Hello Thomas & thank you for your entirely unexpected 5-Star Client Review, which is concurrently #HaberPA's 279th Client Review on AVVO & is also a misnomer. It's a misnomer because Thomas is not & has never been a client of mine; rather I responded to a question that he posted on AVVO in late September of 2023 & since then Thomas has periodically sent me direct questions via AVVO's email option (7 of them by my count), the most recent of which was today (ergo how I was able to associate his name with this review). Anyone who's read any of my Client Reviews knows (or should know) that my protocol is to author detailed, thoughtful responses to those who took the time to share their professional experience with me & that I do so both as a grateful courtesy to the client & to offer guidance to the readers. That said I'm not going to detail the point of any of Thomas' questions; rather, in addition to thanking Thomas I'm going to take this opportunity to make a generic statement about how I view AVVO & my years of participation. As to the former, I see AVVO as a platform for folks to seek generic ("generic" not case specific) information about their respective legal issues from a variety of participating attorneys, & in that way it's the legal system's functional equivalent of any of the many no-cost "Ask a Doctor" websites. Just like those medical platforms responses can be wonderful sources of generic information but they're also extremely limited & for that reason "answers" (which I personally refer to as "responses") can range anywhere from helpful to misleading to inaccurate to outright hurtful. Noting that I won't speak to any other practice area when it comes to Criminal Defense Litigation charges can & do recur (i.e. different folks routinely suffer the same charges) & some questions are sufficiently generic as to be responsibly answered online (e.g. "process" queries or inquiries about certain Rules) but it's a Criminal Defense "universal truth" that each case & every client are uniquely sentient, they must be treated accordingly & any Criminal Defense Lawyer who fails to treat them as such does a disservice to all (ergo Thomas saying: "Always gave the truth even if I didn't like the answer."). Because of this I'd say that it's nearly a 50/50 split between any of my 42,893 (to date) responses being "responsive" & therefore "liked" by the Asker versus my either redirecting the Asker to her / his lawyer (aside alert: the only thing that amazes me more than the number of represented folks who actually seek case specific advise from random lawyers on the internet is the number of AVVO participating lawyers who, as I see it, choose to play "Monday Morning Quarterback" to a lawyer of record & offer irresponsible answers) or to locate a local lawyer & have a meaningful, responsible & confidential consultation, & the difference is stark. When one seeks a consultation at #HaberPA I'm able to take a "Global Approach" to that individual Client & her/his distinct case, I make it a point to come to understand the Client & her/his specific situation, I'm able to adopt the Client's interests as my own, identify & secure realistic litigation objectives & then quote & honor reasonable fees (in writing) but on AVVO I don't have that luxury (in other words I'm limited & my responses must necessarily, & ethically, reflect those limitations, which can & often does result in "dislikes"). Still, even with that limitation a lot of "good" comes from AVVO (albeit again mostly with regard to generic, answerable questions) & so I'll continue to happily donate a great deal of time participating, be it by offering honest responses to questions (again 42,893 to date) & responding to emails or phone calls from AVVO Askers. Be it Thomas or anyone else please know that you're always welcome to ask me anything & while I promise to respond to you I can't guarantee that you'll "like" my response. Ty again Thomas. Amazing lawyer

I’m extremely grateful for the help and dedication my lawyer showed throughout my case. I got caught up in the wrong crowd while riding my e-bike with some neighborhood friends, and what could have been a very stressful situation was handled professionally from start to finish. He took the time to... understand my situation, created a clear plan, and worked hard to get the best possible outcome. In the end, my charges were completely dismissed, and I was able to move forward without a criminal record or any impact on my driver’s license. I truly appreciate his professionalism, communication, and commitment to my case. Dear Alex, Right out of the gate I want to thank you for 3 things: 1) For your kind Client Review (#HaberPA's 278th 5-Star Client Review on AVVO); 2) for not identifying yourself (i.e. "Alex" alone is such a common name that I can comfortably explain the facts & circumstances of your case to the folks without violating either Client Confidentiality or Attorney-Client Privilege); add 3) for the timing of your review which immediately follows the one submitted by your father (# 277) to which the last sentence of my reply was "Hopefully your son will submit his own review so I can explain "the why" of it", thus allowing me to make good on that promise. I also want to make an initial observation about this comment to the folks, to wit: Kinda' like a PSA (Public Service Announcement) this reply is both instructional to the reader & complimentary to Alex as it demonstrates how an otherwise "good kid" (or adult) can make a bad decision(s) that lead(s) to bad things but, if handled properly, it can still work out well. You received a Criminal Traffic Citation for Reckless Driving which simply alleged that you were operating an E-Bike with "one wheel up" on a public road & you were cited for Refusal to Obey a Lawful Command, specifically to stop / pull over when The PoPo lit you up with lights & sirens. For reasons I'll explain below you weren't taken to Jail; rather you were issued a Promise to Appear / Notice to Appear & released from the scene, so no Probable Cause Affidavit / Arrest Report was ever authored. I know the Police version of events because I watched the Body Worn Camera footage which began with you & your E-Bike crashed on the pavement & concluded with the Cops letting you walk away with written citations. The lesson here is that in many (not all) Misdemeanors Police Officers have discretion to either PTA / NTA you or haul your ass off to Jail & in 99 of 100 times the difference maker will be your attitude (be it actual or as perceived by your "Stop Cop"). The BWC in this case clearly showed that while you didn't stop as fast as the Cops would've liked (in fact your stop was a consequence of your having wiped out while trying to get away) once contact was made the Cops were none to happy. Still at all times you were polite, respectful, contrite & deferential to authority. Had you been antagonistic, had a proverbial chip on your shoulder or otherwise been contrary then you likely would've been held in "Contempt of Cop", taken to Jail & suffered all of the indignity, discomfort & costly Collateral Consequences attendant thereto. Another lesson is that by willfully failing to stop after being lit up Alex technically committed the Felony Crime of "Fleeing and Eluding" (which would've mandated booking) but the choice to be mannerly & polite resulted in the exercise of Police Discretion thus avoiding a Felony Arrest, as well as any "Gratuitous Charges" (e.g. Resisting Arrest). The BWC gave me insight into Law Enforcement's mindset (plus the fact that Alex was the only one in a group of E-Bikers who 'd got got) but I also needed to know something about my client, which I learned by speaking with Alex & his father & which was supplemented by providing me with his final Report Card (which reflected a 3.922 GPA), a Certified Funded Trader Certificate which he'd earned during his senior year in High School, "Safe Driver" status with DMV & a lack of Criminal History. That, combined with a proffer that the other E-Bikers were local kids & it wasn't a "Wheels Up Guns Down" street takeover (which everyone but the participants abhor & have no sympathy for), allowed me to prove that Alex didn't deserve the Scarlett Letter associated with a Criminal Traffic Offense for his isolated dumb choice to "Pop Wheelies" with his pals rather than to Day Trade indoors. Being a provably good person pays off, as does following The Golden Rule (i.e. "Do unto others..."). Thank you again & I wish you all the best in life Alex. Fondly, MAH/Esq. #HaberPA

Happy Parent ….

My 18 year old got himself involved with a group of E Bikers riding out one day, and ended up getting a couple of charges. Great kid ,wrong crowd!! I was desperate, started calling friends about what to do, or give me advice . One personal friend I’ve known for over 30 years and has been in Law enf...orcement for around the same time, said I know a guy, call him , his name is Mike Haber. The very next day I called Mike, I gave him the story on my sons situation and on his background. Dear Happy Parent, Thank you for your very kind words (which now constitute #HaberPA's 277th 5-Star Client Review). I want to let the folks know that I recently authored a reply to another person who'd hired me o/b/o a family member (in that case it was a "Significant Other" not a child) which took a deep dive into the ethics of "Third Party Representation" so I'll avoid that here, instead focus on some of the salient points that you mentioned & ask that anyone who's interested in the Legal Ethics aspect of Third Party representation please read #HaberPA's 273rd Five-Star Client Review below. That said I'll start with a philosophical observation: Regardless of race, religion, socioeconomic status or other measure all humans share the same "cycle of life" (i.e. we're all born, ultimately die & if we're true to our own cultures then we share common societal experiences.) At age 60 (soon to be 61) I look back at a time where my life was all birthday parties, then it was "coming of age" events (e.g. Bar Mitzvah / Bat Mitzvah / Quinceañera / Confirmations / etc), then it was weddings, then it was celebrations of birth (e.g. a Bris / Brit Bat / Christening / Baptism) & now it's funerals (welcome to reality). With that in mind it shouldn't be surprising that my professional career (which will turn 35 in October, 2026) has seen the same sort of "social evolution". On the day that I was set loose on society by The Florida Bar I "hung my shingle" as a private Criminal Defense Lawyer & in order to learn how to do what I had dreamed of doing I began by serving as a Special Appointed Public Defender. My early career was spent in Juvenile Court & Misdemeanor Court & when I was sufficiently skilled I tackled Felony Court. It wasn't long before I was Court Appointed as a SAPD to more serious crimes (e.g. Burglary, Robbery, etc) & inside of 10 years it was mostly Drug Trafficking & various Homicide cases. As I gained more experience & exposure I developed a private practice which allowed me to transition to "a better class" of clientele (e.g. folks who could afford to actually pay for the substantial justice that I facilitated), say "Adiós" to serving as Court Appointed Counsel & create a truly boutique Criminal Defense Litigation Law Firm. Apropos of my "cycle of life" observation there came a time where I began routinely representing the kids of my own friends & contemporaries (usually for [bad pun warning] "minor crimes"). Having a 21 year old son of my own for the past 2 decades each time that I've done do so I've silently thought to myself "but for the grace of God there go I" & while I treat all of my clients in a "boutique fashion" (e.g. like an old school family doctor) I'm especially attentive when a parent entrusts me with their child's Criminal Record (& possibly their liberty). In your son's case this was doubly true as you were referred to me by a mutual friend who happens to be a Police Officer & whenever a Cop refers my services to someone whom s/he cares about (as here) it's even more meaningful. (Aside alert: I met our mutual friend about 25 years ago in a Cocaine Trafficking Case where I accused his Police Department of negligently vetting & supervising a Confidential Informant which resulted in my client's legal Entrapment & after peppering them in a Motion to Suppress he & I forged a close, personal friendship which continues to date, proving that Defense Lawyers both battle with Police & Prosecutors & can concurrently forge respectful relationships outside of a Criminal Courtroom.) In your son's case Cops wrongly equated him with other "Wheels Up Guns Down" asshats & treated him accordingly; but when we proved that he had a 3.9 GPA, earned a Funded Trader certificate & was an otherwise "Safe Driver" (to their credit) they quickly came around & gave him a pass. Mike the sharkkkk

I had a bench warrant for an old ticket in Key West that caught up with me, landing me in jail. My lawyer was an absolute shark—sharp, relentless, and effective. He got me out quickly, handled everything, and even arranged it so I didn’t have to appear in courtsomething that seemed inevitable. Dear Anonymous, Thank you for your awesome words in what's now #HaberPA's 276th 5-Star Client Review on AVVO. I'm thrilled that you didn't identify yourself as I can now share details about your situation that may be helpful to anyone who reads this reply. I'll start by returning to the word "details" & shouting out to Lee Child, the author of the Jack Reacher book series (which morphed into movies & television) & that character's recurring tagline that "details matter", a lack of which is precisely what got you into trouble (more than once). In 2021, at age 17 you received a Uniform Traffic Citation somewhere in Florida. For reasons unknown (albeit likely due to youth) you failed to take action within the 30 day window (aside alert: if you receive a Traffic Ticket in FL then you must either pay it, have it set it for Court or if you're eligible then formally elect driving school; aside within an aside alert: those instructions are clearly printed on every UTC & or it's attendant flyer) & as such your Florida Driver License was suspended (ergo "details matter" & your first failure to pay attention to details). Despite this snafu you were a "good kid" who had no contact whatsoever with Law Enforcement until 3 years later when while vacationing in Key West you were stopped for a Non-Moving Traffic Violation (i.e. a broken tail light). As further proof that at age 22 you remained a "good kid" the Key West Police Officer who pulled you over & who then discovered that you were Driving with a Suspended License gave you a pass on the technical violation (i.e. he didn't give you a ticket for the tail light) & he decided not to Arrest you; rather he issued you a Notice to Appear / Promise to Appear in the form of what presented as a normal Traffic Citation. (Aside alert: In many Criminal Traffic situations Police Officers enjoy the discretion to NTA / PTA you or to take you into custody & depending upon the jurisdiction some Police Department protocol is to put the date & time of your mandatory Court appearance on the citation whereas others don't, leaving it to the Clerk of Court to notice you via snail mail at the address on your Driver License. Further, while Criminal Traffic Tickets look exactly like Non-Criminal Traffic Tickets the differences are stark, to wit: unlike the non-criminal variety which allow you to choose how you wish to handle it within 30 days the criminal variety come with a mandatory Court appearance.) Your second "details matter" fail came when you accepted the citation but never bothered to look at it, see the date & time of your Arraignment & thus Failed to Appear at the Key West Courthouse causing an Arrest Warrant to issue. Despite your inattentiveness to details you remained "a good kid", & I can prove that by proffering that while you missed your 2024 Court Date you did promptly "fix" the 2021 DL Suspension. While you knowingly had a valid FL-DL you unknowingly had a Bench Warrant & it wasn't until 27 months later (in 2026) that you became aware of the Alias Capias & this awareness didn't come to pass because you had committed any new law violation; rather you (an otherwise "good kid") were taken into custody when you routinely & innocently approached the Customs & Border Protection (CBP) checkpoint at Miami International Airport after having arrived on a return flight from an international vacation. Despite you quickly contacting a family member who reached me & who assisted your family to Post Bond (fortunately the Warrant provided for bond) it took about 36 hours in Jail before you were processed & released by Corrections. I entered an appearance as your lawyer & filed a "Notice of Compliance" which outlined the facts proffered herein (i.e. how inattention to detail landed "a good kid" in this situation), the Prosecutor apparently took pity on you and chose to dismiss the DWLS case within 30 minutes of receipt. While it ended well it was also avoidable: Details do matter. Gratefully, MAH/Esq. #HaberPA

Because you chose to identify yourself I can't / won't share anything about the facts & circumstances of your case with the folks who read this but I can still comment on a few things without breaching any Ethical Rule regarding maintaining Confidentiality of Communications & Client Confidence & or your Attorney-Client Privilege. The vast majority of my clients are folks whom I've never met before they contacted my Law Office. Many of those potential clients find me on the internet (be it via AVVO, my website - www.CriminalLaw.Miami - after having seen any of the 401 which are soon to be 419 VideoFAQs on my YouTube channel "MichaelHaberLaw", after reading any of my daily "PSA of the Day" posts, be them on Facebook - "Miami.Criminal.Lawyer" - X / MeWe / TS - "Sharky910" - or via a simple Google search), many are referred to me by people whom we just so happen to know in common, some of whom were prior clients & some not (e.g. other lawyers, family members, friends, Police Officers, Firefighters, bartenders &, believe it or not, most recently by my barber who referred another client of his to me based solely upon discussions that we've had over time about my law practice) & a smaller percentage are like you, people whom I've known in some capacity or another in my personal life (e.g. childhood friends, service providers whom I've hired, acquaintances, friends of friends, my Veterinarian, Primary Care Physician, etcetera).
