I am a Captain in the U.S. Army who was facing a Board of Inquiry to determine if I was retainable in the Army. A Major General ordered the board, despite the evidence showing what I believed was my innocence. Due to this, I had lost hope in the justice of the military legal system. It began with a recommendation for an article 15 for a failure to report to PT, and a failure to report to work call. I was then accused of being drunk on duty. After missing PT formation, my new NCOIC told my leadership that he expected me of being “drunk”. After being taken to the MP station for a breathalyzer test, I was found to have a .0 something BAC, and my charge was changed to incapacitated to fulfill my duties. At this point, I hadn’t thought about getting a lawyer. It wasn’t until halfway through my enrollment in the Army’s Alcohol Program in which I was questioned by CID for a pending sexual assault charge. At that very moment I knew I needed to look for a lawyer and declined to the scope of questions from CID until I had a lawyer present. Overall, I was guilty of violating a no drinking order, and having failed to report to PT; Although I lost my rank and received an oral reprimand, the article was filed locally. However, while at my second hearing, my Command Team, Battalion Commander, and CSM, took over an hour to debate on what they should do, and I have a strong feeling it was regarding the matters that Mr. Barry was able to help me with. The way Mr. Barry was able to see all angles of my case and help to showcase these angles to my Commander was truly helpful. I would not have been able to do this alone and most importantly, Mr. Barry’s helped assured me someone was on my side. I wasn’t even contacted by Army Legal until after the investigation was over because they were booked. I hired Attorney Matthew Barry after I ended up in a hole because of an attorney I originally hired named Joseph Jordan. Mr. Jordan helped to create an issue that placed me in an uphill battle that continues to this day. It has been nearly a year since I hired Mr. Barry and replaced Mr. Jordan and th...rough several IG complaints, issues with reprisal and denial of an earned promotion we've made progress and he's been patient with my constant need to stay engaged. The most recent egregious event was a Flight Evaluation Board that was convened as reprisal for an IG complaint that I filed. Mr. Barry was extremely meticulous and was intimately familiar with every detail. He showed up prepared... When I met him on post he asked, "Do you want to see what the last six months of your efforts have produced?" Of course I was interested! Mr. Barry pulled, from his bag, a large three-ringed binder that was nearly full, all things that I had gathered or had written over the previous six months. More impressive is that Mr. Barry had familiarized himself with every detail contained in that binder. He knew the information inside and out. We won that Flight Evaluation Board, the board ruled that the accusations were unsubstantiated. This did not stop a member of the chain of command from recommending that my flight status be terminated despite the board's ruling. But Mr. Barry continued to coach me and encourage me to remain calm. Several months later we received the final decision... I was allowed to keep my flight status. The final determining authority acknowledged that there was not sufficient evidence. There is more fighting and there are more uphill battles that need to be won; but winning the FEB was a significant step in the right direction. I have already recommended Mr. Barry to others. I will continue to recommend him. When a command and when the military allows commands to act and interpret regulation without oversight or redress, it is imperative to have someone in your corner.
