I have been a lawyer for over 45 years.  Most of that time was spent in cases touching real esate in some manner.  I handle real esate transactions, real estate litigation and zoning and development.  I am regularlyengaged in jury and non-jury trials, appeals to the Superior Court, Commonwealth Court and the Supreme Court.  In addition, I enjoy teaching numerous continuing legal education courses each year.  My firm is engaged by a significant number of Real Estate Brokerage companies and by tmembers of heir sales staff.  We handle "failure to disclose" cases and a good number of boundary disputes, including adverse possession and paper street issues.

I also handle estates, and business matters. 

In my spare time, I am an Assistant Scout Master and lead high adventure trips for the Boy Scouts. (My sons are all out of scouting, but I am an Eagle Scout and I love the program)

Jim was born to be a lawyer
When I first contacted Jim, I was absolutely stressed out over what to do with a (litigious, opportunistic) tenant that was threatening to sue me for her own financial benefit. As the lawsuit materialized, Jim's experience, insight, and wisdom kept me calm throughout the process (not an easy task...). I do not often take the time to review people or products unless they are absolutely exceptional, but I feel that the guidance I received from Jim was so spot-on that I would be doing him a disservice by not letting others know how good his practice is. His work resulted in the case being settled with no payment on my behalf. Specifically, the negotiation that Jim held with the plaintiff's attorney was exceptionally well thought-out and showed not only years of experience but an incredibly cerebral approach that included an thorough understanding of not only the law but human behavior in general. My particular experience with Jim was in the area of landlord/tenant law, but this is the first place I would start if I ever needed a lawyer again.

I appreciate the comment. This was a mold claim. They are always troublesome because very large financial demands are made, expert witnesses are needed, and there is usually no insurance to cover defense costs or eventual damages.

Proven Performer
My partner and I have worked with Jim for years. We are in a field that is highly litigious; high risk and high reward. One of our best tools for success is a great lawyer. And boy we did find one. When trouble arises we call Jim immediately. From general legal advice to counsel in trial, his expertise is imperative and very evident. He is astounding. Best representation you can find
I hired Jim to prosecute a large real estate case - quieting my title in a $1 million property after a nasty partnership divorce and a hotly contested foreclosure. I have had my share of litigation with other lawyers, and did pretty well, but never left the courtroom after a trial so confident in my victory as I did with Jim on my side. A master of examination and cross-examination, a super-competent real estate law expert who also learns the case inside out during prep, Jim left no chance for the other side to meaningfully respond or recover from the repeated bashings he delivered. Not only did Jim score 10 out of 10 during the trial, but he filed a motion for sanctions in the middle of the trial which is now likely to get me a full or near-full recovery of all my legal fees in the case. Look nowhere else if you need a real estate lawyer who was born to be one. Contract or litigation, I am always coming back here.

Awesome experience
Jim was amazing. I am looking to buy new construction and I worked with Jim to review the contract and he spent a lot of time with me explaining the areas of concern and providing additional language to protect my wife and I against the builder from just taking our deposit at whim. We absolutely love the house, but this builder has a history of just taking people's deposits as a profit center, based on the language of their contract. I would absolutely recommend Jim to anyone looking to buy a new home and wanting to protect themselves against incredibly one sided agreements and legal loopholes that tie people's hands together once they have signed the contract.

I wish there were six stars......
From the moment I met Jim Tupitza, I knew I had found an amazing man of the law. I had questions on a new area of business, which has many gray areas, and Jim was astute beyond belief. I've worked with many lawyers through the years, but the combination of extreme wisdom and true humility I have never found.

Best lawyer
I have been a real estate investor/landlord for 15 years and had worked with a few different lawyers during that time and not so happy with the services that I received, until I was introduced to Jim, through a real estate agent friend, about 4 years ago. In the past 4 years, Jim has helped me with several Real Estate related issues and transactions and every time, the result was better than I expected, due Jim's professionalism, experience, attention to detail and compassion. What I admire most about Jim, is that he not only has the tenure and experience to know what it takes to win, but how much cares about his client's best interest. I am always amazed at how far he goes to protect his client's best interest. I would highly recommend Jim to anyone seeking only the best.

Knowledgeable and Easy to talk to

Great guy and a good man, very helpful, with no obligation at all.
Mr. James S. Tupitza answer a legal question about a landlord/tenant case. He was fast, informative, and overall very kind. He had no obligation to help nor did I pay him. But he still answer my legal questions and I very very very pleased with his service. I would definetly recommend this lawyer. If He helps people on here without paying him, then I am convinced he would be a honest and helpful attourney if were paying. Thanks again James, cant thank you enough.

Poorly prepared and running up fees
This attorney represented a Landlord who refused to return our security deposit. After we won in Magistrate Court, he filed an appeal to Superior court. The Landlord Tenat code is very clear that the deposit needs to be returned within a specified time frame, minus any damages. This was not done but this attorney encourgaged his client to appeal, knowing full well that this would result in more attroney's fees. His attempts to intimidate us in court with threats that we would need to pay his fees were hilarious. His client ended up paying us double the security deposit plus his fees! I am sure his client was very pleased. He wasted everyone's time and could have resolved this quickly by advising his client that he made a mistake.

Embarrasingly ill prepared
Based on the overwhelmingly good reviews on this web site, our family went forward with hiring Mr. Tupitza to represent our son in a small claims court case with his landlord in West Chester. I cannot express enough how ill prepared this attorney was when representing us in court. There were collectively 4 families who hired this attorney to represent their interests in court and it was such an embarrassing mess, that we immediately realized we would have been much better off representing ourselves. After meeting with the attorney once, we were never again in touch with him until the day we went to court. I would never work with this group again and I certainly would never recommend them to anyone needing attention to detail!

It distresses me that after 3 years someone would still be so angry that they would write this comment without first saying it to my face. On the other hand, I appreciate the criticism because it helps me improve the quality of services our firm provides. If everyone said only good things, I would be lulled into a false high opinion of myself. One of four college roommates hired my firm to deal with a routine Landlord Tenant problem. Not much money was involved and the legal budget was low. I met with the client and went over the case. I did not take the time to have the client come up a second or third time from Virginia to prepare because it would have only generated fees and benefited no one. When younger, I tried this same fact pattern a hundred times. I was adequately prepared for trial. The small claims court judge simply decided to ignore the technicalities of the law and find for a local landlord against college students who were accused of damaging an apartment. Obviously I did a bad job of communicating with the client's mother after trial, and she is still obviously not happy with the result. For that I am sorry. We have discussed this situation at a staff meeting and have taken steps to address the issue. Whether the trial is a LLT matter in small claims court, or a multi-million dollar trial in federal court, we prepare to go to trial and win. Unfortunately we do not bat 1000.
