Jason Brian Phillips is an accomplished attorney with a proven record of litigating, settling, and appealing complex legal disputes across a broad range of practice areas, including federal privacy litigation, family law, employment discrimination, real estate contract disputes, foreclosure proceedings, and creditors’ rights matters. Mr. Phillips has developed substantial experience handling complex statutory and constitutional issues involving electronic privacy, digital discovery, and federal regulatory frameworks governing electronically stored communications and taxpayer information.
Mr. Phillips currently represents plaintiffs in federal litigation arising under the Electronic Communications Privacy Act (“ECPA”), 18 U.S.C. §§ 2510 et seq., and the Stored Communications Act (“SCA”), 18 U.S.C. § 2701 et seq., involving allegations concerning unauthorized access to electronically stored communications, cloud-based systems, and confidential federal tax return information obtained through forensic discovery procedures in related state court litigation. In connection with that representation, Mr. Phillips has litigated issues involving electronic discovery protocols, cloud-computing environments, forensic examinations, federal taxpayer-privacy protections under 26 U.S.C. §§ 6103, 7213, and 7216, and the intersection between state court discovery procedures and federally protected privacy rights. His work in this matter has included substantial motion practice concerning electronic communications privacy, statutory authorization, consent, federal preemption, class-action procedure, injunctive relief, and complex jurisdictional and procedural issues arising between state and federal courts.
Mr. Phillips has also developed a strong appellate and high-conflict family law practice, successfully representing clients before Florida’s District Courts of Appeal and trial courts in emotionally charged and procedurally complex custody, relocation, alimony, and parental-rights disputes. Among his notable appellate victories, Mr. Phillips successfully represented parties in several published Florida appellate decisions, including Arquette v. Rutter, involving interstate child support jurisdiction under the Uniform Interstate Family Support Act (UIFSA); Henderson-Bullard v. Lockard, addressing due process and relocation issues in family law proceedings; and Varner v. Varner, reversing a contempt finding and protecting parental rights in a contested timesharing dispute. These cases reflect his extensive experience handling sophisticated procedural, jurisdictional, and constitutional issues before Florida appellate courts.
Mr. Phillips has also achieved significant trial-level results in highly contested custody and dissolution proceedings involving allegations of domestic violence, parental alienation, psychological evaluations, reunification therapy, hidden assets, and complex financial disputes. In a recent multi-day dissolution and custody trial, Mr. Phillips successfully represented a father facing severe allegations of abuse, supervised visitation restrictions, and efforts to permanently terminate meaningful parental involvement with his children. Despite difficult factual allegations and extensive litigation, the court ultimately rejected efforts to award sole parental responsibility to the opposing party and instead ordered shared parental responsibility, reunification therapy, and a graduated transition to equal week-on/week-off timesharing. The court further found evidence that the opposing party contributed to increasing alienation between the children and father and ordered measures specifically designed to restore and preserve the parent-child relationship.
In that same matter, Mr. Phillips successfully defended against substantial financial claims involving alleged hidden investment assets exceeding hundreds of thousands of dollars, with the court ultimately rejecting those allegations after trial and finding the evidence insufficient to support the claims asserted against his client. The court also denied the opposing party’s request for attorney’s fees and established a structured parenting plan designed to restore equal parental involvement despite years of contentious litigation and supervised contact restrictions.
Mr. Phillips has likewise successfully represented spouses in complex long-term marriage dissolutions involving allegations of concealed business income, undisclosed foreign assets, and credibility disputes concerning marital finances. In one such case involving a thirty-year marriage and extensive family business operations, the court found the husband’s testimony regarding his income and business interests not credible, imputed substantially higher income to him based on banking records and financial evidence presented at trial, and awarded the wife $5,000 per month in durational alimony retroactive to the filing date of the action despite the husband’s efforts to minimize and conceal the true extent of his financial resources and business interests. The court further recognized evidence suggesting undisclosed international business interests and substantial unexplained financial activity reflected in bank records and expenditures.
Prior to pursuing a legal career, Mr. Phillips accumulated several years of executive and management experience with Fortune 500 companies, including Southwest Airlines and Sears Holdings (formerly K-Mart Logistics). In these roles, he supervised workgroups ranging from 30 to more than 100 employees while developing expertise in operations management, personnel leadership, and organizational development.
Mr. Phillips also has extensive experience in the nonprofit sector. In 1996, while serving as Program Director for VOICE, Inc. in Corsicana, Texas, he secured more than $450,000 in grant funding to support at-risk youth programs. His leadership helped establish a sustainable community organization that continued serving central Texas communities for nearly two decades.
Mr. Phillips is licensed to practice law in all state courts in Florida and Texas, as well as the United States District Courts for the Middle and Southern Districts of Florida and the Northern District of Texas. He has earned recognition for his appellate advocacy and litigation work throughout Florida state and federal courts.
During his studies at Florida State University College of Law, Mr. Phillips gained practical legal experience as a law clerk for a family law firm. He also served in Florida State University’s Student Judicial Affairs program, where he chaired a Student Judicial Board and volunteered with the Leon County Public Defender’s Office. While pursuing his Master’s Degree in Public Administration at the University of Central Florida, he further dedicated his time to public service through volunteer work with the Legal Aid Society of the Orange County Bar Association.
