arrears be put on the back end which was much better from the lenders prospective, not to mention the Automatic Stay had already stopped the foreclosure. I was able to restructure my debts that allowed me to "modify" the loan without going the the HAMP nightmare.

Saved our home from foreclosure

Lender was foreclosing on our home claiming arrearages that were not accurate. They have given us the run around on a "loan modification" but were foreclosing anyway. Mr. Benjamin said it was called "dual tracking" and he was correct. The lender would not work with us. The lender caved and M...r. Benjamin wound up having the foreclosure dismissed. His office was always responsive and our assigned case manager was terrific and always responded to our needs. Whenever I needed to talk to my attorney all I had to do was schedule a consult through our case manager and it was set up. No phone tag or leaving voice mails. The communication during this stressful time was very much appreciated.
