I appreciate this comment for the lesson it illustrates. Sometimes—as here—clients who got what they wanted at the time get buyer's remorse later and regret the choices that they made. When they do, they often—as here—blame the lawyer. At the time he chose to plead guilty, this client was happy with the result in his case. I had been paid, as I always am, to investigate the law and the facts and try the case if necessary, but the client chose to reduce his risk of a felony conviction by pleading guilty and taking probation rather than going to trial. Considering the facts of the case (which I won't go into) that seemed a good choice at the time. A shorter misdemeanor probation might have been a viable option, but it would likely have involved a conviction, and would have remained on his public record forever. Taking felony deferred avoided a conviction and should have allowed him to seal his case from public view five years after successfully completing the probation and staying out of trouble. Had he stayed out of trouble, the judge would likely have terminated his felony deferred adjudication early as well; a two-year felony deferred adjudication could have been over in a year or eight months. It's not uncommon for an accused presented with the option of a shorter misdemeanor probation (with a conviction) and a longer felony deferred adjudication (with no conviction) to choose the longer probation. Had the client come back to me after pleading guilty and expressed his unhappiness with the choice he had made, I would have done everything possible to undo it. Had he come back to me and asked me to seek early termination, I would have done so. But he didn't. Instead, he waited more than a year after the case was resolved (not 1-6 months, as the client says above)—after he had chosen to commit another crime, risk revocation of his probation, spend 20 days in jail, and lose any chance of ever getting his record sealed—to complain. Had I expected this client to go around committing other crimes, I would have strongly advised him strongly to choose to try his case instead of taking probation.
