Rachel has achieved many notable results during her career representing employees. Rachel has extensive litigation experience in both state and federal courts. Rachel and Ed Buckley recently achieved a substantial jury verdict, including all of the plaintiff’s lost wages. After a week-long trial, the jury found that there was a willful violation of the Age Discrimination in Employment Act and her client was awarded the maximum amount of damages allowed by the law.

Rachel has also achieved numerous notable results on account of her significant appellate experience and has contributed to successful appeals to the Eleventh Circuit Court of Appeals. Recently, Rachel represented a school bus driver in a disability claim and drafted the appellate brief that was instrumental in convincing the Eleventh Circuit to revive the driver’s claim. Rachel also played a critical role in the Eleventh Circuit’s revival of an age discrimination claim as well as a Title VII retaliation claim.

Rachel has also taken on the Atlanta Police Department in its refusal to change its facial hair policy, which has prevented officers from being able to serve and protect their communities. This will hopefully give similarly situated police officers the ability to proudly serve Atlanta in the future.

Rachel previously litigated wage and hour claims at a boutique New York employment law firm. In this capacity, she helped secure multi-million dollar settlements in numerous collective and class action lawsuits in federal courts across the nation. Before practicing employment law, Rachel was an Assistant District Attorney in Bronx, New York where she prosecuted misdemeanors and violent felonies. As a prosecutor, Rachel conducted hearings and trials, presented cases to Grand Jury panels for indictment, and negotiated pleas.

Rachel graduated magna cum laude from Pace Law School and received her Bachelor of Arts from Sarah Lawrence College. Rachel is a member of the State Bars of Georgia and New York, the Eleventh Circuit Court of Appeals, and federal district courts in New York and Georgia. Rachel is also a member of the National Employment Lawyer’s Associate and the Georgia Association of Women Lawyers.

When Rachel isn’t working, she enjoys spending time with her husband and two young kids, exploring Atlanta, attempting to achieve Yelp’s “elite” status, and visiting her family in New York.

Great Attorney- Client Experience

Great experience
I hired Buckley Beal to represent me in an age discrimination case against my former employer. Rachel was assigned to work my case. Rachel Is the Best Their IS
Rachel Berlin is a sweetie pie but very serious about her work and looking out for her client. More importantly she is a beast. I got a pretty huge settlement thanks to her. Not to mention we were going up against a fortune 500 company. Great Assistance with Discrimination Case
Ms. Berlin provided outstanding service with my discrimination case. I had suffered long-term mistreatment, bullying and retaliation but was not sure if I had a legitimate case. With Me Every Step of the Way
From the moment I reached out and discussed my employment situation with Rachel, she was understanding, honest, engaged, and extremely knowledgeable as to the state and federal employment laws. My case was complex due to the multiple offenses I endured, including abuse, which I am finally understanding through ongoing physcological therapy. After nearly two decades with the same company and being promoted multiple times throughout the years, I was faced with standing up for what was right or sitting down and turning a blind eye to questionable ethics I witnessed from senior management. I did what was right and stood up. My decision to do this was not easy because I knew this would put me in a unfavorable category as seen from senior management. I became the target for termination/dismissal. Due to the physical and mental hardship I faced on a daily basis, my health declined. Eventually I had to take time off to recover as ordered by my Primary Care Physician. I submitted FMLA paperwork to ensure the security of my employment; however, in the end I was terminated. Recommendation and Advice on Separation Agreement
Due to a corporate reorganization with the company my department was eliminated. However, I wanted to secure expert employment legal advice with respect to the terms and conditions in the agreement. Negotiated Separation Agreement
I was recently employed in a very caustic work environment which included a verbally abusive and hostile manager with severe anger issues. The manager was subject to frequent violent outbursts and negative physically demonstrative behavior. The manager was in the process of terminating me without cause, which is allowed under Georgia law. He was constantly bullying me and resorted to falsifying records to protect himself. Ms. Berlin did an excellent job representing me. She was successful in creating and filing a separation agreement before the manager could terminate me. The agreement provided me with 5 months salary, a continuation of benefits, and protection from retribution. Ms. Berlin also put together a very strong case to seek very valid additional settlements which I decided not to pursue at the time due to health reasons. She was knowledgeable, professional, and supportive throughout the process.
