This case was filed with the intent to stop client's foreclosure sale and obtain mortgage modification on a first mortgage which was over $30,000 in arrears. We successfully obtained a temporary loan modification and got client back on track with the mortgage. However, in order to obtain final court approval a/k/a confirmation, the second mortgage was to be paid by the client and payments were to be current which was never done. Therefore, the case was dismissed. We then attempted to reinstate the case after the client got the second mortgage current but the judge denied the request. This case was filed pro-Bono which means the client was not asked to pay any attorney fees. However, when it was recommended to file a new case by both the Judge and myself, we requested a very low fee. Unfortunately, this review was written immediately after the request for attorney fees in connection to re-filing a new case. Not sure why this client is stating that our office represented him for three years since the case was filed in 2016 and dismissed in 2017. Nevertheless, we sincerely wish this client and his family the best of luck.

The Bankruptcy Code allows the Debtor to pay NSF checks through a Chapter 13 bankruptcy payment plan. This is recommended since it gives the consumer the benefit of spreading the balance over 60 months. However, if a Debtor fails to make the Chapter 13 payments, the case is dismissed by the Court. Upon dismissal, the Debtor is without bankruptcy protection. In simple terms, a Debtor must timely make all the required payments to the Ch. 13 Trustee to remain protected. All Ch. 13 clients are fully aware of this "pay to stay" concept. It is the responsibility of the Debtor to make sure the Trustee gets paid so that bankruptcy protection remains in place against the creditors. Otherwise, as in this case, the creditors may take action.
