Rachel Berlin Benjamin is a partner at one of Atlanta’s leading employment law firms. She primarily represents employees who have been subjected to unlawful discrimination and retaliation and fights tirelessly for employee’s rights providing clients with compassionate representation.
Rachel has achieved many notable results during her career representing employees. Rachel has extensive litigation experience in both state and federal courts. Rachel and Ed Buckley recently achieved a substantial jury verdict, including all of the plaintiff’s lost wages. After a week-long trial, the jury found that there was a willful violation of the Age Discrimination in Employment Act and her client was awarded the maximum amount of damages allowed by the law.
Rachel has also achieved numerous notable results on account of her significant appellate experience and has contributed to successful appeals to the Eleventh Circuit Court of Appeals. Recently, Rachel represented a school bus driver in a disability claim and drafted the appellate brief that was instrumental in convincing the Eleventh Circuit to revive the driver’s claim. Rachel also played a critical role in the Eleventh Circuit’s revival of an age discrimination claim as well as a Title VII retaliation claim.
Rachel has also taken on the Atlanta Police Department in its refusal to change its facial hair policy, which has prevented officers from being able to serve and protect their communities. This will hopefully give similarly situated police officers the ability to proudly serve Atlanta in the future.
Rachel previously litigated wage and hour claims at a boutique New York employment law firm. In this capacity, she helped secure multi-million dollar settlements in numerous collective and class action lawsuits in federal courts across the nation. Before practicing employment law, Rachel was an Assistant District Attorney in Bronx, New York where she prosecuted misdemeanors and violent felonies. As a prosecutor, Rachel conducted hearings and trials, presented cases to Grand Jury panels for indictment, and negotiated pleas.
Rachel graduated magna cum laude from Pace Law School and received her Bachelor of Arts from Sarah Lawrence College. Rachel is a member of the State Bars of Georgia and New York, the Eleventh Circuit Court of Appeals, and federal district courts in New York and Georgia. Rachel is also a member of the National Employment Lawyer’s Associate and the Georgia Association of Women Lawyers.
When Rachel isn’t working, she enjoys spending time with her husband and two young kids, exploring Atlanta, attempting to achieve Yelp’s “elite” status, and visiting her family in New York.
