Dear Sir, I appreciate the comments made here. I always strive to make my clients happy and satisfied. I sincerely apologize that you ended up feeling unhappy and dissatisfied. Your K-1 visa petition went smoothly up until the interview, when consular officer placed your fiancee's case into administrative processing. Unfortunately there wasn't anything we could do to prevent the consular officer's decision regarding the Communist Party affiliation. Administrative processing is rare, but it has happened before. We cannot control the government in its decisions. Well before the interview when we became aware of the Communist Party affiliation I did explain to you that administrative processing could occur. I am sorry that it happened and I completely understand your frustration at the outcome. I also acknowledge that I had a system failure regarding your fiancee not coming prepared to her interview with your financial packet. This was an honest mistake, but fortunately this isn't something a consular officer would issue a substantive denial because of -- at worst it will create a short delay (a couple weeks probably -- nothing near the delay caused by administrative processing). In our situation we were able to catch the omission and mail the packet to the Embassy while the case remains in administrative processing. Although it was an oversight and a system failure of mine to remind her immediately before the interview to bring the financial packet, I did provide both you and your fiancee the Embassy instructions (in English and her native language) to prepare for the interview about a month before it occurred. The instructions included a detailed checklist of the items needed, including your tax return and W-2 (the I-134 is optional but is always a good idea to have). After preparing these items and placing them in my file ready to ship out, I believe the reason I forgot to remind her again to bring all items on the checklist to the interview was because of the Communist Party issue that had arisen -- my focus was on that. I again sincerely apologize that you came away feeling unhappy and dissatisfied. I believe your case will eventually succeed after the administrative processing is finalized.
