Unprofessional

I had a consult with Sam Swanberg. He was extremely hostile and unprofessional. He literally ripped a paper out of my hand. I was extremely shocked and still to this day confused with the way I was treated.

I have no record of meeting with anyone named Kate anywhere remotely around the time frame of August 17, 2016. Further, I would never be hostile to or rip a paper out of someone's hand with whom I was consulting. It simply doesn't make any sense. I believe this is a baseless attempt to smear me for an ulterior purpose.

Unprofessional

Was appointed Mr. Swanberg after the RPD arrested me for breaking into my own home (clearly a mistake on their part). Mr. Swanburg didn't want to hear anything I had to say. He tried many times to get me to plead guilty. I couldn't believe the way he talked to me and treated me.

I have no record of representing a Ben this year on a criminal case, and have no idea who he is, the actual facts or charges, or the final outcome. I can therefore only say it is not always easy representing someone charged with a crime. It is my job as an experienced criminal trial attorney to apply the applicable law to the facts beyond dispute and give my professional opinion on whether there is a defense that has a realistic chance of success. I always listen to my client's story. However, I am professionally obligated to let them know whether their story constitutes a legal defense. As a hypothetical example, if a client tells me they were only breaking into their family home to see their estranged spouse, whom they are prohibited from contacting because of a domestic violence no-conact order, I would have to tell them that the fact it is their home is not a lawful defense to the charge of violating the no-contact order. Further, if the no contact order prohibited them from going to the residence of the protected person, then it would also not be a legal defense to the charge of burglary ("entering or remaining unlawfully in building with the intent to commit a crime against a person or property therein.") In such a case it may well be my professional advice that they would be better served by negotiating a reduced charge and/or sentence rather than going to trial. But some people don't like hearing the the truth when it comes to the problematic legalities of their case and view me as not listening to them or trying to get them to plead guilty when I do. To try and avoid this, I always express to my clients that regardless of my advice they have a constitutional right to go to trial and that I will give my best for them if they so choose.

Appreciation for timely, effective help.

Being outside the Judicial and law inforcement loop, legal challenges, law enforcement questions and court ordered mandates are usually intimidating and can be fearful. The question is how to face the issue without an understanding of the challenge of our legal system or knowledge of the process to ...resolve the issue. On two such occasions, I contacted Sam Swanberg hoping for direction and his council was right on the mark. In one of these, I felt that I had been inappropiately ticketed for sliding off a snow covered road without damage to anyone else. We were able to get the sistuation resolved without help, but I was cited after the fact when an officer showed up not even knowing the exact location of the incident. Sam prepared an explaination and challenge to the citation and it was immediately dropped. Through these situations and other dealings with Sam, I have found him to alway be unbiased, knowledgeable, and focused on resolution. In this world of excessifve proceedures and policies, which often mask the obious and can distort the simple and true, it has been so refeshing to find someone that can focus on resolution with integrity and justice. Thank you Sam Swanberg!
