As noted by the writer, this latest DWI conviction was his third in 25 years. Unfortunately, but not surprisingly, the writer fails to mention that the new DWI case was charged as an Aggravated DWI, based on the 0.19 breath test result, and that only after extensive negotiations with the DA's Office was the case resolved on favorable terms for him, with a plea to a less serious "straight" DWI charge. Significantly, the negotiated sentence involved no jail time or probation supervision (more than lenient given his DWI history), enabling him to keep his job. The harsh "3 DWIs in 25 years " ramifications with the DMV were fully discussed with him both before and after his plea and sentencing and he was made fully aware of the consequences of his prior DWI convictions. I am grateful that the DMV was also able to assist him. I wish him the best moving forward.

Following bench trial, charge of Boating While Intoxicated dismissed. Client found guilty of traffic infraction of Boating While Ability Impaired and boating equipment violation.
Client charged with two counts of DWI. Charges dismissed by Court at trial following completion of arresting officer's testimony.
At jury trial, client, who refused chemical test, cleared of DWI misdemeanor and convicted only of DWAI violation
After extensive negotations with general counsel of large private university, client, facing expulsion for drug use, allowed to complete academic year. Sanction limited to semester suspension, followed by restoration to full academic status.
Following felony DWI jury trial in NYS Supreme Court, client cleared of charge. Client refused to submit breath sample. Found guilty of less serious DWAI traffic infraction.
Client stopped for entering expressway going the wrong way. Breath test results tossed out and DWI charges dismissed following trial.
Jury trial verdict cleared client of DWI after he refused all field tests and refused to submit breath sample. Found guilty of less serious DWAI infraction.

Client seriously injured in crash and analysis of his blood showed BAC nearly double the legal limit. Charged with two misdemeanor DWI counts, case resolved with plea to traffic infraction, Driving While Ability Impaired.
In highly publicized and politically charged DWI case with extensive media coverage, client took responsibility for actions and was sentenced to community service over objection of DA's Office, which instead wanted 3 years of probation.
Successfully argued appeal of County Court conviction before Appellate DIvision, Fourth Department. Conviction vacated and case returned to local court, Charges dismissed by Special Prosecutor.
Client, a student at a local college, faced with disciplinary sanctions arising from prescription addiction. Case resolved with no disciplinary action taken by college.
Client, a student at a local college, charged with on-campus felony theft crime. Felony charge reduced and resolved wtih plea to non-criminal charge and college disciplinary action dismissed.
