I was born and raised in southern California. I graduated from Brigham Young University (B.A., History, 2000) and Western State University College of Law (J.D., 2004, Scholarly Merit). All through law school, I worked as a law clerk for my father, Barry J. Wishart, who had practiced family law since 1982. As such, I have been in the business for more than 13 years and have been trained by one of the elite attorneys in the county.
I have been married for more than fifteen years. I also have eight children. I am a member of the Orange County Bar Association, the Family Law Section, and the J. Reuben Clark Law Society. In 2006, I was elected and appointed to the Executive Committee of the Orange County Bar Association's Family Law Section, where I served until 2009. In 2013, I was appointed as a member of the State Bar Family Law Section Executive Committee (FLEXCOMM), Orange County Standing Committee.
I have authored several articles on the subject of family law which have been published at , an online magazine or e-zine. I volunteer time and am featured as an "Expert" of the "Divorce Support Center" (), a non profit organization that helps individuals and families in crisis.
My practice is exclusively dedicated to Family Law. I currently accept cases in Orange, Riverside, San Bernardino, and Los Angeles counties.

Horrible experience
If you were thinking of hiring Brett Wishart as your divorce attorney, I have one word of advice for you – RUN! My daughter hired him in part because he indicated that he would quickly ask for spousal support because of the disparity in income between her and her husband. Several months later, he had...
As admitted by the author of this review, I did not represent her. I have not met or spoken with her. The allegations made are not based on any firsthand knowledge or experience. In Court, such claims are routinely excluded from evidence as “hearsay” or "lacking in foundation" and are considered inherently unreliable. Nevertheless, I deeply regret that the author of this review is so upset. Under the best of circumstances, the process of a contested divorce is often slow and expensive. Some feel their attorney is to blame and it is common for counsel to be changed more than once before final conclusion of a case. Less often, it is the attorney, not the client, who seeks to end the representation. I can count on one hand the number of times I have had to petition the Court to withdraw from a case in my 20 years in the business. This was one of those cases where I had to file a formal motion requesting to be relieved as counsel due to a complete and irremediable breakdown in the attorney-client relationship. Attempts were made to resolve the breakdown, but in the end it could not be fixed. Had any of the things she claims about me been true, I would have been fired, not the other way around.

Great Experience and Outcome
Look no further, this is your guy! I started my divorce process with a different lawyer. A month in, my wife hit me with domestic violence claims where I lost all access to my children for three months, it was horrific and terrifying. My lawyer at the time gave me no confidence she could beat the ...

Truly a wonder and joy to work with
In my case, my ex is extremely contentious... her side would have attorney drafted letters written on every little thing. Brett is no only patient, creative, but deals with opposing counsel with extreme professionalism. He knows when to "attack" and when to consolidate and cut your losses. I...
"I endorse Brett. I have been the opposing counsel on cases with Brett Wishart and his firm and I have found he and his firm to be very prepared, professional and knowledgeable. Moreover, he is very reputable and not underhanded in ways that end up causing his clients (or mine) to spend unnecessary legal fees. He has the ability to both advocate for his client's interests and still work reasonably with opposing counsel. Brett is a definite asset to our profession."
"Mr. Wishart is a very competent, ethical, and hard-working lawyer. His experience and good character have earned him an exceptional reputation in the legal community. I highly recommend this lawyer!"
"I endorse this lawyer. Brett Wishart is a solid attorney. He represents his clients without unnecessary drama. My experience with him as been superb."
"Brett is an excellent lawyer and I have had the pleasure of having cases with him over the past several years. A couple of our cases have been complex custody matters, and Brett worked to diligently represent his client's interests, but also kept settlement in mind, which saved both of our clients money. I endorse his work."
"Brett is equally capable in the courtroom and the conference room. He brings skill, experience and wisdom to the cases he handles. He is a consummate professional, and uniquely skilled at resolving high-conflict family law matters."
"I whole heartedly endorse this lawyer. Brett is one of the finest young lawyers practicing family law today. Brett is a forceful advocate, and can also settle a case when appropriate and advantageous for his client. Brett has trained under a premier family law attorney, his father, Barry. Together they make a formidable team."
"I endorse Brett because he is a very good attorney and is very respected by the Orange County Famiy Law Bar."
"I had the pleasure of attending law school with Mr. Wishart. During law school, Mr. Wishart had an excellent reputation and an always friendly demeanor, both of which are highly suited to his family law practice. I'm not the least bit surprised to read many glowing peer and client reviews in Mr. Wishart's Avvo profile. I, too, offer my glowing endorsement of Mr. Wishart."
"Brett is a highly talented and compassionate attorney. If for any reason Irwin Family Law cannot represent you, then without reservation I highly recommend Brett for your family law needs."
"I endorse this lawyer. I have referred numerous clients to Brett Wishart for legal advice. He is thorough, professional, and provides excellent service."
"I have referred countless friends, neighbors, and clients to Brett and have heard nothing but praise regarding his professionalism, expertise, and skill. Simply put, Brett is the guy for any "family law" issue you or a loved one may face."

Court denied Father's 50/50 and denied child support reduction
Sole Legal and Sole Physical custody of minor children to Mother, with professionally monitored visits to Father
Restraining order against my client dismissed, child returned to my client's primary care.
Wife's spousal support reduced to zero
Father awarded sole legal and sole physical custody of children. Monitored visits only to mother.
Other party's request denied. Custody and visitation rights fully restored. Their request for attorney fees denied.
The opposing party's visitation was reduced and his child support obligation to my client increased by $1,000.00 per month. Judge also ordered him to pay nearly all my client's attorney fees.
Other party's requests for spousal support and division of home and business were denied. Court found Husband not to be a credible witness. My client kept her home and her business. Husband was ordered to pay for all of his own attorney fees.
