Unprofessional
Was appointed Mr. Swanberg after the RPD arrested me for breaking into my own home (clearly a mistake on their part). Mr. Swanburg didn't want to hear anything I had to say. He tried many times to get me to plead guilty. I couldn't believe the way he talked to me and treated me.
I have no record of representing a Ben this year on a criminal case, and have no idea who he is, the actual facts or charges, or the final outcome. I can therefore only say it is not always easy representing someone charged with a crime. It is my job as an experienced criminal trial attorney to apply the applicable law to the facts beyond dispute and give my professional opinion on whether there is a defense that has a realistic chance of success. I always listen to my client's story. However, I am professionally obligated to let them know whether their story constitutes a legal defense. As a hypothetical example, if a client tells me they were only breaking into their family home to see their estranged spouse, whom they are prohibited from contacting because of a domestic violence no-conact order, I would have to tell them that the fact it is their home is not a lawful defense to the charge of violating the no-contact order. Further, if the no contact order prohibited them from going to the residence of the protected person, then it would also not be a legal defense to the charge of burglary ("entering or remaining unlawfully in building with the intent to commit a crime against a person or property therein.") In such a case it may well be my professional advice that they would be better served by negotiating a reduced charge and/or sentence rather than going to trial. But some people don't like hearing the the truth when it comes to the problematic legalities of their case and view me as not listening to them or trying to get them to plead guilty when I do. To try and avoid this, I always express to my clients that regardless of my advice they have a constitutional right to go to trial and that I will give my best for them if they so choose.
