Although I am a trained litigator, I prefer for parties to work through differences in mediation as it normally benefits everyone (especially the children) to settle differences in that way.

Replied last February 28, 2017My understanding is that the judge removed the excel spreadsheet which was an exhibit to the separation agreement and PROPOSED ORDER, thereby changing some page numbering by the time it became a FINAL ORDER. A certified copy of the actual FINAL ORDER proves that the order is exactly what it is. Since I was a mediator (without access to the actual court file) and the mediated agreement records I have in the form of a PROPOSED ORDER were apparently changed after the mediation (by removal of the exhibit and/or other changes), it is impossible and highly inappropriate for me to "certify" an ORDER is what it is after the changes that were made to what I did, because I have never seen the FINAL ORDER and have never had possession of that sealed document (as I am not a party to the case). The lender has apparently requested proof that the order is what it is and a certified copy of the order itself is the correct way to prove that. A letter discussing pagination of a proposed order would be of no use at all. I wasn't the judge and I didn't create the order in its final form. A mediator's word version of a proposed order is patently insufficient to certify that my copy of a proposed order in word format is the actual order (because we know that my version is NOT the actual order). I remain very encouraged that this valued client will understand that my proposed order in word version is not sufficient for me to verify an altered document that was based on that draft. Doing so would potentially get us both in trouble. I remain hopeful that he will obtain a certified copy of the order itself which should fix the problem with the lender by proving that the order is exactly as it is, including misplaced pagination references. I also hope that this response assists with the situation with the lender and/or court clerk and creates a full understanding of what exactly is necessary (a certified copy of the actual order) to accomplish this client's goals. When the clerk staples the certified copy of the FINAL ORDER as it was ordered by the judge, please don't remove the staple.
