Because you chose to identify yourself I can't / won't share anything about the facts & circumstances of your case with the folks who read this but I can still comment on a few things without breaching any Ethical Rule regarding maintaining Confidentiality of Communications & Client Confidence & or your Attorney-Client Privilege. Dear Rodrigo, Thank you very much for your kind words in what is now #HaberPA's 274th 5-Star Client Review on AVVO. Because you haven't fully identified yourself & as "Rodrigo" is a very uncommon first name in the USA (aside alert: "Rodrigo" is a common masculine name in Spanish & Portuguese, in fact in 2011-12 it was the #1 most popularly given masculine name in Portugal, as of today it regularly ranks between the 30th & 60th most common names in Spain & Portugal but in the US it's well outside of the top 500, most recently ranked beyond 900 & some estimates have it low as as 1 in every 3,700 baby boys being named Rodrigo) it'd be borderline impossible for anyone to either identify you or to locate your case based upon this response to your Client Review. Still, to both ensure that you can't be identified and that no one would even know where to look I won't pinpoint the location / identify where this happened as I explain to the folks what it is that you had to deal with & what it was that I was able to do for you in your case. That said you were referred to me by a mutual friend. We had never met before you called me & your faith in me was a direct result of your faith in our mutual friend. Upon meeting you explained to me that you had been contacted by an unnamed Deputy Sheriff from an unnamed SoFlo County with regard to a traffic accident that you were involved in several months earlier. You did not Leave the Scene of that accident; rather you remained on scene, were fully debriefed by Responding Officers & gave them a complete, accurate, unbridled statement as to "the why" of the accident, after which you were permitted to go on your way. The reason that you were contacted many months later by the Sheriff's Office is that your accident involved a pedestrian fatality, it took some time for the responding municipal Police Department to "hand it off" to the County, for a Traffic Homicide Investigator to be assigned, for that person to review the case & ultimately contact you to give a new statement so that the case could be closed (one way or another, e.g. there was no way to know how the Traffic Homicide Detective viewed the case & ultimately it was s/he who'd make the call whether you'd be cited, Arrested or given a complete pass). You hired me to liaise between you & Police, to determine whether we were dealing with Officer Friendly or Officer Unfriendly & to advise you as to your most prudent course of action. I made contact with the Deputy & found him to be quite candid. He shared far more information with me than Cops usually do, I was quite satisfied that he was in agreement with the initial assessment that this was nothing more than a tragic accident & so I agreed to appear at the Traffic Homicide Division with you with the understanding that I would make the call in real time as to whether or not you were going to make any further statement. (Aside alert: Florida's Accident Report Privilege requires citizens to disclose information about Traffic Crashes to Traffic Crash Investigators & in exchange for doing so any statement you make is inadmissible in both Criminal Court & Civil Court, but you're only obligated to give one statement, which you'd done at the time of the accident.) When we met at our agreed date and time the Deputy was every bit as much a gentleman in person as he was over the phone. He accepted & respected my invocation of your rights, reviewed the data from his file on the record (e.g. the Traffic Crash Report, your prior statement and statements of others) showed us the Traffic Monitoring Camera & private surveillance footage that Law Enforcement had acquired which, together with your statement, that of witnesses and the conclusions of the Police Accident Reconstructionist proved that it was truly an accident, albeit a tragic one, & in the end he issued you a Civil Citation. For reasons which I'll explain below I'm extremely grateful that you posted it rather than your partner (my actual client), but before I get to that please accept my appreciation for the way you quantified your value for my communication & effectiveness. One of the pillars of #HaberPA is my constant effort to serve my clients in a boutique fashion (i.e. as "a small company that offers highly specialized services") & that all starts & ends with frequent dialogue & prompt service. I admit that my "bedside manner" isn't always as tactful & nurturing as some would like (after all my job is to defend my client's ass not to kiss it) so when I manage to combine communication, emotional support, & professional demeanor (as I apparently achieved in this instance) I'm extraordinarily proud. That said let me explain why I'm glad that it was you who posted this review & in so doing make this response relevant to the folks who read it. Just this past Saturday (June 27th) I filmed 18 new #HaberPA VideoFAQs for #MichaelHaberLaw (my YouTube channel which currently has 401 but is soon to expand to 419 short, informative & hopefully entertaining "Webisodes" on all sorts of issues in the Criminal Defense, Criminal Law, Criminal Procedure, Constitutional Law, Evidence, DUI, BUI, Domestic Violence, Probation, Crime Victim Rights & Seal & Expunge arenas) including these beauties: # # 411: If Someone else pays my Legal Fees can my Lawyer speak with them? # 412: What is the "Attorney-Client Privilege"? & # 413: What is "Client Confidentiality"? (Shameless plug alert: If you've not yet subscribed to "MichaelHaberLaw" then please do @ www.youtube.com/c/michaelhaberlaw ) It's fortuitous that your Client Review hits all 3 of those points & therein lies the relevance. You were a "3rd Party Payor" for your partner but he (not you) was the client & therefore he (not you) was the benefactor of both the "Attorney-Client Privilege" & "Client Confidentiality". [Rhetoric question alert:] Okay but what does any of that mean & why is it relevant to the folks who read this review? First, anyone can hire / pay a lawyer to represent someone else (e.g. parents do it for kids, some bosses do it for employees, everyone who gets Court Appointed Counsel like a Public Defender has a lawyer paid for by 3rd party taxpayers & here you did it for your domestic partner) but there are 3 catches: 1) The Client must give "Informed Consent" (i.e. the client must agree to that lawyer's services); 2) the 3rd party can't interfere with the lawyer's "independence of professional judgment" (i.e. the payor is merely that - the payor - not the client & can't influence the lawyer's perspective); & 3) unless there's an informed waiver by the client the payor isn't entitled to any confidential information (i.e. the Attorney-Client relationship doesn't extend to the payor). Second, as to "privilege" & "confidentiality" (the former being a legislative creation which is subsumed into the later, which is a far broader ethical mandate), despite who pays the Legal Fee a lawyer's fiduciary duty is exclusively to the client. Unless the client expands the relationship to include the payor the payor is entitled to nothing more than to make the payment(s). Of course a Client who accepts "bought & paid" counsel is free to waive confidentiality (& thus privilege) & allow her/his lawyer to share as much or as little as the client wishes with anyone else, & many clients do waive confidentiality (in part or in whole - as your partner did here) & allow the payor to play a role in the case. Your partner authorized me to speak with you in writing (in our retainer agreement) about all aspects of the case as he was more comfortable in relying on your judgment than his own (which was fine with me as it was his informed wish). Knowing this I used my vast familiarity with the system to explain "the what, why & how" of things to you, to breakdown your situation to its's fundamentals, to ease your mind as best I could & once we had fully vetted the facts & circumstances of your case (i.e. both your Arresting Officer's Probable Cause Affidavit & your version of events) I was able to both formulate & explain to you a rational, achievable game plan & then quote you a fair fee to accomplish our goal. "The best part about working with Michael is his communication. Facing a felony is terrifying, but he was always available and responsive. He actually answered my calls and questions in real time and never left me hanging or wondering what was going on. He kept me updated and involved the entire time." I've been reading The Florida Bar's Disciplinary Reports since I was licensed in 1991 & when I was a young lawyer Trust Account violations were the most common basis for Lawyer Discipline. Dear Ryan, Thank you for your kind words in the form of #HaberPA's 271st 5-Star Client Review on AVVO. As of 2024 Ryan was the 87th most popular name for boys (& the 702nd for girls) in the USA but more importantly as no one can identify you & as yours is an excellent learning opportunity for anyone who reads this response I'm quite comfortable in sharing more about your situation with the folks. You got pulled over on 09/17 & were issued a citation for driving a vehicle with an expired registration. (Aside alert: You weren't stopped for a moving violation; rather your Traffic Stop occurred because your license plate was surreptitiously scanned by an Automated License Plate Reader - i.e. a high-speed camera system that automatically captures & transmits license plate data - which was mounted on a Police Squad Car & which alerted Officer Friendly that your vehicle registration was expired. Note that ALPRs can also be stationary but in either event they "red flag" vehicles for any of many reasons - e.g. an expired tag, a suspended Driver License, a Warrant for the registered owner, a Stolen Vehicle Report, an Amber Alert, etcetera - they provide Law Enforcement with Probable Cause to stop the flagged vehicle & anything that happens thereafter is usually fair game - e.g. a DUI arrest.) You read the citation, did a little internet research, took matters into your own hands & attempted to provide timely Proof of Compliance to the Clerk of Court counting on an automatic dismissal. Unfortunately you were woefully unsuccessful, both in terms of complying & in providing proof the thereof. That said you didn't become aware of your “double-fail” until 10/04 when you were once again red flagged by another ALPR, stopped & received yet another citation for driving a vehicle with an expired registration. As a bonus this time your "Stop Cop" was "Officer Unfriendly" & he slapped you with two more Traffic Tickets, one for having no Proof of Insurance & the other for failure to change your address on your driver license. (Aside alert: As to Proof of Insurance you claimed to have digital proof on your phone but that the Cop refused to look, insisting on a physical insurance card & as to the failure to change your address the only reason that you got that ticket was because when the Officer asked you if the address on your DL was correct you said "no".) 10/17 was the 30th day after your first citation was issued & as you hadn't either paid the citation, elected Driver Improvement School or pled "Not Guilty" & requested a Trial you received a notice of suspension of your Driver License for the first ticket at which time you contacted me to figure out what happened & to get you righteous with the Court & DMV. I researched your Driver History, pieced together what had happened, entered appearances as your lawyer in both cases, filed a "Motion for Relief" seeking to have the "D-6 Suspension" that was issued on 10/17 rescinded, set-aside & otherwise vacated, provided instructions making it easy for you to reregister your vehicle & to change the address on your FL-DL & once you provided me with documentation I prepared & properly electronically filed effective compliance notifications & as of today (11/26) all of your citations have been dismissed. The lessons here are: 1) Defending traffic tickets isn't rocket science but it's still legal work, everything lawyers do involve rules, procedures, policies, protocols & deadlines & so even for "minor" matters instead of playing lawyer hire one (i.e. your choice to "pro se" represent wound up costing you far more than it would've had you lawyered-up in September, plus you may not have been cited in October); & 2) the less that you say to The PoPo is usually for the better (i.e. you didn't need to "confess" to another infraction & a lawyer could've helped you to resolve the issue). Anyhow it's all good now, I'm glad you're once again righteous & appreciate your Client Review! Gratefully, MAH/Esq / #HaberPA
