I had an issue with the Trolley "police" where I was subject of a severe issue and falsely accused. Gerald had the Trolley "Police" completely shocked. He is a good guy. It ended where they The "Police" didn't show up.

Retaining Gerald Smith was most likely the best decision I ever made. Not only did he go above and beyond his job requirements, He would show concern and for my well being in a health issue by becoming my advocate to gain speedy medical service. My peticular case was sensitive and was punishable by more then 30 years. He would assure me at times when I was feeling the pressures of trial and always left me feeling better and in capable hands.I fully endorse Mr. Smith . And would go as far as to say he was the best choice . I will forever be in his debt as he returned me to my life and was able to get me treated faster then the courts were allowing. Atty. Gerald Smith did an outstanding job as my attorney against the "Agency". CPS had taken all of my children under false accusations. During the hearings he asked questions and brought out the truth. In the end the judge; who listened and didn't back down; ruled in my favor and I got all my children back.

I spoke to two different attorneys before speaking to Mr. Smith, and I immediately noticed a big difference in levels of experience amongst them. From presentation to knowledge, to the way they explained the process and the way they took notes. Gerald's hard work and dedication as well as all of the members of his firm's support were key in us obtaining a positive outcome in our case. We did not accept any plea bargains and we were very well prepared for trial. Although we were nervous we were confident in our defense. We'd like to thank Mr. Smith for helping us prove our innocence and clear our name. When I was wrongfully accused I interviewed more than thirty lawyers. I learned the felony trial process and that the case would be treated differently in San Diego vs. other counties in CA. Jerry and I discussed this at length. I also collected as much evidence as I could myself. Why? Because the deputy public defender didn't have the resources to get the job done. As a white-collar professional financially devastated by the economy, facing a serious criminal case was an unbelievable amount of stress at the worst possible time. Jerry Smith appreciated my interest in my case (I was innocent after all and he was protecting MY FREEDOM).
Think about that for a second. You aren't the only person who depends on your freedom. You have friends, family and others who depend on you. If you lose your case-in some ways they do too. It's nothing personal to the "system" - as far as they are concerned they have a job to do. The prosecutor actually laughed in Jerry's face after the jury was chosen he said he didn't care whether or not he won my case. No one had gotten hurt (and yet I was facing 16 years in state prison). If he didn't care if he won, why did it got to trial in the first place?
I'll tell you why. Because he has a job to do. It isn't about truth, justice and the American way. No, it's about keeping "the system" going. The "system" is the courts and the DA's and the cops. They have a better retirement than you or I will ever have. They repeatedly expected me to plea to a felony. And the last time i said no they added a strike. Prosecutorial misconduct is rampant in San Diego. Thats EXACTLY how they get a 98% conviction rate. Look it up. They overcharge the case in the first place AND then offer to settle it later(as long as you plead to a felony, they have quotas too).
Felonies don't look good on job applications. Clearly, I wasn't going to be able to get the DA to make a settlement offer that made sense UNTIL I DEMONSTRATED I was ready to go to trial. It becomes a sick game of chicken. When a case is going to trial- you need an experienced litigator WHO is as motivated to win as you are. That's Jerry Smith. Jerry came to my house, met my wife and children in preparation of my defense. I knew if we were to get through this he would be the one person enabling me to keep our family together.
By the time we got to trial, Jerry was so prepared I was sure he would destroy my accusers credibility. And he didn't disappoi
I had been through hell and back. On the witness stand, I told the prosecutor that despite their efforts to destroy me, that I was still fighting.
"You want to finish me off? Go ahead and take your best shot."
This wasn't a movie. This wasn't scripted. This was what I told the prosecutor trying to destroy my life just a day after laughing, telling my attorney he didn't care if he win the case or not.
In his mind that was acceptable. In my mind it went beyond acceptable. Now I don't recommend doing what I did but later I was told several juror were just as incensed at the prosecutors condescending and flip attitude as i was. I was innocent and mildly outraged and it showed.
The prosecutor is getting paid a healthy six figure salary to destroy your life. Don't worry, it's not personal. It's just how it is.
I never ONCE got that it was just about business with Jerry. I won my felony case thanks to his dogged determination and excellent trial skills. I wound up with a misdemeanor conviction and hired another attorney to appeal for me. Boy do I wish I'd had Jerry handle that too. That other attorney DROPPED the ball and never even filed the appeal (he's a former DA, go figure).
Sometimes you don't know what you have until you don't have it anymore. Jerry Smith is a true professional who I will recommend to my dearest and closest friends and family AND to anyone else who values their freedom.

Gerald Smith and all staff members consistently displayed professionalism, personalization, concern, sympathy, sensitivity - and at times tasteful humor and made my Partner case much easier to get through. A case is a very difficult time in one's life (no matter how much it is wanted and/or needed) and Gerald Smith made it as easy as possible. Gerald Smith made my partner feel comfortable and at ease. He was extremely patient and compassionate, also very professional. He kept me well informed and I completely trusted him to take care of my partner and handle the case, especially when there were difficult moments he was very helpful. I had a business that because of the economy had to be shut down. I had creditors harassing me all day long and had to file for bankruptcy. I was put at ease be Gerald and would recommend his services to anyone. Very professional and takes your feelings into consideration. Overall this would be my choice if I ever need another lawyer to represent me.
