the truth

If there be any doubt in your mind about selecting Mark Bennett to defend you against a legal assault mounted by the federal, state or local judicial systems against your life, liberty or happiness---cast them aside. If you are reading this, you are very likely under such assault. Just know there is ...only one goal to this assault, and that is to prosecute you to the fullest extent of the law, regardless of guilt or innocence or extenuating circumstance. It is their job. And they like it. And the only thing standing between you and a conviction is your defense attorney, upon whom your fate will utterly depend, so you had better make the right choice. I can personally attest that they don’t come any better than Mark Bennett. Period. He is the best of the best. A lawyer’s lawyer, with compassion, integrity, and a deeply intuitive situational intelligence that enables him to create highly effective strategies and tactics to win your case; he can think within the box, outside the box, and even upend the box if necessary---whatever the situation requires. Not only does he keep up with the very latest developments in federal, state, and local legal standards, practices and laws, his cutting edge commentaries and articles on a wide variety of evolving legal issues help to shape and inform the attitudes and opinions of innumerable practicing lawyers and judges, both locally and nationally. On at least one occasion while in court, he actually had to educate the judge and prosecutor of a change in the law, which as a matter of course led to yet another dismissal. This is a defense attorney that you want at your side. My case involved a false accusation and a wrongful arrest, personally exponentiated by a sensationalized flurry of local and internet journalism which threatened to destroy not only my reputation and livelihood, but my career as well. I had no experience in legal matters whatsoever. I had a month before my initial court date, and so I spent that time doing in-depth research on legal defense options. When I came across Mark Bennett’s website, it was the tenor and tone that struck me first. Second were the stellar reviews from his previous clients. I continued doing research, but after a few days, I kept coming back to Mark. I knew he was the one. I contacted him, and he accepted my case. For which I am and shall remain immensely grateful. Mark wasted no time. After filling out the big picture, he then identified the specific areas that needed clarification and investigation. He spared no expense or effort, using his investigative staff, even to the point of subpoenaing phone records. One of the great things about Mark is that he includes you in the loop. He informs you of what he is doing and what he finds, and answers any and all questions you may have about even the most incidental of details, whether factual or speculative. But most of all, he is tolerant and patient with your questions, regardless of how dumb or irrelevant. In a word---he is kind. And eminently personable. A rigorous, no-nonsense professional who exercises kindness. It’s a lovely thing to find. Especially when your life is hanging in the balance. The court dates went on for months, and at each instance, he gathered more and more information and moved the ball further downfield. And then finally, when he uncovered exactly where the critical point to the entire affair lay, he pressed the DA into action. And the result of the DA’s action? Dismissal. Utter and unequivocal. Just like that. It was unbelievable---I was a free man once again. After the dismissal, we filed and were granted an expunction order (the complete clearing and destruction of all records pertaining to the case). Tabula rasa. It was the complete legal restoration of my civic status. But the situation wasn’t quite over yet. Suffice to say that Mark’s representation was indeed---stellar. Frank

Skilled, Humanistic Professional

I recently turned to Mr. Bennett for help with a First Amendment appeal being litigated in federal court. He was enormously helpful not only in bringing clarity to the content of the argument, but in putting together a serious legal document for the judges. I highly recommend his services without h...esitation.

It was a pleasure helping you, Raphael. Appeals of criminal free-speech cases are one of my favorite practice areas.

Thank You Mark and God bless you

Mark is an exceptional attorney. If you have judicial problem, talk to Mark. You will be in safe hands. He will patiently listen to you and make you feel that he is always there for you to help. He is the best in class and has a big heart. Recently I was charged with 2 cases in the Houston court. Th...e crimes were performed in Harris County in Houston .It was shocking as I had never been to Harris County or Houston in my life. I had warrants against me so I could have been arrested. To add a challenge I had to go to out of the country in 2 weeks.I did not know what to do. I wanted someone who can listen my version and then provide me consultation for the next steps. I talked to 7-8 attorneys based on their reviews from Avvo.com. Their individual sites boasted about free consultation for 30 min -1 hr. But when I called them few of them demanded that they needed to be engaged and paid before they could provide any consultation. Others gave suggestion which looked very similar, “Pay me, get a bail by posting bond and then appear in Houston court on court date”. That meant expense and time. When I talked to Mark, he had very unique suggestion. He said he will try to have cases dismissed without me even going to Houston. It looked unbelievable but I agreed. He shared the cases details with me. According to the case the 2 crimes were done by a physiotherapist at physiotherapy clinic at Huston. In contrast, I am an IT manager and never trained on physiotherapy. He was very quick to understand that it was the case of mistaken identity. He did a research to find that there is another guy with my name in Houston who had degree in physiotherapist and worked in the same clinic when crime was done. He even tasked his investigators to visit to physiotherapy clinic and collected all the required details (Passport, DL, Certificates etc) about that guy. He then contacted Chief, all the ADAs and investigators to inform that case was filed against the wrong guy and shared the details on the right guy. Mark is highly respected attorney in the state of Texas and everyone including judges respects him. And I witnessed that. In few days, 2 cases against me were dismissed without me appearing in the court or even going to Houston. It would not have been possible if I did not have Mark representing me. In turn, Mark just asked me to pay him for 1 hr of his time. In reality Mark had spent much more time on this case. This fee was nothing in compared to what other attorneys demanded. For Mark it could be one of his easiest cases but in reality he saved the life of an innocent. The case which looked complicated in the beginning, Mark made it look so simple. Believe me, Mark is one of the attorneys whom you can trust. I am writing this review to thank him. This is the least I could do. Thank You Mark and God bless you! Me and my family will be always grateful to you.

Thanks. I don't think it ever even occurred to the State that two people might have the same unusual (in Houston) name.

expunction order

Mr Bennett WOW ! It's hard to believe it's finally over! I'm so very happy, you've no idea! Thank you for handling my final expunction order. My case was tried and acquitted over 35 years ago, but I have “carried” the burden of the case with me ever since. I feel like that chapter of my ...life is finally behind me and I no longer have to hide or walk around with a copy of my disposition paper in my purse. Neither do I have to dread when a potential employer asks “is there anything else that I should know before we start processing your application.” Thank you for giving me life back, I wish I had known you 35 years ago, I wish the lawyer who originally handled my case would have suggested I get an expunction order. I hope that I have expressed and conveyed how grateful I truly am. Thank you Mr. Bennett

Mark Bennett put my life back on track

If you are looking for a brilliant, determined, and respectful defense attorney who will fight for you hire Mark Bennett.  I was charged with a Misdemeanor Class B for Disorderly Conduct with a firearm.  My first meeting at Mark's office gave me hope (and Mark even bought me lunch!).  His professiona...lism and demeanor have a way of making you feel that you have the right defense attorney.  He is smart, and doesn’t think like a former prosecuting attorney. In court, you see those run-of-the-mill attorneys who merely plea everything out and never go to trial. Mark is the opposite. He told me “I’ll take this case to trial by jury”. Mark, by the way, is excellent at reading people. He has a YouTube video discussing voir dire which I would encourage you to watch (Search YouTube for: Houston Criminal Defense Lawyer Mark Bennett Teaches Jury Selection). Mark helped me understand the entire process, and how we would get through this. His calm and confident manner helped me to be patient with the process.  When he comes in and talks to the prosecuting team and approaches the judge, I noticed how they all respected him and he commands their attention in a positive way.  After our trial date was reset month after month, I kept my focus on the goal set by Mark - to get the case dismissed or win the trial.  I believed if I did everything he said and maintained a clean record, we could win. After a full year, we finally had the trial date set for October 6 and Mark worked diligently to get me prepared for the witness stand. He taught me how to approach cross examination without falling into the DA’s traps. I had the best surprise on my trial day when Mark walked up to me and said that the case was going to be dismissed!  I walked out of that court house a new person, confident, and ready to get my life back on track. Within two days, I was back in a job interview with a global company with a strong Houston presence.  I know I will remember Mark the rest of my life, as the person who treated me with respect and dignity at a time when I needed that the most.  Thank you, Mark Bennett!

On top of all of that, he is simply a treasure for civil society and the defense bar. His contributions are more important than most people in the public will ever know."

"Integrity, Heart, Love, and Skill Review for Mark Bennett | Submitted on 4/29/18 (Review Pending) Mark and I were friends and he had helped me out prior to the case that is the subject of this review. In 2006 my girlfriend died of an overdose. In 2010, I was charged and indicted for Delivery of a CS F4. Mark Bennett selected a jury in Harris County on my behalf in front of a very hostile and myopic Judge named Denise Collins. Additionally the DAs Office assigned a “special prosecutor”-Commie Spence, and the trial was covered by all of the media with the point being that the only people who were somewhat on our side were the bailiffs who completely supported us after hearing the evidence. So Mark did an outstanding job in a hi profile, prejudicial, and hostile venue where it was clear that the Judge was just another prosecutor, but who was on the Bench, making it that much more difficult. Despite all these facts he got a not guilty on my behalf."
