Debtor v. Creditor for Violations of Automatic Stay
Jun 11, 2009OUTCOME: Settlement of $4,700 obtained from Creditor.
Creditor levied Debtor's bank account post-petition claiming that the funds could be traced to the separate property of a non-filing spouse. We filed the appropriate motion for Sanctions and Conte ... mpt against the Creditor and were able to obtain a refund of the funds wrongfully taken from the Debtor's account as well as a settlement for damages in the amount of $4,700. The Settlement was enough to pay for all of the Debtor's costs for filing bankruptcy in the first place!
