You picked apart the case policies and eventually made it impossible for the prosecutor to prosecute me on the DUI Charges. (A simple checklist to be followed and check marked as completed by the officer and for the officer to watch me for 16-20 mins before BAC testing) Because of these disregards of process---If it went to trial the machine readings would have been thrown out. -----Inconclusive street testing from the officer---(because I have essential tremors ---which is the shakes------ It was tough for him to perform such test) ---It would of stood up in court as inconclusive. Plus along with my refusal to say anything to the officer when arrested---(Which was a help to me) The prosecutor had to drop the Charge. Remember I was looking at a 3rd strike rule----It would of been a loss of License forever---Lots of Money----A serious amount of Jail Time and everything else that goes with DUI ---The Victims Panel---Assessment charges---Treatment Center Charges---Probation Charges—and fines of the court. You never know what rights you have in this type of situation---you’re not supposed too---you don’t plan on getting trouble---let alone driving under the influence.
