Replied last July 23, 2011This client called me about three o'clock in the afternoon out of the blue almost three years after her case was closed. She got upset when I did not remember any details of the case as the file was in storage due to age. When she was getting upset I stopped everything I was doing to see if I could understand the situation. I contacted the court and pulled all public records and my computer files to see what I could do. I did remember the case when I reviewed the information I could gather but I did not remember exact details. After locating the file a couple days later I remember the case well and I found she was charged with pretty serious traffic offenses (driving under suspension, driving without insurance, crossing over center of traffic and speeding). She was looking at many points on her driver's license, large fines and getting her license suspended. The police officer had written notes on the back of the ticket that she was rude and non compliant. When the court date came around, she did not appear at court for some reason. Both the prosecutor and the police officer were the nicest people but the officer had plenty to say about her mental stability. In order for me not to have to come back to court with this case or client, they agreed to drop everything but the speeding if she would show proof of insurance, show a valid license and pay the maximum fine (I think $100 plus about $75 court costs). After the prosecutor gave me the offer, I did get in contact with her by cell phone and asked her where she was and she told me she didn't know she had to be in court. I was amazed at her concluding this in any way. However, she did agree to the deal and had her insurance and license faxed to me at court. She ended up with a speeding ticket and she did not have to appear after all (which was amazing in itself). Going back to the afternoon phone call from her, I was trying to sort out what was going on with her case. I ended up running out of time that day because the court closed at 4. I told her there was little I could do that day without my file in front of me and the court being closed. She became irate. She was yelling at me telling me I guaranteed her this would go away and not be on her record. At that point I had to stop her as those words never come out of my mouth especially as it is not possible to have this "taken off her record". The law just does not work that way. If anyone reading this ever calls me, you will find I will never mislead you nor will I ever "guarantee" an outcome. If you want a guaranteed outcome, call someone else. She was also becoming belligerent. I asked her to give me a day or two so I could get the file and contact the court. She was worked up and had no interest in calming down or waiting a day or two. The entire conversation I never cursed or showed her any disrespect but it was not reciprocal on her part. She ended the conversation by calling me names and telling me she will get me back (thus the above review) and hung up on me. To this day I would still be happy to resolve any issue she had. If there was a misunderstanding, I would be happy to fix it or come up with some solution to make things right. If anyone reading this retains me and you ever have a question or concern, please give me at least one day to sort things out. If you require concrete answers within an hour when I do not have the facts immediately available to me, I am not the attorney for you. This person did pay a couple hundred dollars to me for her case. If she was not happy with how her case was handled, despite her input or lack thereof, I would have given her the money back in a moment and been happy to part ways. I work very hard to make sure my clients are happy and informed. At this very moment, I still do not know what exactly she wanted me to do to make her happy. I was happy to try then and would still be willing to try now. However, I can only do so much without her input.
