Terrible Communication/ Knowledge of Case

18 months in and have talked to case worker maybe 3-4 times most of which I have initiated. Since my second denial I am now awaiting my court date with my new case worker aphlene?, I have not had one call, I have talked to her maybe twice when I call (have to wait up to 3 days for call back according... to the VM ) have had two letters from odar but nothing from her saying she is aware (is she?) The last one from alj in Baltimore needing documents to expedite my case(have my local congressman via liaison) case will be in Tampa via video would be great if you all are as up to date as I am ..... I already had to go get all of my own medical records and mail to you even signed several forms for you to do so?, do I get any live communication as to the hearing? Who will be there with me?, what do they do?, what do I do?, can I bring a personal witness (wife)?, or do I show up and find out who's with me? Can I have a better case worker( more responsive) not blaming time length on you, but communication is really bad!! I often wonder if your disability case loads are too many? Waiting until after hearing for a more accurate review. Crowley 5653 all info on file, really hope I haven't made a bad choice this is my life at stake.

Would not reccomend

It has now been two years. I was aware disability would be a lengthy process. due to another hearing in another county for an unrelated case, I was not able to attend my hearing for disability. The caseworker was aware, and I even asked if I should reschedule my other case to be there. I was told my... hearing for disability would be continued. It wasn't, I was not there to appear and NEITHER was the attorney. My case was dismissed. Then I'm informed the judge is now requesting additional information from SSI, yet the caseworker is telling me my case is being transferred to the county I now live in, since over six months ago the firm never informed SSA I had moved. I have left several messages for the caseworker, no response back. No I have not missed a call, received any emails or letters. They just DO NOT respond! I have no idea where my claim stands, and at what stage of the process I am at.

We appreciate your comments. We encourage you to contact the law firm so that we may discuss the details regarding this case. Since we do not have the specifics, I can only respond generally to your comments. In most instances, Administrative Law Judges (ALJ) will schedule hearings months in advance of hearing. Since the hearing is scheduled with advance notice, if a client fails to appear, the ALJ may dismiss your claim. Every ALJ applies this standard differently. Some ALJ's will automatically dismiss a case for failing to appear, other ALJ's will provide an opportunity to provide good cause for failing to appear. We inform ALL our clients of these very real legal possibilities. We routinely file requests for continuance if our clients cannot attend the hearing. It sounds like from your feedback that we did file a request for continuance which was denied by the judge. Notwithstanding the denial by the judge, your feedback indicates you still chose not to appear at your hearing. There still may be appellate remedies available. Again, we encourage you to contact the law firm because even though you failed to appear at your schedule hearing, we may be able to fight to keep your claim alive.

SSD admin judge , lawyer review

went online and picked this firm for my SSD case, i was denied and then went before the SS admin judge. i talked to my appointed lawyer the nite before my hearing, i asked about papers i had sent in and he said he had what he needed, i offer my paper work and he replied "he wasn't going to go thru a... stack of papers". at my hearing i met him for the first time and only had 15min to review my case before i went before the judge. i was his second client to go before the televised judge, he came out and said to me" this judge is weird and hates florida!" this statement worried me greatly. i asked him how he liked it over here and this SS admin building, he replied" its not west palm beach "and I just want to get this over". we then went in and he honestly didn't do much and didn't have any fight in himself for my case. i asked him about how it went and he was indifferent. when i received the unfavorable decision in writing and reasons why, i reviewed the SSD letter and it was no surprise. the paper work they put together from my doctors with dates and, it a mess with inconsistency that are blatantly obvious. mostly its the time line they defined. It was different to what i have and stated to them. i believe my lawyer should have brought these points up to me. If those discrepancies were rectified then at least my case would have more merit. to be fair this was probably one lawyer out of many so yours may vary.

Don't make this Mistake

I had a bad experience how this Scott attorney handle my case at the hearing, The attorney did not even looked like an attorney and he DID NOT know anything about my conditions even though I was been represented by them for almost two years . With all the conditions I have was not enough to get a fav...orable decision and based on the letter I received from ODAR there was so many not true facts. Do yourself a favor and do not make the same mistake I did.

The medical evidence surrounding the diagnosis must show that because of an individual's medical conditions, the individual no longer retains the ability to perform any type of employment regardless of whether the individual can actually get hired to do a job. Consequently, issues such as the state of the economy, bias, and prejudice have no bearing on whether an individual will be found disabled. We appreciate your feedback. I feel it's the disability system

I have been with L & N since 2009 and I cannot say that they specifically had anything to do with the long wait. They handled my Social Security Claim and my VA Claim. It has been a long hard road with the VA. For the most part I believe that the VA is the reason my claim is taking so long. When ...I talk with the VA here in Atlanta they are unable to tell me anything that even makes sense about my appeals. If the VA cannot tell me anything about my appeals I don't think the attorneys L & N are going to get any better of an answer then they gave me. The problem is VA system its broken, its been broken for a long time and until we as Veterans demand better treatment and hold our government responsible the VA system will stay broke. In my waiting I have learned several things and that is if its not documented, time stamped and black ink with the VA letter head it has not happened. Like most I have lost faith in the law firm and the VA system, but If I am going to be fair about it, L&N has never lied to me that I can prove and they have kept me inform as best they can when you look at who they are dealing with. If the VA is going to treat a veteran with little regard imagine how they are going to treat a non veteran who is in all reality challenging their decisions. Like most I get very mad and feel like I am all alone in this fight, and yes sometimes I feel like taking it on L&N but actually they are the only ones that will actually talk to me about this. The VA doesn't. They just tell me what ever they think will get me off the line quicker. L&N has kept me informed as best they can with the information they get from the VA when they get it. One thing I have learned is just talk to one entity the attorney or the VA. If you deal with both it will just drive you crazy because in my experience nothing ever matched up. Save yourself the grief.
