Ergio I. Fernandez

About me

I am the Founder and Managing Partner of Fernandez Legal Group, P.A.  I was born in Havana, Cuba, and raised in Miami, Florida, where I attended and graduated, with honors, from Florida International University in 1995 with dual Bachelor’s degrees in Political Science and International Relations, and a concentration certificate in Latin American Studies.   After graduation from Florida International University, I attended law school at Nova Southeastern University, where he graduated with honors in 1999.

Upon graduation from law school, I was selected, from amongst thousands of applicants nationwide, to serve as an Assistant State Attorney at the Miami-Dade State Attorney’s Office, which is one of the four largest prosecuting offices in the United States.  As a prosecutor, I was responsible for prosecuting various criminal offenses, from Driving Under the Influence to Homicides, and was quickly promoted as Assistant Chief of the Misdemeanor Division, where I performed important administrative functions, as well as supervised and trained incoming prosecutors.

My career as a prosecutor was served with the utmost honor and distinction, which allowed me to be selected to be part of the specialized Economic Crimes Unit, where I investigated, charged and prosecuted individuals accused of committing a myriad of financial offenses, ranging from Embezzlement to Racketeering.

In 2005, I culminated his stellar career as a public servant and went into private practice.  Since then, I have represented countless of individuals and corporations throughout the United States and abroad in civil, administrative and criminal matters.  In addition, I often advise small and large corporations on matters of corporate structure, governance and compliance.

My practice is primarily focused on litigation and trial work, where I have successfully represented clients in a wide array of cases in the areas of commercial litigation, shareholders and partnership disputes, trade secrets, non-compete, temporary restraining orders and injunctions, deceptive practices, real estate disputes (including failure to close and escrow deposits), foreclosure defense, banking litigation, collections, criminal defense, family law (including, divorces, domestic violence injunctions, child support, alimony, and paternity), professional malpractice, personal injury (including dog bites, slip-and-falls, dangerous conditions, car accidents, and negligent security), international litigation and arbitration, and insurance litigation (including property and casualty claims negotiations, denials, and bad faith), administrative proceedings, and appeals.

I have also counseled corporate clients and individuals in a wide range of transactional, administrative and regulatory matters, including, but not limited to, governmental audits, purchase and sale of businesses, real estate closings, corporate governance, personnel and labor issues, employment matters, international trade and business transactions, statutory and regulatory compliance, contract drafting and negotiations, partnership agreements, purchase and sale agreements, employment agreements, franchise agreements, and non-compete agreements.

I am the proud recipient of an AV Preeminent Rating from Martindale Hubbell, which is an honor only bestowed upon a select group of lawyers nationwide who have received the highest peer reviews in the areas of legal knowledge, communication and analytical skills, judgment, ethical standards, and overall legal experience.

I am fluent in written and conversational Spanish and I am a member of various courts and organizations, including the Florida Bar; the United States District Courts for the Southern and Middle Districts of Florida; the United States Court of Appeals for the Eleventh Circuit; the Association of Federal Defense Attorneys, the Cuban American Bar Association, and the American Bar Association.
