The situation this poster describes is untrue in many ways I will address them in turn. 1. This person's CORI is NOT in fact sealed and I know that it is NOT in fact sealed. This negative review was posted on March 6, 2024. On March 8, 2024 I personally went to the courthouse where this person had a criminal case, that was the subject of the potential sealing we discussed, and I was able to see the entire court file. If this person's record had been sealed, the court clerk would NOT have provided me with any information regarding this case and certainly would not have handed over the court file for me (or any other member of the public) to inspect. 2. The reviewer claims to have have filled out one form at Probation and then received notice that the record was sealed. This is a FALSE claim for the following reasons: a) while certain criminal records can be sealed by way of an administrative procedure wherein a form is mailed to the Office of the Commissioner of Probation (a so-called "100A petition"), only misdemeanors older than 3 years and felonies older than 7 years can be sealed in this fashion. The misdemeanor criminal charge in the present situation was less than 3 years old, and thus would not be eligible for sealing under a 100A petition; b) the processing time for a 100A petition is generally between 60-120 days once the 10A petition is received by Probation; c) the Probation department does NOT just seal your record in less than 3 weeks, even when the charge that you are seeking to seal is eligible for sealing under 100A (which the charge in this case is NOT). 3. The charge at issue for which I sent a fee agreement to the poster is a non-conviction for a misdemeanor, less than 3 years old. Misdemeanors that resulted in non-convictions, and are less than 3 years old, can only be sealed by way of a "100C Petition". A 100C Petition requires that the defendant go before a judge in the court that issued the charges and convince a judge that "good cause" exists to seal the record. They can NOT be sealed by filling out a form in the manner that the poster describes. 4. The poster never bothered to reply to the email I sent with the fee agreement. The poster did NOT inform me that the poster was going to revisit this in the future, nicely or not. I sent a follow up text to the poster the day after I sent out the fee agreement and the poster never responded to that text, which I still have. This review purports to have accomplished a record sealing in a fashion that is not possible for the criminal record in question, and implies that I attempted to overcharge the poster for legal work that was not neccessary. These are false claims, for the reasons I stated above. 1) The poster's record is NOT in fact sealed; 2) the manner in which the poster claim to have sealed the record is NOT possible under the law; 3) I have incontrovertible proof that the poster's record is NOT in fact sealed in the form of certified copies of all the documents in the courthouse file (complaint, docket sheet, police report, etc.), date stamped March 8, 2024 and AFTER the time the Poster claims to have sealed the record, none of which I would have been able to obtain if the record was sealed as the Poster falsely claims it was. The fee I quoted to poster was reasonable for the amount of work that would be entailed to do a 100C sealing petition, which is the only way to seal the poster's record at the current time.
