I made a poor decision to drive my car after a few adult beverages. Long story short, I was arrested for DUI. I was totally coherent, aware, alert, however, the police officers decided to arrest me, even after I passed my FSTs.
After my release, I contacted several attorneys to seek advice and get price quotes. Mr. Blair promptly returned my call and listened as I explained what happened. He asked me several questions regarding the circumstances of the incident. Unlike other lawyers that I spoke to later. He also asked about who I was, my history, my record, and if I thought I should have been in that situation. He didn't treat me like someone who was looking for a way out. He was kind, understanding and genuinely wanted to help me. Yet, after listening to some co-workers, I tried to secure a different lawyer. I was told this other lawyer would be much better, but after getting the run-around for almost a month, I called Mr. Blair once more. He remembered who I was and what he quoted me and was still eager to help.
After learning what my financial situation was, Mr. Blair established a payment plan for me and got right to work on my case. Any information or evidence he received was immediately sent to me at my home for review. After he reviewed the police reports, blood test results, breath test results, and my explanation, he was able to convince the district attorneys not to file charges against me. This was solely because of his extensive knowledge in blood alcohol content. He knew that when the officers pulled me over my content was lower than the limit. With that information in his hand, he was able to fight on and convince the Department of Motor Vehicles not to suspend my license.
When I decided to hire Mr. Blair, he told me what his plans were. He did exactly what he said and because of that, I will definitely be keeping his information on file. His name will be recommended to anyone in need of his services.

I was referred to Mark by a friend who had recently obtained a DUI earlier in the year and had already completed the whole process that one goes through when arrested for such a thing. I called his office as soon as I could and while he was not available in his office, he returned my phone call on his cell phone within the hour. I could tell he was extremely knowledgeable and experienced in handling DUI cases the moment we started conversing on the phone and hired him on the spot, despite the fact that I had several other lawyers on my to call list. It did not matter as not only was Mark able to reduce my charge down to a Wet Reckless for me, he was also able to convince the DMV to forego the hard suspension of my license. Needless to say, I felt reassured by his calm and collected demeanor throughout the entire ordeal. Mark is reliable, punctual, and very easy to reach. I felt that I was getting a bargain with his fixed rates, and compared to some of my colleagues experiences with their attorneys, I they share my sentiment.

I wanted to leave a review for two reasons. First, I truly believe Mark did a fantastic job with my DUI case and deserved an honorable mention. And second, to HELP any of you that may be looking for a high quality DUI lawyer to decide on the RIGHT lawyer. I was charged with my DUI in Aug of 2012. Starting that time and up to my trial in Jan of 2013 Mark (and his support staff) handled my case with the highest levels of professionalism. He was clear in his communication, always available when I had questions, kept me thoroughly informed of the entire process (with both DMV and court proceedings), shifted court dates to support a very busy personal and professional schedule, and sympathetic during this very difficult time. Sadly to say, this was my 2nd DUI and the second time I secured a lawyer to handle my case. In comparison to the previous lawyer, Mark was more effective and thorough than my first lawyer and cost me less money.
The truth is, he is NOT a miracle worker; nor would he claim that he is. What he does well is leverage his understanding of the law AND personal relationships with court judges, DA’s, and other court staff to ensure you end up with the best results possible; and that’s all you can really ask for in a good lawyer. Might I retain him to defend me if I was charge in Oregon or Florida? Probably not as he does not have the same level of relationship in those areas. But I hardly think there’s a better networked lawyer in the Santa Clara County and/or the San Jose area. Mark is deifnitley the who’s who’s of lawyers in San Jose. In the end, what prompted me to write this review is simply…”would I pay my money and have him defend me again if needed?” The answer is a definitely yes!
Hopefully you’re not reading this review. Hopefully you’ll never need Mark’s services. But if you’re looking for a great DUI lawyer in the San Jose area, you would be making a huge mistake not going with Mark Blair. For the service you get compared for the fee you will pay, you simply cannot beat his value.

I recently really messed up. I got a second DUI with an accident and a BAC of .29 while still on probabtion for my first one. I was pretty scared so I decided to hire Mike Blair as my lawyer, and I would be in jail right now if I hadn't. I don't know how he did it but my penalties were less than my first DUI (except for the 18 month DUI program and loss of license, but I don't believe there was anything that could have been done about that).
Mark always answered my emails very quickly and kept me at ease through a very troubling time. His rate is also more than reasonable considering the work he is able to do.
I don't even want to think about what the outcome of my case would have been if I hadn't hired Mark Blair, I would recommend him with no hesitations to anyone who gets a DUI

I blew a high BAC of .15 roadside, and Mark Blair was able to help me get a reduce fine of "wet and reckless."Mr. Blair also greatly helped with my DMV license being suspended. I highly recommend this Attorney Blair.

I am very happy that I chose Mark Blair as my lawyer for my DUI case. It was much more complicated than I had imagined, and he was fantastic in making sure I understood everything, at each step. Whether by phone or by email, he communicated clearly and answered all my questions. He told me everything I needed to do in order to best prepare myself for the court appearance, to optimize my chances of a favorable outcome. And when it came down to it, my outcome was as good as I had dared to hope. I would highly recommend Attorney Mark Blair!!
From our 1st phone call he has been kind, very knowledgeable and able to explain the law, procedures, & protocol with exemplary skill. He's always keeping me informed, and recommends the best advice. I had never had a DUI before, But he & his staff have held my hand and guided me wisely so far. He was able to bring my DUI down to a Wet and Reckless in court. We still have the hearing with the DMV coming soon, and I have no doubt he will do his best to help me attain a restricted drivers license verses any hard suspension as my business requires me to drive and i would face severe financial challenges and possible loss of clients if a Hard suspension is issued.

I would highly recommend Mark Blair as a DUI Attorney. He handled my case with ease and kept me informed at all times. He was honest at all times and did not over promise anything to me, which I appreciated. He was available when I needed him and spent lot of time on the phone with me answering any questions I had regarding my case. His years of experience show through his work and successful results. He was able to reduce my charge to a wet/reckless when my BAC would have pointed to a DUI. Not only was I impressed with Mark but with his assistant David as well. David was always available to assist me and handled a lot of details with the DMV and insurance that would have been time consuming and tedious. He was also extremely knowledgeable about my case and he followed through with every request I had. If you have been arrested for a DUI I would absolutely call Mark Blair. As for my case, I was facing a second DUI conviction. I was initially pulled over because I was accused of honking the horn illegally and then driving at an unsafe speed for conditions. I had no idea I was going to be questioned for alcohol because I drank the night before, slept at a friend's house, then started driving home in the morning. Well, I failed the breathalyzer and got 0.09. Went to the station and got 0.07. This is supposedly a very bad scenario because the DA can easily argue I was even higher at the time I honked my horn and sped.
I went straight to AVVO and found Mark to have a perfect score of 10, which was the determining factor for me in obtaining his representation. He got back to me right away and was very informative in our initial consult. I just knew he was the guy to hire. Throughout the process, he was very honest, gave realistic possibilities, and really did his magic in the courthouses as well as the DMV hearings.
Jumping to the outcome, my charge got reduced to a wet reckless, which is supposedly very rare for 2nd time offenders. Not only did that reduce some of the penalties, I did not even get my license suspended! It was an unbelievable outcome! Let me also state how well he handled my DMV hearing that I did not face a single day of driving privilege suspension during the whole process. I had so much to lose from this DUI charge, but now I feel like I can regain control of my life.
If you are facing a DUI charge in Santa Clara County, you are in for a rough ride because you may be facing one of the toughest DUI prosecutions known to have very little leniency. However, don't give up! If you're even thinking about hiring a lawyer, trust the AVVO score! Everyone's situation is different so there can't be any promises, but Mark will definitely give you the best outcome for your case because he actually cares. He handles numerous cases but he never hesitates to give you his full attention. Furthermore, he has so much experience with the Santa Clara County court system, his resources within the system is so invaluable. That is the magic I'm talking about. I cannot stress the importance of that. You may second guess whether or not you hired the right guy with other lawyers, but you won't with Mark.

A few months ago I wrote a review for Attorney Mark Blair on what an excellent job he did on my DUI case and what amazing results he obtained. He not only did a great job in court for me by getting the Best Possible Outcome for my case... but he also did a great job of Following Up on things afterwards. He helped me get my sentance of doing "Straight Time" switched to house arrest on the Electronic Monitoring Program (EMP). This was a huge thing for me because it saved me the horror and humiliation of doing Jail time ... and allowed me to continue to work and move forward on my path of getting my life back on track. He also helped me get things handled with DMV so that I could get my license back as soon as possible. And here is the kicker ... he did it all free of charge. This was on top of the Great Deal he gave me initially on the Fee for his services. I can say with absolute conviction ... he is not only the Best Attorney ...especially with DUI cases ... but he is also the Most Reasonable when it comes to the legal fees he charges. He and his Staff are very helpful, knowledgeable, and responsive to your needs. Furthermore ... he is not only an awesome attorney... but a really nice guy. I can't imagine anyone getting a “better shake” from an attorney ... unless they went with a Public Defender...!
And you would never get his kind of experience by going that route.

On July 20th this year, I got arrested for a DUI. My situation is that I had pulled my car over and called my husband to come get me, but a resident who I asked for help with directions decided to call police. Police came, (I was not in car when they came, however, I admitted that I drove to that location), they arrested me, I spent night in San Mateo Jail and recorded a .21 BAC. It was a horrible depressing experience. I had never been in any trouble with the law before in my life. I spend the following two days after the arrest in bed crying and searching for a lawyer. Reviewing Marks clients reviews here was what attracted me to him and on the Monday morning, I called his office. I was still very upset on the phone, but David was so kind and not in the slightest bit judgmental when he took my details and informed me that Mark would call me back. Mark called me within a few hours and explained his business model. A one time only fee that covered both court and DMV hearing. Marks style of communication is mostly written via email, but he does take calls and is patient in his response. Communicating through email is a style that suits me perfectly. If you are someone who needs a lot of face to face time with your lawyer, you might want to have a conversation with Mark about that first. I'm pretty busy so not having to visit his office was fine with me. I travel a lot for my work and my court hearing was set on a day I was due to be away, so Mark handled it for me in my absence. This spared me the embarrassment and time of having to be in court. When the police report got revealed it was pretty damning. Mark immediately advised that he felt I would get DUI conviction, 3 years probation, a fine, community service and due to my high BAC a 9 month 'enhancement' DUI school term might be a likely conviction. He advised that I enroll in 3 month DUI class and attend 3x a week aa classes before court. (I attended a few short of 40 before the sentence date). As I mentioned above, I was unable to attend court due to work, so I watched emails all day and was so delighted to hear that although I had gotten convicted of first time DUI, I got credit for community service so didn't have to do any (yahoo :)), I got a fine and 3 month (not 9 month) DUI class, (as I had already started, I was more than half way through on this sentence.) This was a phenomenal result, a few weeks later, the DMV hearing was set. My expectation was that due to the fact I was convicted with first time DUI, I would get one month mandatory off the road and 4 months restricted license. Again, Mark handled the hearing for me and all that was left was for me to wait for his email. Mark pulled off a miracle!!!! My one month mandatory off the road date was set to one month earlier so I was immediately able to get a restricted license with no time off the road. I could not be more happy with the service provided by Mark. His emails were honest and pragmatic, he never committed to more than he could deliver (in fact, my experience with him was the opposite). I never met him in person, but know that he had my best interests at heart and am happy to advise anyone who finds themself in the unenviable position of getting a DUI to call him immediately. Another individual in my DUI class also has Mark as his lawyer, and Mark succeed in getting him a 'Wet & Reckless' although he had a .16 BAC. We are both very satisfied customers and having heard results from others in DUI classes, got lucky that we decided to work with Mark. Apparently a lot of other lawyers are a lot more expensive, have hidden fees and at the end of the day, their clients ended up with standard convictions. I'm sorry for you, if you have just been arrested, I know how it feels, believe me when I say, that this too will pass, Call Mark today, with him on your side, you will get the best possible outcome.

I was facing my second dui with a BAC of .09 with a possible refusal charge in addition. Mark was able to get me the minimum sentence for a 2nd dui charge, no refusal charge, and reduced fines. The judge was even surprised at how lenient my sentence was. My only complaint would have to be that I sometimes felt when we spoke over the phone that he was confused about the details of my case and often mistaked details with other cases he was working. He was very easy to get a hold of when I had any questions and responded to emails/phone calls very promptly. I met with a handful of other lawyers regarding my case and Mark definitely was the most knowledgable of Dui's. I would definitely recommend Mark Blair to anyone facing a DUI!

A little over 4 years ago a received a DUI in Santa Clara County … which is very strict on DUI’s. It was my second within ten years… so I was very worried about what the possible outcome would be. I asked around and did some research on DUI Attorneys. I was told by several people that Mark Blair was the best… but I got schmoozed by another Attorney that said he was” The Best”…and promised that he would get My case dismissed or at the very least reduced to a lesser charge. Since my Blood Alcohol Content (BAC) was very low … right at .08% …as determined by a Breathalyzer Test…and the reason for the traffic stop was bogus… and I had two witnesses… I believed him. When I spoke to Mark Blair he was less optimistic and more realistic … So I decided to go with the other attorney who was three times more expensive than Mark Blair on his Initial retainer fee. Since I was making a lot of money at the time … and wanted to beat the DUI charge and not just reduce it… I thought it would be worth it. I couldn’t have been more wrong in my decision …! My Attorney dragged out the case for 14 months … and blew way over the initial retainer fee. I came to find out soon thereafter that he was charging by the hour … (for everything…!) and not a flat fee for all services up to the time it went to trial … if that happened… like Mark Blair does. In the end … after spending over $19,000 dollars on just attorney … I didn’t get anything dropped or reduced to a lesser charge. Although my sentence was not excessive (9 days of WWP) … I was charged with a 2nd DUI and also lost the DMV hearing and received a 1 year suspension of my driving privileges and 3 years probation. I was devastated by the whole experience and by the financial impact it had on me. During the whole 14 month duration of my DUI case I kept in touch with Mark Blair who gave me not only strait forward advice but also support and was very sympathetic with my plight. We kept in touch occasionally even after my case had been resolved. During that time I sent him several referrals whenever someone I knew got arrested and charged with a DUI. I was always pleased with the service he provided and outcomes of the cases … as were the people I referred. A little over 2 months ago I was arrested for another DUI … I was just barely finishing up all of the consequences from my last DUI and still on probation and My Suspension of my driving privileges had also not been lifted as I thought it had because of an oversight by DMV. My Blood Alcohol Level was also high at .19%... I was extremely afraid of what the consequences would be and rightfully so … I called Mark Blair and told him what had happened. He was sympathetic … and because of what I had been through the last time… and because my Financial Situation had changed for the worse… he gave me a great deal on his services… and I retained him immediately. He also helped to ease my stress by giving me an honest and accurate estimate of what the possible consequences would be. Sure enough he took care of everything with The Court Case and DMV Hearing …and advised me of what to do on my own (AA Meetings, Alcohol treatment Programs, etc.)to get the best possible outcome for my case. I followed his advice to the letter and beyond and it really paid off. I received the minimum sentence possible … which was almost exactly as he had predicted after reading the police report and charges filed against me. He also had the whole matter resolved in a little over 2 months and I was very relieved not to have it hanging over my head anymore. I would highly recommend Attorney Mark Blair to anyone arrested for a DUI charge. It’s not often in Life you can get the Best Service for the Best Price. Mark Blair deals with a high volume of cases … instead of exploiting the few unlucky clients that come their way … like many attorneys do. I recently recieved my second D.U.I. After many hours of stressful research and going through the many attorney letters I recieved in the mail I decided Mark Blairs Law Office was the correct route for me. From my first call to his office I realized this was deffinately the way to go. He is extremely professional, kept me informed on every outcome that could possibly happen; good or bad. Although untill the day of my court date I had not met him face to face, he made me feel comfortable with my choice and with no question in my mind he was the one to trust with the outcome of my case. I would highly recommend Mark and his office. The outcome of my case was a first offense D.U.I. with the minimum in all fees with no jail time. Our 18 year old son was faced with a DUI charge. As a family we were out of our comfort zone in this type of situation. I was scared to death. I got a DUI and recieved all this mail about how we are the best (DUI Attorney) Google them and you will see like I did that Mark is the best. Hoped for the best and received it.. He put me at ease during the court date, even tried to make me laugh. I did later, after everthing turned out OK. If you need a GOOD attorney he is the one.

I hit a car and got scared and left the scene because I had been drinking. It was so stupid to do, and I really didn't know how to handle all the problems that happened. I happened to find Mark on the internet. When I spoke with him, Mark was sincere. He wasn't judgmental. He listened and gave me some wonderful advice. Somehow, he got my hit and run dismissed and my .14 DUI reduced to a wet reckless! Thanks for a great job!

Mark was EXCELLENT in his approach to my delicate and very serious matter of my 2nd DUI. He was succesful in my aquittal to the DUI and was succesful at making sure I promptly was re-issued my Driver's License. He is nice, easy to work with, always reachable, hard working, very helpful lawyer. I would say the best in the bay!! Overall my experience was ok, it was my 2nd DUI within 1 year (stupid I know, first was wet wreckless) When you call you will talk to David his assistant. David is very nice, pretty knowledgeable, and will give you "hope". He went over process and what they like to do and a lot of your options before I talked to Mr. Blair. I was told they'd check calibration of machines, possibly retest blood, call my witness, check police officers record, whatever it took to get best outcome, etc.
After I got police report my blood was .17 and Mr. Blair explained that they could do enhancements and what the possible outcome would be in court. I had a sober witness with clean record and reason for pull over was 100% false and made up. Long story short I was requested to show up at Arraignment (which I didnt do in first case with another attorney, only final time when deal was already made) because he said "sometimes they offer great deals to get it over with". I showed up and was offered 18 days weekend work, 1st time fine, 18 month classes, and that they wouldnt call san mateo county and report my probation violation. Mr. Blair told me he thought this was a great deal because they wanted to give me 28 days weekend work, and call to report my voilation which could give me 10 extra days.
I really wanted to do a motion to supress because I had 1 great witness and 1 ok one (records). He told me we could do it that was option, but why and how the DA would probably break down witnesses, and if I lose motion they would give me stricter penalty. I thought about it and took the deal (which I regret now). He didnt pressure me to take the deal or anything, he just told me how he the DA would go about it and he didnt like my chances.
So overall I didnt really feel a lot of work was put into my case for the money I paid. I basically paid Mr. Blair to obtain police reports and show up a little early and negotiate a deal with DA for me. All the talking to witness, retest blood, check police officers history, etc that was told to me in initial conversation, didnt see or hear any of it being done or considered. For this reason unsure if I shouldnt have just used public defender to get something similar and save attorney fee.
Mr. Blair was very nice, always called me back quickly, and knew a lot of the processes though. He definitely has DUI's down as far as process/procedure, and he admitted the system was screwed up and Cops can lie and get away with it (the truth) which was nice to hear. He did even ask the judge to reduce the weekend work days he had already negotiated with DA, but judge didnt want to hear it and said he thought it was fair.
So your basically paying for someone to simplify the court process for you and negotiate a quick deal to reduce charges, as far as a full on "dismissal" very doubtful unless you get a miracle like mistake in police report or something.

I was in the process of moving to the East Coast when I received my DUI. I was very stressed, for the new job and the DMV dealings, and I would not be able to appear myself in court. Despite a pretty high BAC of mine, Mark was able to reduce the DUI charge to Wet-and-Reckless! He has been extremely helpful from the beginning of the hell and very clearly responded to all of my request in a timely manner.
He knew what he needed from me to gain what we wanted and clearly notified so we were able to prepare all the things. He was very professional at the court (it was today!) and made my wife and me feel relaxed and comfortable during the whole time. Thanks to his expertise, we got what we desperately hoped for without any trouble. My court case ended painlessly before I realized what happened. Mark did an excellent job with my case. He was well prepared and ready to tear the DA's case wide open. He noticed that they did not call an expert witness to testify that my blood was drawn in a "medically approved manor." However, the judge allowed the DA to re-open his witnesses and sided with the DA based on the non-professional opinions of a police officer and convicted me. Mark realized on the spot that I had grounds for an appeal and recommended an excellent appeal lawyer. I ended up winning my appeal on the same grounds that Mark had suggested the case be dismissed. He should have won in the first place and was still able to make a good recommendation that allowed for me to be treated justly by the system. I would strongly recommend Mark, he did right by me and knows his stuff!!

I will be perfectly honest with you here...as soon as I got into this mess I searched for a lawyer with the mindset that all lawyers are sharks.
Mark Blair wasn't my first choice, and even after meeting with him I had my doubts. However, he communicated sooo much information over the phone and in-person even before I retained him as my lawyer. This honesty and thorough knowledge on his part convinced me that he would be able to help me.
He is incredibly professional in that he keeps you in the loop in regards to the progress of your case. Also, he sticks true to his word, and discusses your case with you with simplicity and without false promises. He told me that the best I could hope for was a reduction of charges to a Wet Reckless. I was facing, at worst, a felony DUI because the other party involved in my high-speed accident claimed personal injury...
I don't know how he did it, but he did it. Mark Blair got my charge reduced to a misdemeanor Wet Reckless Driving charge.
I recommend Mark Blair a thousand times over for all your DUI defense needs.

I got my first and only DUI in San Mateo County and after reading many lawyer websites and making many phone calls to various lawyers I decided to retain attorney Mark Blair. Mark had some great information on his website and when I called his office his assistant David answered. David was the only assistant I spoke with in my many calls to law offices that was able to answer my questions vs. just taking a message. Also, Mark Blair made it a point to call me back the same day as I had called him even though it was in the evening as he was driving home from a day in court.
Once retained Mark Blair continued great communications throughout the whole process. Mark kept me informed of what to expect at each step both on the court side and the DMV side. Everything Mark told be to expect is exactly what happened. Mark also recommended that I start the DUI classes prior to my court date, which paid off when the DA tried to get the judge to give me more months of DUI class vs. the 3 months of class I got (the minimum). Mark met me at court before my arraignment explained to me what to expect and then resolved my case that morning in court. He then went with me upstairs to pay my fine and to get signed up for community service. On the DMV side Mark was able to minimize the impact on my license so I did not have to go through the 30 day hard suspension and instead I had a restricted license during the whole DMV penalty period.
I highly recommend retaining attorney Mark Blair if you are facing DUI charges!

I hired Mr. Blair for two separate cases. The first case turned out better than I could have hoped for. The second case , believe it or not , even turned out better than I could have possibly imagined.

Mark was wonderful. I had worked with other lawyers before, but Mark really came through for me when I needed it most. I had a third DUI, and Mark pulled some magic and got me a drunk in public! We hired Mark to help with my wifes DUI. He seemed friendly enough on the phone. However once he got our money the conversations became very short and he took much longer to return calls. On the night before she was to appear in court he called and said he "had a big case" and would not be able to make it to court the next mornign, but was sending a collegue "who is fully apprised of the case." The next day we found the woman he had sent, she was having trouble finding us as she was looking for a man based on the mispelling of my wifes name! Aslo she had no clue about our case and we had to try and fill her in on the circumstances in the 10 minutes before court started! What was even worse was on the phone he stated that his 2,000.00 fee would cover the case and when time came to help expunge her recored. Now he says we "misunderstood him" and the "law is very confusing guys." Even after I showed him the email he snet me stating that he claimed the I changed it, as he would never say anythign like that, let alone put it in writing. Bottom line is I really wishd we had hired anyone else but this guy, dont make the same mistake we did, hire somone who actually cares about you and your case and is not just looking for a paycheck.

My dad often said that there are only two things that matter in life: your reputation and your word. I couldn't agree more. When someone blatantly attacks either, you have to defend yourself.
This review is a sham. That is not to say that I am perfect, or have never made mistakes. When I make mistakes, I own up to them.
But what is written in it is simply and blatantly false and untrue.
I can state unequivocally that I have no "colleagues" or associates. I am a sole practitioner and have no other attorneys in my office. I am the person and the ONLY person who represents you. That is what I say, and that is what I put in every contract that I sign with every client. There is no, as this "review" states, " woman" or for that matter, "man" whom I send to court. I go to court for you. My clients are paying for me to go, with my experience and my knowledge of the case, not someone else.
There is one exception to my personally appearing that every attorney must consider and foresee: if an attorney is ill or is on vacation or has an emergency (stuck in traffic because of an accident on the freeway), the attorney's duty is to protect his/her client. If such an event occurs, I ALWAYS would inform my client BEFORE sending such an attorney, have my client understand why and agree to the appearance by another attorney and instruct that attorney ONLY to do what my client and I have previously agreed that the attorney would do. Moreover, if I cannot appear, my client has my cell phone number (as does the attorney), and is instructed to call me if my client has any concerns or questions.
Equally outrageous is the statement attributed to me that I supposedly told this person that I had "a big case" and could not appear on his wife's? My philosophy is that EVERY case I handle is THE big case for my client and therefore for me. I only accept cases I personally can handle, and I handle each one as if it was for a loved one or close friend. I would NEVER make such a statement to a person about have in a big case that prohibits me from appearing on his/her case.
Then this "review" says and I quote:
"Now he says we "misunderstood him" and the "law is very confusing guys." Even after I showed him the email he snet me stating that he claimed the I changed it, as he would never say anythign like that, let alone put it in writing."
Absolutely false and equally outrageous as the previous statements. I am a person of my word. If I promise something, I do it. Whomever this person is, he has NEVER shown me any Email. I have NEVER told him, nor anyone else, the "law is very confusing guys." If I make a promise, I honor it. I don't hide behind "confusion." What sort of nonsense is this? Moreover, SHOW ME THE EMAIL. There simply is none. Also, even if there was no Email, I would honor a promise if I made it. It is simply my practice to not include “expungements” in my contract (expungements are to dismiss a conviction), because my job is to prevent a conviction!
A couple final points: first, this person's wife supposedly used my services one to three years ago. If this really happened, why wait so long, several years, to mention these "problems" with my representation? Second, what happened in his wife's case? I don't see any comment about the results, which is strange, if this is a real "review." And third, why didn't the client, his "wife" write the "review" if it really happened?
So, unfortunately, I don't know who wrote this patently false set of statements, but I apologize to you, the reader, for having to read it as well as my rebuttal.
When you in life have to decide who is telling the truth between two persons each of whom you don't know, what do you do? You examine the details. The "details" of this "review" are blatantly false. I'm a Class A driver with a good driving record that made the mistake of relying on an iPhone BAC app to determine if I was safe to drive. Long story short, I got my 1st (and last) DUI in Nov. I was inundated with spam mail for DUI attorneys but Mark's mailer stuck out. I met with 3 attorneys (1 strongly recommended by my family lawyer) but after speaking with Mark, my guts told me he was my lawyer in this case. I'm ecstatic that I made the correct choice. On my initial call, I wasn't passed off to an assistant but instead spoke with Mark directly. The conversation was positive, uplifting and empowering. Attorney Mark Blair was very informative during my DUI case. He quickly responded to my emails and provided support during the time. I was an emotional and mental wreck, but he continuously assured me that things will be fine. He would send me an email to see how I was doing through my DUI process. I was arrested in the San Mateo County. My BAC level was a 0.10. At my court date, my charges came out to be a Wet Reckless, 3-month DUI Program, NO jail time, and NO community service. I received my first DUI this year in Sept. i contacted him shortly after and he took care of everything for me, which really reduced my stress level. He also kept me well informed with all the proceedings of my case with DMV as well as the court. He was able to reduce my DUI to a wet and reckless and was able to have my lisence just restricted rather thn fully suspended. He is very knowledgable about all aspects of DUI, and can explain everything in terms you can understand. He is also very personable and comforting in a time that can be scary! I strongly recommend Mark as A DUI related case attorney. From our initial phone conversation I felt confident in Marks ability and that he would give me his best attention to my case. Mark was verry flexible with payment options and made it easy for me to pay for his services. Mr. Blair was concerned and personable throughout my whole experience. I was initially hesitant to even hire a lawyer to represent me. I was advised by friends and family to just plead 'no contest' and save myself the money that I would have otherwise spent on a lawyer to pay fees and insurance instead. However, at the last minute I spoke to David, Mark's assistant, and made an instantaneous decision to trust this team. Throughout my case, Mark proved time and again what a good choice I had made in going to him. Mr Blair not only was prompt and reliable in keeping me informed of my next steps to take on my own behalf, but he was a great source of information. He was patient when I had questions and EXPLAINED why a particular defense would or would not work. In the end, he aggressively defended me in the courtroom, dropping my case down from what wold certainly have been a DUI with enhancements, to a wet reckless charge. He was at my shoulder the whole time in the courtroom help me with the judge's questions, and was the first attorney in the door to file his cases. We got in and out of the courtroom fast, I mean within 30 minutes! Getting arrested for my DUI was stressful in the extreme, but retaining Mark Blair was the best choice I made throughout the whole ordeal. He offered hope where no other lawyers I spoke to would. Trough my hardest time, when I caught my second DUI I recieved tonns of brochures. Among them was ONE, with suggestions which helped me in the future. Anyway at that hardest time I met mr.Blair who explained to me that he can back me up. And he did.
Just to tell: I had BOC .33 which is twice of my previous,
I was drivingand had a witness, in first case I was at parking lot
And with his professional help I was sentenced 2-3 times
less than my first DUI
I really apreciate his professionalism
Even with my broken english I easily understood him and was understanding me without me strugling to explain

Although Mark Blair did an incredible job with my case, I felt that after the money situation was taken care of it seemed like I was a second hand client. I appreciate all that was done, but I feel that the communication could have been a bit better, or more consistent after all the funds were collected. I gave him a good rating based on his performance in the courtroom, which he excelled in, but I his personal communication was just like any other lawyer that I have dealt with in the past. I know that I am not his only client, so I guess that I can give him a pass

Mark took my extremely stressful situation and solved nearly all the issues by explaining what was happening and how he would proceed with my case. He is calmly confidant in his knowledge of the process and shares that calming effect by sending prompt emails and fallow up calls to his clients. Mr. Blair was a great attorney throughout the duration of my case. He guided me step by step throughout the entire process and kept me completely informed on even the most minute details. He clearly demonstrated a thorough knowledge and understanding of DUI laws and regulations, and always informed me of all possible options that could be afforded to me. Also, his fixed rates were exactly what I needed considering my less than adequate financial situation. The majority of other DUI attorneys that I researched would have been twice as expensive if not more. During the duration of my case, his office was more than patient with me. Mr. Mark Blair represented me for a DUI in San Mateo County, CA. I signed a retainer with Mr. Blair as my attorney, and three months later, I resolved my DUI in court. As soon as my check was cashed, Mr. Blair repeatedly resisted my requests to meet with him. Mr. Blair did not appear at my arraignment, as per agreement. In fact, the first time I met him was at my pre-trial hearing. He was late to the hearing. In the courtroom waiting area, I stood in a line with Mr. Blair's other clients appearing in court that afternoon, waiting to speak with him. Mr. Blair and I had brief conversation (4-6 minutes) in the courtroom lobby. I had to inform him of the most basic details of my case in the courthouse. Disappointingly, he did no research about the circumstances of my case, as promised.
My experience with Mr. Blair was very unsatisfactory and a waste of money.
Lawyer’s Comment:
I disagree completely.
Before I address this individual's statement, I must state the limitations that the rules of ethics will impose on my response. An attorney must protect his client no matter what. Even if a client makes false accusations, an attorney may not divulge client confidences or info that reveals whom the client is. I must therefore address this client as "this person" so he/she remains nameless.
The first incorrect statement is, "as soon as my check was cashed." The irony is that I allowed this person to make payments. So, he/she made three payments of his/her retainer fee.
Next, this person wrote me a letter in which he/she admitted giving me information that was not full and accurate regarding his/her past convictions.
This person failed to write that he/she was involved in an accident along with the DUI. This person also failed to write that I was able to obtain his/her full license privileges back from the DMV without his/her driving license ever being suspended or restricted. Lastly, this person failed to write that I was able to get his/her DUI dismissed and obtained a reduced charge ("wet reckless") despite his/her having an accident involving alcohol.
The statement about my resisting meeting him/her is false. At this person's request and with this person's permission, I spoke with his/her father at length about this DUI case. In addition, this person failed to mention that he/she wrote a very nice e-mail about meeting my wife, whom this person agreed to have attend the arraignment (first court appearance) because they knew I had a court emergency where I had to appear elsewhere. This individual wrote me the following e-mail after court: "It was nice to meet your wife, and it must be very exciting to expect a new member to your family. Would it be possible for you and I to have a brief meeting? I have some concerns about the police report and I am working on a document outlining the important points succinctly and objectively. Please e-mail me...at your convenience."
I replied to this e-mail on the day and asked for a list of his/her concerns in the police report, and the place (i.e. page, line number) where the issue appears in the police report. I wrote that such a guide (list) would greatly benefit both him/her and me for purposes of discussion and court.
This individual agreed in an e-mail sent the next day to supply me with such a list.
But again, this person failed to write that he/she NEVER submitted to me any such statement or list which he/she had promised to send. Instead, I received an email from him/her about one month later stating he/she was concerned about the lack of progress and communication. This person the asked me to contact him/her.
I did contact him/her on the same day. In fact, I was in court all day; so, I worked late and returned client calls after 7 pm. I called this person at 8 pm on my cell phone and discussed his/her concerns at length and offered to meet him/her two days later in my office (the next day I was unavailable because I had court all day). This person agreed to call me the next day to arrange a time to meet.
However, once again, this person failed to write that he/she NEVER did as promised. He/she never called to set up an appointment. Instead, this person showed up in court at the pretrial conference. I was on time. This person never "had to wait in line" to speak with me. This person failed to write that in the county where his/her pretrial was, there is a list that attorneys must sign to speak with the judge. I went to court early in the morning that day to sign up on that list so that my clients could be out of court as early as possible that afternoon (pretrial conferences were in the afternoon).
So, there was no "line" to wait to speak with me. Again, this person failed to mention that at the pretrial conference, I got the DUI dismissed and charges reduced to a "wet reckless" despite an accident involving alcohol.

For me to respond, I cannot mention my client’s name or use any identifying information. I have to refer to my client in a non gender specific way to preserve his/her privacy.
My client had a prior wet reckless. My client was convicted not in 2011 as my client wrote, BUT in 2012, on January 4, 2012. Please note that my client’s new 2012 DUI for which my client hired me DUI occurred only SIX months after the first conviction, on June 12, 2012.
My client in my client’s new 2012 arrest had roadside tests of .16/.15 and a blood test of .17 just 35 minutes after the breath tests.
Before we went to court, I learned that my client was on probation for a “wet reckless”. I researched my client’s wet reckless case and read the conditions of probation. In January 2012, the judge ordered my client in my client’s wet reckless case NOT to drive a vehicle with any measurable amount of alcohol. In January 2012, the judge ordered my client NOT to violate the law.
Unfortunately, when my client was arrested in Jun 2012 for my client’s new DUI, my client’s drinking and driving (.15/16 and .17 blood test) violated my client’ probation in my client’s wet reckless case. I am very familiar with the jurisdiction where my client in on probation for a “wet reckless”. In that jurisdiction, judges routinely put persons in actual jail when they (1) drink and drive (2) get arrested for a new DUI offense within six months of their first conviction. Judges in that jurisdiction put persons in jail for up to 60 days for such a violation.
My client was well aware of this potential jail issue. Before we appeared at arraignment (first court appearance), we discussed the problems with being on probation. I had my client appear in court at the arraignment (first appearance) because we wanted to see if we could as early as possible in the case, avoid any actual jail time and avoid the district attorney in the new DUI case from contacting the district attorney’s office in my client’s wet reckless case to violate my client’s wet reckless probation. We were both concerned that a prosecutor could simply pick up the telephone, call the other jurisdiction, and have my client violated on my client’s probation. So we went to court with the idea of trying to obtain the best offer and then weigh accepting the offer vs the risks of setting the case for a motion to suppress the evidence.
A person on probation has the following risks when arrested for a new offense in such little time after being placed on probation. First, when a person is violated on probation, the judge can remand (put in jail) immediately the person. Moreover, a person remanded into jail on a probation violation does NOT have a right to bail. That means, the judge can simply leave the person in jail until the probation violation is resolved. As previously indicated, the jurisdiction where my client was on probation, sentences persons to 60 days or more of jail for such violations.
My client was aware of all the above. We were also concerned that the prosecutor for the new (second offense DUI) arrest would want actual jail as well. When a person is on probation for such a small amount of time and is arrested again for a new DUI, especially one in which the person is over two times the legal limit, the person can face 30 to 60 days or more of real jail on the second offense.
So, I had my client appear, because as my client and I had discussed, if we could (1) avoid jail, (2) avoid the prosecutor contacting the other jurisdiction about the probation violation) and (3) minimize my client’s second offense sentence, my client would be quite fortunate. We would weigh all the above against litigating the motion.
My client absolutely agreed. My client was concerned that my client may have a motion to suppress the evidence, because my client believed that the officer did not have a valid reason to pull my client over. My client had a passenger in my client’s vehicle who my client thought could support this position.
