Unfortunately, due to OWCP's rules, there are very few doctors (or attorneys for that matter) who know how to write reports for federal workers compensation. And the ones that exist can be expensive. So we try to work with doctors who know what they are doing in this field and are reasonably priced. If our doctor's say they need a test to determine a medical diagnosis, we are not in a position to tell the doctor otherwise, we work with them for their expertise and their success in dealing with the Department of Labor's strict rules. I wish we could have had the opportunity to continue here, while OWCP cases can take a long time, we have had great success in these types of cases. Furthermore, we do what we can to keep costs low compared to other firms who handle federal workers compensation. I'm sorry you did not have a good experience with us.

Sometimes, when an attorney initially receives a call from a possible client, after receiving more information you find out that there is no way that you can help them. It is unfortunate, but at that point, your option as an attorney is to either take the client's money and fight for a case that you don't believe you can win or explain that due to new information, it is not in the interest of the client for them to hire you. I am sorry that this person felt that they had a bad experience in dealing with my firm. I only wish them well and although I am not sure what I could have done differently in this scenario, I will always strive to do my best as an attorney in the future.

The Board found that OWCP improperly refused to reopen appellant's case for reconsideration on the merits of his claim under 5 USC § 8128(a).
The Board found that the client raised an uncontroverted inference between her claimed condition and work factors, and are sufficient to require OWCP to further develop the medical evidence and the case record.
The case will be remanded to OWCP for referral of appellant to an impartial medical examination pursuant to 5 USC § 8123(a). Following this and any necessary further development of the medical evidence.
