I contacted the Aronfeld firm about a cruise ship accident. Even though I am a lawyer and former judge, I had no experience with this field of law. My case involved my 14 year old son during our Captain's Dinner on board the Liberty (Galveston). An unfortunate incident occurred when, after the waiter filled our water goblets, my son took a drink and upon setting the glass on the table it shattered. My son severed the ulnar nerve and 6 1/2 tendon...s in his right wrist. Talk about a panicky situation, blood was all about the dining table. I was not in the mind set or had I even thought about hiring an attorney. We are in North Texas (10 hours from Galveston) and my main concern was getting my son from Cozumel to his much needed medical care. However, my brother has a very good friend that is an attorney near our hometown just 10 miles from us. My brother contacted him because the story just seemed as though there was some negligence on Carnival's part. This attorney called me the day of my son's surgery and I was not willing to talk at this time so he called me about a week later and got my side of the story. He said he knew of an Attorney in Miami (where Carnival's headquarters was). So, then our relationship with Mr. Spencer Aronfeld began. From the get go.. Mr. Aronfeld and his staff were very attentive to our needs on phone and email correspondence. Spencer is a very caring attorney and from our stand point he wanted what was best for my son. He was willing to go the length if we were willing to walk (run) beside him. Long story short, we settled our case. We settle for way less than what Spencer recommended we do. However, that would require additional trips to Miami for doctors and court. My son did not want to make additional trips to Miami and lose time from his daily life (which he had lost enough last summer)! The best part about Spencer.... He completely understood our decision and ultimately there was no push to do anything other than what we wanted for our family! Also, Spencer constantly referred to us as "Family"! It was a comfortable fit with no pressure to act, do or be anything than what we were... a country hard working family from a small town in North Texas. When I first met Spencer and his team it was very informative and pleasurable, but as the case progressed it became confusing. I was introduced to MANY people during our case. Not sure why but it seemed every few month's I had a new person assigned to my case. This was chaotic and awkward on my behal...f because I live 6 hours north of their office and I would have to travel or spend hours on the phone "catching up to speed" the new people. As for the medical part of my claim the firm was very proactive in getting myself the medical attention I needed. Due to my injury several surgery centers and doctors were involved to satisfy my medical needs. I felt it would have been helpful, being that we lived outside of Miami, if it were explained about all the different associates who would be responsible for my case. Each time I called there I wasn't clear on who I needed to speak with. As the case grew closer to the end it became very difficult and hard to understand what was going on. What started out as a "slam dunk" now appeared to be the complete opposite in determining our case. The arrangements for our mediation were all made. It was a week long affair that involved several meetings with Mr. Aronfeld, doctor visits and a deposition. It also was a week of staying in hotels and a week out of work for my husband. BUT it was also the week that Hurricane Matthew made landfall on Florida. The week prior to leaving for Coral Gables, I would get a phone call from Mr. Aronfeld's office requesting to meet in his office on Sunday (10/2) instead of Monday (10/3) which was discussed originally. This now caused more anxiety. On Thursday (9/29) before leaving for Coral Gables I received a call from Mr. Aronfeld stating he was going to be on a "religious holiday" and was not going to be in his office early in the week and would not have time to "prep me" for the week ahead. He suggested we try to settle NOW or possibly lose my case. This was all conveyed to me over the phone in a local parking lot, I didn't even have the opportunity to get home to think about what was happening. I was blindsided to hear that the "burden of proof" had shifted and it was now MY responsibility to prove my case. What happened to the "slam dunk"? Within 60 minutes, NO council from Mr. Aronfeld pertaining what to expect or how to be proactive in this situation, I lost $40,000 and to this day have no idea how it happened. I was very upset and thrilled it was finally over. As you can see it was a bittersweet experience, the ending was not the way it had been explained, and the outcome was nothing I had expected. The many trips we had to take to Miami, due to me unable to drive, he had to take time off work. Ultimately, these absences were key in my husband loosing his job. We went into debt to cover expenses of hotels and travel costs including the unpaid days off work. We were told to keep track of all expenses when in actuality they were not factored into my settlement whatsoever. I'm glad its over, my injuries are still an issue, but I continue to get better every day. Thank God its over and I finally can live a respectful life.
