Light at the end of the tunnel...

One drunken night in Miami set me on a collision course with it’s criminal courts and threatened to undo me as a whole. I’d found myself in jail and facing very serious assault charges on a police officer. Needless to say, the outlook was grim at best. My priors from 20 years ago were definitely not ...helping. To be honest, I was scared, alone and facing serious time. My public defender’s performance only served to put me further in the courts hole. I had to do something. That’s when I was referred to Michael Haber. After one conversation with him and Marc, I knew they were the real deal. He asked me the tough questions upfront and set my expectations. I paid my retainer and the following day, they’d filed more motions in 24hrs, than 3 public defenders had done in an entire year! The prosecution now realized, actual work would be required. I finally took a very favorable plea deal for 2 years probation. No special conditions, freedom to travel for work and the ability to complete probation in half the time. This was a big win for me, seeing as my priors did me no favors and the trumped up assault charges on an officer were going to bury me. Money well spent and I’d most certainly recommend Michael Haber to anyone facing bleak circumstances.

Dear Anonymous, Thank you very much for sharing your experience with the folks via #HaberPA's 179th AVVO Client Review. It's true that once we got on board we absolutely peppered the State with motions (not one having been previously filed in your case) and that in so doing - forcing the State Attorney to actually open their file and work - we achieved your litigation objective (it's important to note that because of your prior record you were specifically not seeking an acquittal at trial; rather you wanted to close your case cleanly, sans risk, with straight probation and leave to freely travel throughout the US)... But I feel that I need to give a shout out to PD's (and most especially those here in the 305) and explain that although they generally can't afford to offer up the time and personalized attention that a private lawyer brings to the table, PD's are almost all excellent attorneys, generally being extremely well-versed in both the law and their courtrooms. Contrary to popular belief, it is not easy to either get hired as, or to remain employed as, a PD (again, especially in the 305). It takes brains, ethics, effort and commitment. It is an often times thankless job and attorney's who are not committed to it simply do not last. For those who do, however, their client's usually benefit not only from the day-to-day knowledge of their individual courtrooms (including but not limited to knowing the tendencies of their Judge, their prosecutors and the other instrumental court personnel) but also from the vast resources that the PD brings to the table (investigators, experts, etcetera) without further expense to the client. I have the greatest of respect for those guys and gals who earn a pittance yet generally try so hard and accomplish so much. That said, there is no substitute for privately retained criminal counsel (although - sadly - there are plenty of snake oil salesman / worthless private attorneys out there). As you have so nicely illustrated, when you retain #HaberPA we pledge - and deliver - to: A) provide honest & realistic litigation objectives; B) quote and honor fair fees; C) always be available & responsive; D) keep you fully informed; and by doing so E) earn your positive client review at the conclusion of the case! Michael Haber, an attorney you can trust

Just 8 month ago this would of been way too embarrassing for me to admit but looking back I have to be completely honest about what happened I was arrested on 4th DUI. My third DUI happened less than 5 years earlier and I was still enrolled in a DMV program trying to earn back my drivers lisence at t...ime after bonding out of jail I called a police officer friend of mine and he told me that I needed to call Mike Haber. I did and mike met me the same day he ask me a lot of questions. He was patient and thorough and he listened,but then he shocked me with my reality I didn’t want to believe how much trouble I was in - mostly because I was in denial - and honestly in that moment I was not thrilled with what mike told me he said that I had an alcohol problem that I probably had underlying mental health issues and no matter what I definitely had a going to prison problem but mike also assured me that everything was manageable if I followed his plan mike told me that unless I got lucky with some screw up by the police then my only shot at avoiding jail was to agree to spend 90 days in an inpatient substance abuse program he explained that this wasn’t only a strategic for court but that if I took it seriously then it could also save my life. Again honestly looking back on that conversation I was far from thrilled but then again I was also in denial so I went home talked to my wife and my police officer friend and realized a few things I had 3 different lawyers represent me on my other DUIs but not one of them thought or talked like mike none of them even considered my life outside of court and none of them was referred to me by a cop so I called mike back and agreed to go check out the facility that he had recommended long story short I spend 90 days in rehab then another 45 in an intensive outpatient program I am- to this day - in follow up treatment and mike was 100% correct not only did he kept me out of jail but he also put me in the right place to understand the reasons for my alcohol addiction and how to maintain my sobriety in the end mike was right about everything whenever I called him he always told me to stay focused on my sobriety and treatment and to let him worry about court it took me 8 month but my case is closed I am not in jail and sober mike performed and I can’t thank him enough if you need a criminal lawyer and want one who you can trust then don’t hesitate to call Mike Haber!

Dear Anonymous, Grammatical errors not withstanding your (#HaberPA's 178th AVVO) Client Review was outstanding. It is obvious that you gained incredible insight, understanding and an appreciation for your situation, and it is equally apparent (as well as most appreciated) that you've given me credit for both having steered you in the right direction and considered your legal and personal needs. As a lawyer I'm ethically bound to perform several functions (see Chapter 4 of the Rules regulating the Florida Bar, specifically Professional Conduct), namely serving as an "adviser, advocate, negotiator and evaluator", and this is what i did in your case. I took a global view, put together a plan and (at times struggled to have) kept you focused on the only objective of consequence, to wit: keeping you out of jail / prison. It wasn't just the facility that I chose for you (a dual diagnosis facility specifically structured to deal with both substance abuse and mental health issues) or even the private forensic psychologist whom we employed (and who's significance cannot be understated) or even my knowledge and negotiating skills, but, most importantly, it was your own provable, steadfast and unwaivering commitment to amenable and meaningful participation in all aspects of your treatment protocol (over an extended period of time) that carried the day... so props and kudos to you, because in the end it was you who kept yourself out of a cage. Dear Ryan, "You mean, let me understand this … cuz I … maybe its me, maybe I’m a little f*#%ked up maybe. I’m funny how? I mean funny, like I’m a clown? I amuse you? I make you laugh? I’m here to f*#%in’ amuse you? Whattya you mean funny? Funny how? How am I funny?" (Tommy DeVito in "Goodfellas") Precisely like Joe Pesci was doing with Ray Liotta I am teasing you, in good spirit and as a friend, but, because the folks have no context I'm gonna take a moment to explain. In your case your dog had chased and was barking at a passing-by pedestrian. Because of the commotion you walked out of your front door at which time the pedestrian yelled at you "if I had a gun I would shoot your dog". You considered this to be a credible threat and so, in response to, and from the sanctity of the front door of your home, you brandished your handgun and said "if you ever come to threaten my family or my dog I will kill you". Shortly after that the cops appeared, and even though both you and the complaining witness gave the exact same rendition of events to the man (including the statements), you were arrested for aggravated assault with a firearm. Marc and I explained to you that per FL's Stand Your Ground Law this was a bad, wrongful and unlawful arrest, that as such you had become a victim (as opposed to the pedestrian) and that you were entitled to statutory immunity from prosecution. The "funny" thing (which is actually quite serious) is that because you were understandably rattled and scared we had you chanting "I'm not the Defendant, I am the victim", and that was our mantra for you in your case. Fortunately, unlike the responding cop (who did not have the benefit of #HaberPA explaining how the law applies to facts before he made his p*ss poor decision to arrest you), we were able to get the State Attorney's Office to see this situation for what was and they agreeably took "no action", dismissing your case (rather than forcing us all to expend the resources to jump through the legal hoops of conducting an evidentiary SYG Hearing which clearly would have resulted in a grant of immunity). All of that said, and in contrast to my long winded reply, your client review (#HaberPA's # 177th on AVVO) was clear, concise and is most appreciated. The Best

Even though I was in a tough circumstance, he was able to communicate a sense of calm. Clearly outlined my options and walked me down the best one. This lawyer also seemed to know everyone in the courthouse.. Judges to secretaries.. The outcome was never in doubt, and it was a very positive one I may... add.
