Reviewing every minute of Police body camera evidence, David constantly looked for ways to rebut the cops’ assertion that I was intoxicated, and he found the weak links in the prosecution’s case. He got me “off”. David did two things that I call genius: (1) he contested the Driver’s License suspension, and (2) he contested the legality of the arrest at the scene of the stop. Both hearings, together, resulted in the dismissal of my DWI. The Drivers License hearing (DLh) was an opportunity to put the arresting officer under oath, while being questioned. The intent was to record the officer’s testimony in one hearing, with the hope that the officer changes his testimony in later hearings/trial. BINGO! It worked! In a subsequent hearing, the officer changed his testimony , and suffered in credibility. David’s crowning achievement was contesting the legality of the arrest! An arrest at the scene is not legitimate if the legal standard of ‘probable cause’ cannot be proved by the police. If the arrest can be shown to NOT meet the legal standard of probable cause, then any evidence collected AFTER the arrest is not admissible. In other words, if the cops didn’t have probable cause to arrest me, then the blood alcohol test was not admissible, and the prosecution’s case was severely weakened. David did superb work to prepare for the probable cause hearing, and when the judge ruled in or favor, the DWI case had to be dismissed!! Let me tell you about the lawyer razzle dazzle David did to win my probable cause hearing. It’s estimated that 1 out of 1,000 probable cause hearings go in favor of the defendant (me); David beat some long odds! Immediately after the judge ruled in our favor, the prosecutor said he would drop the case! We won! David Burrows is a terrific lawyer, and a cool guy. You want David as your lawyer!
