Moody v. Shinseki

Case Conclusion Date: 11.23.2011

Practice Area: Administrative Law

Outcome: Judgment for the appellant veteran

Description: This was a veteran's case at the Court of Appeals for Veterans Claims in Washington, D.C. The Board of Veterans' Appeals had denied back benefits to Mr. Moody, holding that despite a settlement entered into by the parties at the Court of Appeals for the Federal Circuit in 2005 regarding the processing of the case, the Board was no longer bound by the settlement. Mr Jackson briefed the case and persuaded Judge Lance to reject the Board's position and order the case remanded for processing consistent with the terms of the earlier settlement
