Description: Plaintiff in this case claimed his Kia had defective brakes, which caused him to rear end a car stopped at a traffic light. He sought a refund of money for purchase of the car, personal injury and property damages. Mr. Kaplan employed a variety of pre-trial litigation techniques in order to create serious, potential downsides for plaintiff. Although the jury found a breach of warranty, it awarded only a minimal amount. The Court therefore deemed Mr. Kaplan's client the prevailing party and awarded Kia Motors a net financial recovery.
