It is essential to convey that spousal maintenance determinations are independent of whether children are involved. Your review was indeed unexpected because Teresa Drexler maintains an impeccable reputation and was most recently honored by the SuperLawyers organization, which recognizes and publishes only the top attorneys in their field. Candidly, your review is the first review where we have encountered a client feeling that Attorney Drexler did not “push back” or advocate aggressively when called for. Admittedly, Teresa is the first to tell us that, if “pushing back” would be counter to a client’s overall interests, she would advise just that and then work with our clients to accomplish the client’s goal in another manner. Certainly, there are realities in a divorce case where the law (not the attorney’s discretion or strategy) requires the Court issue orders regarding spousal maintenance, especially where a disparity in income exists between the parties. Colorado law actually requires judges to articulate and consider spousal maintenance guidelines (i.e., suggested amounts and durations of spousal maintenance). Without more information on your particular case, however – and we have reviewed our case outcomes dating back some time and didn’t see a case where this fact pattern matches up – it is difficult to comment further or determine what an appropriate solution or next step might be.
