Unfortunately, Steve was two years behind on his mortgage payments when he came to see me about using bankruptcy to save his home from foreclosure. Although I was able to get a Chapter 13 Plan successfully confirmed for him, immediately following confirmation, he stopped making Plan payments and mortgage payments. About eleven months later his lender obtained relief from the bankruptcy stay and his case was dismissed. I understood that his goal was to keep his home, however, there is only so much I can do if he wasn't willing or able to make the payments. For the cost of my fees (equivalent to about one mortgage payment), he essentially got to live in the home rent free for an additional year because of the bankruptcy. I believe this was a service to him, even if he happens to disagree.

I filed Chapter 13 and my credit union told me I had reaffirmed the account which I continued to pay on when in fact was not.
