Fortunate to hire Michael A. Haber
When one is abroad and does not known anyone, but needs the help of a lawyer, there is always doubt about choosing the right one. I consider myself fortunate for quite accidentally selecting the best one. I was very pleased with his services, and the positive outcome of the court proceedings is truly...
Dear Alex, Thank you very much for your kind words (and for authoring #HaberPA's 184th AVVO Client Review). So that the folks understand you reside in Slovenia and while vacationing on Miami Beach and driving a scooter you received 2 criminal traffic citations and 2 traffic infractions. Although you had paid the 2 traffic infractions you had no time to deal with the criminal component of the case until after you had returned overseas. From Slovenia you and I had a detailed WhatsApp discussion. I prepared, emailed to you and then you returned to me the documents that I needed, including verified pleadings permitting me to appear and resolve your misdemeanor cases in your absence. In short order I was able to get both of your criminal traffic citations dismissed and, as icing (and because I had the foresight to have filed a Motion for Relief) I was able to convince the court to reopen and to dismiss the 2 previously paid and closed traffic infractions, resulting in your being 100% righteous with FL-DMV. Tourists are most welcome here but they should know that coming to FL subjects them to laws and rules, including being properly licensed (if you're in FL for more than 30 days then you need a FL driver license and if you are going to drive a 2 or 3 wheel vehicle with 50+ ccs then you need either a motorcycle endorsement on your license or a motorcycle license). I hope that you'll come back and visit again and that I will get to say hello in person when you do. Thanking you again. Gratefully, MAH/Esq

BUI
Michael was prompt and professional. His approach to my case was just what I needed to get the resuts we wanted, that the State was not giving us. After diligently addressing the case with his expertise, he got my charges lessened and withhold of convictions. His knowledge for the court system, and r...
Dear Roy. Thank you very much for authoring #HaberPA's AVVO Client Review # 183. For the benefit of the folks "BUI" is a DUI, only it occurs on a boat (Boating Under the Influence). Like any criminal case these are tough, they carry a boatload (sorry, couldn't resist the pun) of potential consequences, they're tricky and have many nuances, but a skilled and experienced criminal litigator should know how to (here comes another pun) navigate them. (If you want to know more about BUI then please check out #HaberPA's VideoFAQs #96) BUI: what is it? - https://youtu.be/QyrijyDnPmo # 97) Do I have to be “Captaining” (at the helm) a boat to get a BUI? - https://youtu.be/kaak9la7dKM # 98) BUI: How does it differ from DUI? - https://youtu.be/6e_psjNWojI # 99) How does Law Enforcement give FST’s on a Boat? - https://youtu.be/We4UHKN5g9w and # 100) What are the penalties for BUI in FL? - https://youtu.be/cIeGCbaCrg8 you may also want to watch # 92) Does the 4 Amendment Apply to me on the Water? - https://youtu.be/0XNnmjAmkMY and # 93) What is a Vessel / Boating Safety Check? - https://youtu.be/EBQ_GLGK12Y ). Your BUI ended in a breakdown to reckless boating with no conviction and no probation (i.e. a slightly better deal but the functional equivalent of a breakdown to "wet reckless" from a DUI) but it could have gone to trial. We were ready. We had the court take Judicial Notice of the weather data from the National Oceanic and Atmospheric Administration, we had four listed civilian witnesses (all of whom provided sworn affidavits supporting the theory of the defense) and we had lined up (although we did not retain) an expert to debunk the marine FSTs (which are even more of a pathetic joke than are roadside FSTs); but you chose to accept the broken-down withhold (at which time I convinced the State to agree to drop probation). I say this not to be critical (not even a little, as I completely respect your decision - and it was entirely your decision to make); rather so the folks understand that #HaberPA worked your case up for, and was prepared for, outright war. Regardless, I am elated that you are "very happy with the outcome as well as how Michael handled it along the way", and I am grateful for your taking the time to share your experience with #HaberPA with the folks. As my old friend Quint would say (sing): "Farewell and adieu to you old Spanish Ladies, farewell and adieu you ladies of Spain, For we received orders to sail to old England but we hope in a short time to see you again." Boat safe and be good brother. Fondly, MAH/Esq.

I was arrested on my B-day people! And I walked out of court with a dismissal without any hassle!
Unbelievably Amazing! My Boyfriend and myself were arrested on my Birthday at La poderosa Wynwood... if you can avoid this place please do. I went to la poderosa to celebrate my birthday and when we came out of the club we were arrested and charged with battery (to a cop when it was the other way a...
Dear Ali, Thank you so very much for your kind words (in the form of #HaberPA's 182nd Client Review). When I consult with a potential client I do my best to come up with both a realistic goal (a "litigation objective") and a fair price to accomplish the mission. I get there by initially examining any and all available police reports (affidavits, etc.) - so as to understand law enforcement's probable cause for having made the arrest - and afterward (I always want to know the cops' version of events first) I thoroughly vet the "worst case scenario" with the potential client. I also learn as much as I can about the client, especially any prior criminal history and any potentially relevant unique circumstances (i.e. health, medical, psychological, etc.). When I have a client who's particularities suggest that I may need more than one litigation objective (such as you) then I contemplate secondary and even tertiary goals, just as we did in your case. I took a global view of the case and the client (you), considering and planning for the reasonably foreseeable possibilities. Louis Pasteur (and Travis Dane) said that "chance favors the prepared mind", and that is an operating principal at #HaberPA (along with quoting and honoring fair fees, always being available & responsive, keeping the client fully informed and by doing so earning positive client reviews at the conclusion of the case). We plan, as best we can, for everything, including expecting the unexpected... and we always welcome a dismissal. I'm happy that you're happy and while I'm tickled to know that "[you] will forever be thankful and if [you] ever get in trouble again [you] would have [me] represent [you] again", I also hope that you don't find yourself in that situation. Again, thank you. I very much appreciate your sharing these kind words with the folks. Wishing you all the best! Fondly, MAH/Esq

No BS straight to the point attorney.
Like most people that break the law one way or the other we feel like we should be able to walk clean from our offense. However, its never that simple, thats why we hire an attorney. Where I am getting at, is that Michael Haber won't give you any BS. He will make it very clear and straight to the po...
Dear Marco, Thank you very much for earnestly sharing your thoughts with the folks and for authoring #HaberPA's 181st AVVO Client Review. Unlike many of my responses to client reviews (always in an effort to provide context to the folks) I won't get into the facts and circumstances of your case, except to say that because of both the overwhelming evidence in the case against you and your past (your prior criminal history, which the State and the Court were absolutely entitled to, and surely would have, held against you in this case) we agreed that keeping you out of a jail cell was our most realistic litigation objective, and then we achieved that goal. I say "we" intentionally because I could not have done it on my own. I did plenty - peppering the State with motions, relentlessly forcing them to comply with a never-ending flow of discovery requests, etc. - but all of my efforts surely would have been for naught had you not held up your end by performing, flawlessly, precisely as I instructed, to the "t", and just as you did... for months. So props and kudos must go to you as well. It only takes one bad decision to wind up in the government's cross-hairs, but sometimes "it takes a village" to manage the situation. I'm sorry that you didn't get exonerated in your case but, in the paraphrased famous words of Bones McCoy... "I'm a lawyer not a magician". Because we reached our litigation objective - managing to avoid a jail sentence - I consider your case to have been a success. Thank you again Marco. I wish you all the best in luck and success. Gratefully, MAH/Esq

Feisty and Mighty Duo against the Mammoth
Can’t say it with enough words on how thankful I am with Attorneys Mike Haber and Marc Morris. I was with the wrong people, at the wrong location, during the wrong time. Everything happened so fast; I ended up in the slammer with charges which could have left me behind bars for about 40 years. I ...
Dear Elbin, Thank you for your powerful and descriptive Client Review (#HaberPA's 180th on AVVO). So the folks understand, intending visit to your your sister and brother-in-law for a weekend, and so as to save money on airfare, you had hopped a ride with 2 guys (1 of whom you knew) from ATL to the 305. Unbeknownst to you the guy you knew was carrying $28k in cash to purchase a kilo of cocaine from an undercover (U/C) Hialeah cop, the deal (a "reverse sting op") having been brokered by the other person in the vehicle via a confidential informant (CI). The car drove straight into a meet at a gas station, the driver reportedly flashed the cash to the U/C and the passenger agreed to follow the U/C cop to the prearranged (and wired) buy location while you unwittingly remained along for the ride. The 2 guys went inside with the U/C and his partner while you sat in the car, ignorant of the circumstances. Meantime, in a secured location - and entirely beyond your presence - the coke was displayed, opened, tested and the cash was tendered - all on video & audio - and then the fishnet was thrown, the 2 guys on the inside being (properly) arrested and you being (improperly) arrested while you were waiting inside of the vehicle. There was none - zero, nada, nil, zip - evidence of your involvement / knowledge or intent to participate in this drug transaction, the C/I never mentioned your name to law enforcement, they did not expect you, they had no idea who you were or why you were in the car and you were not present during the actual transaction. Still there was bad news, and it was fourfold: 1) It was Hialeah (absolutely no legal scholars there) and so they arrested you for drug trafficking, 2) You were not effectively represented at the bond hearing, the Judge simply rubber stamped your arrest and you were held on a $500,000.00 bond; 3) Even though your family hired #HaberPA within days of your initial appearance you still had to sit in jail more than a month before we could get you an Adversary Preliminary Hearing (APH); and 4) after an evidentiary hearing, and even though your Judge ruled that the cops had NO PROBABLE CAUSE to have arrested you, the State Attorney refused to drop the case, doubled down on his officers' douche-baggery, forced us to file a written demand for speedy trial and kept your stink bomb of a case alive for several more weeks. (In case anyone wants to research it the defense to your case was "mere presence" - meaning that guilt cannot be established either by someone's mere presence at a crime scene or mere association with another person at a crime scene - the law requires more than that so as to establish knowledge and intent to commit a crime.) The good news was that immediately after the APH you were released from custody, without any conditions and, ultimately (and although the State made us work for it) the charges against you were all dismissed. Sadly no one can give you that month+ back but #HaberPA did what we promised, as we always strive to do, to wit: We attacked your case, aggressively and quickly, and exposed it for the stink bomb that it was. I wish that we could give you back the month+ of your life that you lost to p*ss poor policing... sadly we can't. But we did help you to recover your freedom, to restore your good name (you had no prior criminal history) and live up to our commitment of providing "boutique", effective and relentless representation for a fair price and, as you say, "lean" (with no unnecessary fat). Thank you again for your kind words (and also for the shout out for #HaberPA's YouTube Channel - "MichaelHaberLaw" - which I am very proud of and to which I hope that everyone who reads this will subscribe). Marc and I wish you and yours all the best. Gratefully, MAH/Esq.
