I am very concerned about the increasing aggression for warrantless searches against citizens shown by law enforcement that I see in my practice. It appears that many of them do not even care about the Fourth Amendment of the US Constitution, and pretend that front doors to homes do not mean anything. They even make traffic stops for no other purpose but to search "suspicious" vehicles.
We defense attorneys need to be zealous about defending the Fourth Amendment rights that belong to ALL of us-- they are a precious heritage from our Founding Fathers!

No offense is too small a crime in Polk County
I retianed Attorney Averbuck for a charge of failing to notify of change of address in 30 days( I got stopped while moving from one home to another)! I offered for Atty. Averbuck to negotiate a payment of ticket with no misdemeanor on my record. He said "You are not wrong.. I appreciate the offer.....

Criminal charges. Aggravated Assault w/deadly weapon, no intent to kill. Improper display/ exhibit of a concealed weapon.
Mr. Philip Averbuck had the felony charges that were against me dropped in no time. He then helped me w/the misdemeanor gun charge. We selected a jury, then had the trial the next day. Mr. Averbuck questioned the 3 people who were testifying against me. He cross examined them carefully and tactfully,...

Took care of everything
Mr. Averbuck is my go-to lawyer. He handled my traffic ticket without my having to worry about it at all. His assistant Joeann communicated with me through every step of the process. Adjudication was withheld and the fine was reasonable.

Do not use this Attorney
My husband was referred to this attorney by someone we know. His rates are way overpriced for the services he provided. My husband rarely was able to speak with him and he misled my husband to believe that he was in the Florida Diversion program when he was not. I had tp finally reach out to the Flor...

Do not hire
Do not hire this attorney unless you want to pay out money for nothing! He cost me an arm and a leg to represent my son for sentencing. I could have saved the thousands of dollars because the outcome of the sentencing was the same as if we had no lawyer. He is horrible when it comes to communicati...
I am very sorry this case did not get a better result for your son. It is always an uphill battle to represent a client after they have been found guilty at jury trial and have a significant number of "sentencing points," but we try to do everything in our power to improve our chances with the judge at sentencing. I believe in this case we also filed a motion for judgment of acquittal notwithstanding the verdict, which may be useful for him in a potential appeal. I hope we can rebuild your confidence in us.
"I endorse this lawyer. I recently had the occasion to resolve a sensitive matter with Attorney Averbuck on the opposing side. His professionalism and candor was extraordinary in light of the nature of the situation. A true scholar and gentleman."
"I endorse this lawyer. Mr. Averbuck is an excellent litigator and is very proficient in the rules of evidence and criminal procedure."
