Description: This was a DUI trial where the defendant was accused of driving a motor vehicle while under the influence of alcohol to the extent that it was less safe for him to drive. The defense was able to conclusively show that he had consumed no alcohol for several hours prior to driving. In addition, the arresting officer failed to properly administer the field sobriety tests. The case originated when an ambulance driver reported a green car driving poorly. The arresting officer testified that the car in question was driven by the defendant. The defendant's car, however, was blue. The defendant was convicted only of having an open container of alcohol and failing to maintain his lane of travel.
