I am a partner with Falcon Rappaport & Berkman LLP, a full service business law firm. As Co-Chair of the Firm's Creditor's Rights and Bankruptcy Law Practice Group, I believe clients benefit from a holistic and integrated approach to legal problem solviing. As a result, my team often finds it useful to collaborate with lawyers from other departments, including taxation, corporate, labor and employment, real property, landlord and tenant, intellectual property, Web3, digital assets,cryptocurrency, cannabis, among others. In every case, clients are represented zealously and with compassion. Simply put, whatever the facts and circumstances may be, my team focuses on resolving complex business and bankruptcy challenges.
These could involve a wide range of issues, including owner, contractor and joint venture disputes, debtor and creditor entanglements, workouts, assignments, receivership, restructuring, and turnarounds. Other services include bankruptcy liquidation and reorganization (including small business chapter 11 cases under subchapter V), proofs of claim, debt priority, subordination, distressed asset purchases and sales, evaluating the adequacy of disclosure statements, plan confirmation, trustee claim defense (including preference and claw back), investment and bankruptcy fraud, and objections to debt discharge and dischargeability. I work effectively inside or outside a courtroom, although I am licensed to practice in the federal and state courts of New York and New Jersey, and the Supreme Court of the United States. And while many of the Firm's attorneys are superb litigators, they also understand when it may be better to employ other means of conflict resolution, like arbitration and mediation.

The result is clients often achieve exceptional outcomes when prosecuting or defending high-risk, high-value litigation. In some cases, a single lawsuit can put a company's very survival in jeopardy. The matter could arise from a non-paying vendor or counterparty, licensing dispute, UCC Article 9 enforcement, commercial foreclosure, private or public asset sale, tax or labor law issue, lease assumption or rejection, note default, as well as a private company's action over control or valuation ("business divorce"), or similar crisis.
