I am a 1990 graduate of Marquette University Law School and have been practicing in Southeastern Wisconsin since that time. You can learn more about my areas of practice and experience on my web site, Facebook and LinkedIn. Areas of practice have been family law, divorce, legal separation, custody child support, guardianships, termination of parental rights, adoptions, children in need of protective services, grandparents rights, paternity, wills and estates. I also have an unique area of law practice in equine law. As a horse owner and lover, this provides me with the experience and background to assist owners and business people in contractual and litigation matters relating to horses. In August, 2022, I was admitted to practice law in the State of Illinois. This allows me to continue to represent clients in their legal matters over the bordering States having grown up in rural Southwestern Wisconsin, bordering the Illinois state line.
I am licensed to practice law in the State of Wisconsin , the State of Illinois, Eastern District of the United States District Court, and the United States Court of Appeals, 7th Circuit. I have been successful in appeals in both the State of Wisconsin and the United States Court of Appeals, 7th Circuit. I argued before the Wisconsin Court of Appeals, District I in a landmark child support case of Winkler vs. Winkler, 282 746, 2005 WI , 699 N.W.2d 652(Ct. ). In 2024,
I was honored to be in the 2024 Wisconsin Law Journal's Power List for Family Law Attorneys in Wisconsin, as well as named as a "Woman in the Lead". Throughout the years, I have often been a speaker for Continuing Legal Education courses in Family Law, Adoptions and Guardianships.
With more than 35 years of experience as a family law attorney, I look forward to meeting the needs of my clients with a problem solving approach. I have been flattered to be representing the children of former clients over the years, many of whom have told me that I have helped them to have a positive childhood, despite being children of divorced or separated families. I aspire to make the lives of my clients, and their families, more positive.

Knows the law and the family court system
I had used Jane once in the past to write up a pre-nup. A couple of years later when issues arose with my ex, I returned to Jane for her advice. What we both expected to be a simple matter taken care of within 30 days, blew into 18 month of legal bullying from my ex and his lawyer. Through it all,...

Very respectable lawer
Jane Probst handled my divorce in fall of 2014 and finalized in spring of 2015. She explained everything she was going to do in detail and did exactly that. I felt as if I was working more with a friend rather a lawyer just looking for money. Her rates were very acceptable as well. I would definitely...

STOP READING USELESS REVIEWS. YOUVE FOUND YOUR TEAM
Jane Probst is a no nonsense lawyer that doesnt take crap from anyone who doesnt sugarcoat the truth and gets the job done right the first time. I actually felt sorry for her opposing attorney when she mopped the courtroom floor with his inflated ego ( Poor Bastard). Coming from a construction ba...
"I had the pleasure of sharing a mutual client with Ms. Probst once and during our joint representation I found her to be an extremely capable attorney. She performed exemplary work on his behalf and I would happily refer clients to her."
"I feel extremely lucky to have come to know Jane. In my time knowing and learning from her my legal knowledge has grown exponentially. She is truly an expert in her field and is one of the rare talents in the legal realm who is able to think outside the box in terms of litigating and resolving cases. She is comfortable and effective in areas of the law many attorneys in our field have not even heard of, much less understand. I wholeheartedly endorse her."
"Jane is a tireless, can-do worker who will go the extra mile for her clients. She is smart, caring, and tenacious. Everything you would want in a family law attorney."
"An outstanding and well established member of the legal community. An excellent choice for any one needing representation in a domestic matter."
"I endorse this lawyer. I too practice family law and have been on AVVO for some time. I have seen Jane's answers and found myself agreeing with her probably ever time. This area of the law needs more thoughtful people like Jane."
"I gladly endorse this lawyer. Jane's clients like her, attorneys respect her, she has years of solid experience and she knows the law. Her several hundred well-written answers to questions published at Avvo.com show she cares too. If you have a custody or divorce law question, clearly she will have your answer. I highly recommend."

The BacDrop payment was not considered as marital property to be divided equally since the benefit was paid after the divorce was final. However, it was considered to be income for payment of child support.
