HOA False Allegations. Animals Involved

It was very difficult for me to post this due to Avvo vetting. Mr. Harper, a talented attorney, seemed like he wasn't going to do anything after I put money down and signed the contract. I am a paralegal with over 15 years of experience. I produced 180 professional level exhibits and did legal resea...rch after my neighbor did not want animals next door. I had everything approved and have an excellent reputation for cleanliness over a period of many years. I had to call and confront Mr. Harper because an Answer was not filed. He blamed a computer glitch. I have no choice but to accept that. I was very busy working on a Master's and working. Suddenly I realized a couple weeks before the hearing I had not heard anything. I confronted his office. His paralegal tried to back out of the case at the last minute. He then filed a competent pleading, however, it was deemed much too late and the Court rejected it. He showed up at the hearing and presented one exhibit (more than likely he would have been in trouble if he didn't show.) I am not even sure if that one exhibit was admitted properly. He has no empathy whatsover for the fact that my hands are tied. If I have an attorney, the attorney has to do the presentation, unless I want to cause a big scene before the Court. These HOA cases have become very rough and difficult due to legislation. He could not stomach the challenge. I think he is typical of the Bar here in Arizona. Now that I confronted him and took action I may not have the basis for a Bar complaint, but for malpractice, which will require more down on a malpractice attorney, another suit, etc.

I recognize that in every case at least one party is disappointed in the outcome and may wish to blame his or her attorney, but in this case the complaints have absolutely no connection with reality. This case involved an HOA suing this client, and the outcome at trial was actually favorable to this client. First, it should be noted that I was hired to replace a previous lawyer, and based on some of the complaints I can only assume some lapse in memory as to who did what. For example, there was never any call about an Answer not being filed, and there was never any blaming anything on a computer glitch. To the best of my recollection, my office has never suffered a computer glitch, and in this case we actually filed an Answer within two weeks of being retained, and just days after the prior lawyer withdrew from the case. It is also not true that my paralegal tried to back out of the case at the last minute. I can't even begin to imagine what this refers to because there was no paralegal working on this case, which I handled personally, and there was never any effort to back out of the case at any time. As for the outcome of the trial, it is also not true that I "showed up at the hearing and presented one exhibit." The truth is that I traveled to Tucson and met with this client the night before the hearing for a couple of hours, at which time we reviewed our numerous exhibits, and at which time she could see and commented on how well prepared we were. Notably, because I empathized for her financial situation, this client was not billed for almost 10 hours of travel time and hotel bills. The next day at trial in southern Arizona ten exhibits were marked into evidence (the Court's Minute Entry confirms proper admission of the exhibits) and this client actually prevailed on the primary issue in the Complaint that had been filed against her. She was upset that the judge also found in part that she had violated the the HOA's rules. This client is actually a very nice person and I wish her the very best.

Great lawyer

I hired Kevin Harper for a wrongful termination case against my employer who wrongfully terminated me because I envoked my Miners Rights for safety reasons... Kevin worked with me and my financial situation and understood my financial concerns. He took on this case for me against this Copper ...Company and we won the case, he got me my job back and back pay..
