My Case: 2nd DUI – After a long year and a half, working though the process in Montgomery County criminal courts, Tyler Flood won my case. It was wonderful to hear the Judge read the verdict “Not Guilty”and to know the Jury reached that conclusion unanimously! I want to point out that Tyler negotiated a very good offer from the DA and it was tempting, but I wanted to clear my name. Most Lawyers would have probably told me I was an idiot for not taking it, but not Tyler. When I told him I wanted to fight it he did not argue with me, he said “OK”. We both went down the hard road and I am glad we did. I was not sure what to expect in an actual trial and was nervous as can be, but once it got under way I have to say it was reassuring to see Tyler and Andrea in action. It was amazing to see how they were taking down so many notes as testimony was given and how they worked together so seamlessly. When Tyler went to work on the Police Officer’s testimony at one point I almost jumped up and yelled Yeah! Go Tyler! Of course I kept my cool. As the trial winded down I was not so confident that we would win. Then I heard Tyler’s closing argument and it was so well thought out and encompassed all the critical details. His argument resonated with confidence in our position. As he laid it out, I could see the look in the jurors faces and I thought yes! they are getting it! Tyler Flood is a master of his craft. He has a great legal team, and they all are working behind the scenes for you. All the other attorneys I consulted in Houston (about five) told me that I should take a plea and just do probation. But I'm in a profession where this specific charge is highly frowne...d upon, so having this stain on my record wasn't really an option. My case involved a car accident and a blood draw with a BAC over .15 after refusing to submit to both breath and blood. Thankfully, no other vehicle was involved, and no one was hurt. Tyler Flood, being the confident and excellent litigator that he is, took my case to trial after us being denied Pre-...Trial Diversion, and had my case dismissed after being in trial for maybe 3 hours total over 2 days. Tyler Motioned to Suppress on grounds of an unreasonably lengthy detention period where no DWI investigation occurred or was even in the works. Tyler had a convincing argument for the judge who eventually granted the motion. Thus, all evidence (video, blood draw, SFSTs, etc) collected at or after the incident could not be used against me. The State decided to dismiss the case 5 minutes after the Motion to Suppress was granted since it became self-evident that they could not meet the burden of proof. I am forever grateful to Tyler Flood. He saves the lives of good and innocent people by protecting our rights in a system that gets harsher and more unfair everyday. One thing I will add is that Tyler's trial law skills are unlike anybody I have ever seen, heard or even read about.
