Description: I argued that my client was not given proper access to an attorney after being arrested for DWI in the middle of the night. After my client left a message for an attorney seeking advice, the attorney tried to call back to the jail to speak with my client. The police would not let him speak with the attorney, telling the attorney that my client's time was already up. The lower court agreed, so we appealed. The Court of Appeals reversed the lower court and agreed with me that the police should have allowed my client to speak with the attorney that called back to give advice.
