Excellent but wish I knew more

Mr. Nanna handled my bankrupcy case with a favaroble outcome. He was able to deliver what he said he was going to deliver. My only concern is that Once I hired Mr. Nanna, I never heard anything back from him. All the information I have was sent to me from the court.

Thank you for saving my home

Bad advice from Thomas Nanna

I hired Thomas Nanna to help me with my bankruptcy. In our first meeting I was told to list all of my creditors. I question a debt that I had with my bank for floating checks. I had been making weekly payments to my bank to pay this debt down. Mr. Nanna advised me to include this debt in the bankrupt...cy and to stop making my weekly payments. I was uncomfortable with this advise and I asked my bank about it. My bank told me that floating checks is a felony and that a felony supersedes a bankruptcy. After telling this information to Mr. Nanna, again his advise was to include it in the bankruptcy and to immediately stop paying the bank. His exact words to me were: "The states attorneys office is too busy chasing real criminals to worry over something like this". I followed my attorneys advise, two weeks later I was arrested in my home. My bankruptcy was dismissed, and I was left with a felony on my record.

Replied last May 14, 2011

The Bankruptcy Code allows the Debtor to pay NSF checks through a Chapter 13 bankruptcy payment plan. This is recommended since it gives the consumer the benefit of spreading the balance over 60 months. However, if a Debtor fails to make the Chapter 13 payments, the case is dismissed by the Court. Upon dismissal, the Debtor is without bankruptcy protection. In simple terms, a Debtor must timely make all the required payments to the Ch. 13 Trustee to remain protected. All Ch. 13 clients are fully aware of this "pay to stay" concept. It is the responsibility of the Debtor to make sure the Trustee gets paid so that bankruptcy protection remains in place against the creditors. Otherwise, as in this case, the creditors may take action.
